AN ORDINANCE AMENDING ZONING RESTRICTIONS
FOR PROPERTY LOCATED AT 2568 & 2570 TAYLOR
LANE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property and generally
identified in the attached Rezone Exhibit is hereby changed from R-3, One- and Two-
Family Residential District to B-1, Neighborhood Business District:
LOT 2, BLOCK 54, HIGHLAND PARK, NINETEENTH FILING.
TOGETHER WITH:
THE SOUTH HALF OF PUEBLO BOULEVARD, ADJACENT THERETO
AND THE NORTH HALF OF TAYLOR LANE, ADJACENT THERETO.
TOTAL REZONED AREA CONTAINS 0.40 ACRES, MORE OR LESS.
SECTION 2.
The rezoning is approved with the following conditions:
1. Provide a complete landscaping plan complying with Section 17-4-7 of
the Pueblo Municipal Code for review and approval.
2. Provide a complete site plan complying with the site plan requirements
for public improvements and transportation (parking) for review and
approval.
3. Install landscaping and site improvements (as per approved site plan)
All conditions must be complied with within one (1) year from the date of approval
of the rezoning at City Council.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of the Ordinance to effectuate the policies and
procedures described herein.
SECTION 4.
This Ordinance shall become effective immediately upon final passage and
approval.

SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY
LOCATED AT 2568 & 2570 TAYLOR LANE
SUMMARY:
Applicant is requesting to rezone the subject property from R-3 to B-1, Neighborhood
Business District
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The subject property is located at 2568 & 2570 Taylor Lane. The applicant is requesting
to rezone the property from R-3 to B-1, Neighborhood Business District to utilize the
property for a for a youth vision clinic next to their existing dentistry clinic. The proposed
use is not permitted in the existing R-3 Zone District; however, it is allowed as a use by
right in the B-1 Zone District. As a condition of the proposed rezoning, the applicant will
have to bring the property into compliance with the B-1 Zone District, which includes
landscaping, site improvements, public improvements, parking and transportation
requirements. These requirements are to ensure the property will not have a negative
impact on the surrounding properties.
Staff has received complaints regarding the associated property to the east, 2603 Taylor
Lane, due to the employees parking on Taylor Lane. Staff understands that the business
owners of the property require the employees to park on the street, rather than in the
business parking lot. To mitigate this issue, the applicant has worked out an agreement
with the church across the street to allow the employees to park in the church parking lot
during business hours. With this agreement, staff feels all negative impacts of the
rezoning have been addressed.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their July 12, 2017 Regular Meeting, voted 4-1
with Commissioner Latka absent, and Commissioner Castellucci dissenting, to
recommend approval with the following conditions of approval:
1. Provide a complete landscaping plan complying with Section 17-4-7 of the Pueblo
Municipal Code for review and approval.
2. Provide a complete site plan complying with the site plan requirements for public
improvements and transportation (parking) for review and approval.
3. Install landscaping and site improvements (as per approved site plan) within one
(1) year from the date of approval of the rezoning at City Council.
4. Provide a copy of the parking agreement with the church.
Condition 4. has been complied with by the applicant. Conditions 1 through 3 must be
complied with within one (1) year from the date of approval of the rezoning at City Council.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
