HomeMy WebLinkAbout09178 ORDINANCE NO. 9178 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE STATE OF COLORADO, THE DEPARTMENT OF HIGHER EDUCATION, HISTORY COLORADO, THE COLORADO HISTORICAL SOCIETY FOR A GRANT IN THE AMOUNT OF $201,900, ACCEPTING MATCHING GRANT FUNDS TOTALING $265,000 FROM PUEBLO COUNTY COMMISSIONERS, GOODNIGHT BARN PRESERVATION, INC., EL POMAR FOUNDATION AND TRUSTEES, THE GATES FAMILY FOUNDATION AND THE JENNIE AND ALBERT GERSICK FOUNDATION, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $466,900 RELATING TO THE GOODNIGHT BARN RESTORATION PROJECT, PHASE 1, AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, the State of Colorado, Department of Higher Education, History Colorado, the Colorado Historical Society have offered funds through Contract 2017-01-047; and, WHEREAS, total matching grant funds in the amount of $265,000 have been offered by the Pueblo County Commissioners, the Goodnight Barn Preservation Inc., El Pomar Foundation and Trustees, the Gates Family Foundation and the Jennie and Albert Gersick Foundation towards the cash match amount; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Contract between the City of Pueblo, a Municipal Corporation, and the State of Colorado, for the use and benefit of the Department of Higher Education, History Colorado, the Colorado Historical Society, 2017-01-047 (hereinafter referred to as the “Contract”), a copy of which is attached, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. Subject to encumbrances by the Colorado Department of Higher Education, History Colorado, the State Historical Fund, funds from SHF #2017-01-047 in the amount of $201,900 are hereby budgeted and appropriated for the Goodnight Barn Restoration Project, Phase 1, PL1704. SECTION 3. Matching funds from the Pueblo County Commissioners in the amount of $131,850 have been accepted and are hereby budgeted and appropriated for the Goodnight Barn Restoration Project, Phase 1, PL1704. SECTION 4. Matching funds from the Goodnight Barn Preservation, Inc. in the amount of $75,650 have been accepted and are hereby budgeted and appropriated for the Goodnight Barn Restoration Project, Phase 1, PL1704. SECTION 5. Matching funds from El Pomar Foundation and Trustees in the amount of $27,500 have been accepted and are hereby budgeted and appropriated for the Goodnight Barn Restoration Project, Phase 1, PL1704. SECTION 6. Matching funds from the Gates Family Foundation in the amount of $20,000 have been accepted and are hereby budgeted and appropriated for the Goodnight Barn Restoration Project, Phase 1, PL1704. SECTION 7. Matching funds from the Jennie and Albert Gersick Foundation in the amount of $10,000 have been accepted and are hereby budgeted and appropriated for the Goodnight Barn Restoration Project, Phase 1, PL1704. SECTION 8. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance and Agreement to effectuate the policies and procedures described therein. SECTION 9. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE STATE OF COLORADO, THE DEPARTMENT OF HIGHER EDUCATION, HISTORY COLORADO, THE COLORADO HISTORICAL SOCIETY FOR A GRANT IN THE AMOUNT OF $201,900, ACCEPTING MATCHING GRANT FUNDS TOTALING $265,000 FROM PUEBLO COUNTY COMMISSIONERS, GOODNIGHT BARN PRESERVATION, INC., EL POMAR FOUNDATION AND TRUSTEES, THE GATES FAMILY FOUNDATION AND THE JENNIE AND ALBERT GERSICK FOUNDATION, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $466,900 RELATING TO THE GOODNIGHT BARN RESTORATION PROJECT, PHASE 1, AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME SUMMARY: This Ordinance approves a contract between the City of Pueblo and the State of Colorado Higher Education, History Colorado, the Colorado Historical Society, State Historical Fund for a grant in the amount of $201,900. This Ordinance also accepts matching grants from various organizations and Foundations in the amount of $265,000. This Ordinance will budget and appropriate a total of $466,900 for the Goodnight Barn Restoration Project, Phase 1, PL1704. PREVIOUS COUNCIL ACTION: City Council approved Ordinance No. 8779, dated October 14, 2014, which established the project number PL1704, budgeted and appropriated funds in the amount of $42,350 relating to the Goodnight Barn Stabilization Project and approved the Contract with the State Historical Fund. City Council approved Resolution No.13287, dated August 24, 2015, which awarded a construction contract to Arc Valley Construction, Inc. for the Goodnight Barn Stabilization Project. BACKGROUND: On March 28, 2016, City Council through Resolution No. 13405, authorized the submittal of a grant application to the Colorado State Historical Fund in the amount of $200,000 related to the Goodnight Barn Rehabilitation Project. The City was to provide the matching grant in the amount of $415,000 for a total project of $615,000. The City fell short of its grant matching goal of $415,000 by $150,000. The Goodnight Barn Stakeholders and the State Historical Fund (“SHF”) decided to reduce the scope of the project and proceed with the restoration project. The new reduced project scope will consist of construction administration, restoration of the foundation, grading, structural rehabilitation, repair and reconstruction of masonry, removal and replacement of the roof, reconstruct the original pigeon cote and cupolas, secure doors and windows and remove the milk house addition. The remaining restoration items will need to be completed as funds become available. The SHF grant in the amount of $201,900 includes $200,000 for restoration and $1,900 for an update of the conservation easement held by the Pueblo County Historical Society. The SHF grant agreement required the City to provide local matching funds in the amount of $265,000 which combined with the SHF grant provides $466,900 for the project. The breakdown of the matching grant funds is detailed in the financial implications section below. FINANCIAL IMPLICATIONS: The Project shall consist of the following amounts and funding sources to be budgeted and appropriated for Project No. PL1704: State Historical Fund $201,900 Pueblo County $131,850 Goodnight Barn Preservation Inc. $ 75,650 El Pomar Foundation and Trustees $ 27,500 Gates Family Foundation $ 20,000 Jennie and Albert Gersick Foundation $ 10,000 Total Funds $466,900 BOARD/COMMISSION RECOMMENDATION: The Historic Preservation Commission has recommended the project. STAKEHOLDER PROCESS: The Goodnight Barn Stakeholders Committee has endorsed the project. ALTERNATIVES: The Project will not go forward if the donated funds are not accepted and budgeted.
