HomeMy WebLinkAbout09170ORDINANCE NO. 9170 AN EMERGENCY ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE COLORADO DEPARTMENT OF TRANSPORTATION AS PART OF THE RESPONSIBLE ACCELERATION OF MAINTENANCE AND PARTNERSHIPS PROGRAM WHEREAS, the Pueblo Area Council of Governments (PACOG) submitted pre- applications to the Colorado Department of Transportation (CDOT) on May 1, 2013 requesting the acceleration of funds through the Responsible Acceleration of Maintenance and Partnerships Program (RAMP) for the construction of safety, congestion mitigation, and other improvements on Interstate 25 (I-25) and US-50 between Wills Boulevard and Purcell Boulevard; and WHEREAS, CDOT determined that the pre-applications submitted by PACOG met the criteria and intent of the RAMP Program and authorized the submittal of final applications requesting the acceleration of funding for the I-25 and US-50 corridors; and WHEREAS, final applications were jointly submitted by the City of Pueblo and Pueblo County, rather than PACOG, in order to include formal agreements and commitments to provide local matching funds including cash contributions from the City of Pueblo and commitments to accept the long-term ownership and maintenance (devolution) of CDOT owned roadways through mutually agreeable Intergovernmental Agreements; and WHEREAS, CDOT has now submitted an Intergovernmental Agreement to the City of Pueblo pursuant to the foregoing applications which sets forth the terms and conditions to accept long-term ownership and devolve Highway 227 also known as Joplin Avenue from milepost 0.309 to milepost 1.851, to City of Pueblo; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Intergovernmental Agreement (IGA) between the City of Pueblo, a Municipal Corporation and the Colorado Department of Transportation, as part of the Responsible Acceleration of Maintenance and Partnerships Program (RAMP), having been approved as to form by the City Attorney, is hereby approved by the City Council of Pueblo. SECTION 2. The President of City Council is hereby authorized to execute and deliver the Final Agreement on behalf of the City of Pueblo, A Municipal Corporation, and the City Clerk shall affix the seal of the City thereto. SECTION 3. Due to time constraints existing by virtue of the fact that the approval authority for execution of the Agreement granted by the Transportation Commission expires September 13, 2017, good cause exists for the passage of this Ordinance as an emergency ordinance pursuant to Section 3-20 of the City Charter. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the attached contract/agreement to effectuate the transactions described therein. SECTION 5. This Resolution shall become effective immediately upon passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Earl Wilkinson, Director of Public Works SUBJECT: AN EMERGENCY ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE COLORADO DEPARTMENT OF TRANSPORTATION AS PART OF THE RESPONSIBLE ACCELERATION OF MAINTENANCE AND PARTNERSHIPS PROGRAM SUMMARY: Attached for consideration is the approval an Ordinance approving an Intergovernmental Agreement between the City of Pueblo, a Municipal Corporation and the Colorado Department of Transportation as part of the Responsible Acceleration of Maintenance and Partnerships Program (RAMP) transferring ownership and maintenance responsibilities of State Highway 227 (Joplin Avenue) to the City of Pueblo. PREVIOUS COUNCIL ACTION: Resolution 12756 authorized the commitment of the City of Pueblo to accept ownership and maintenance of certain State Highways as local matching funds for an application requesting State and Federal transportation funding for I-25. Resolution 12856 authorized the President of City Council to sign a letter of commitment assuring that the City of Pueblo remained committed to entering into a partnership with the Colorado Department of Transportation concerning the I-25 (Ilex to City Center Drive) project. BACKGROUND: The RAMP program accelerated funding for selected project included in the FY2014 and FY2015 Colorado Statewide Transportation Improvement Plan. The City of Pueblo and Pueblo County jointly submitted two RAMP applications that received final approval providing funding to I-25 between Ilex bridge structure and City Center Drive and for US50 West between will and Purcell Boulevard; both projects are under construction. The RAMP application required a local match from both the City and County. To meet the match requirement both entities made a commitment to accept maintenance and ownership of a State Highway (City – SH227; Joplin Avenue and County – SH223; Baxter Rd). The attached Intergovernmental Agreement is the formal agreement setting forth the terms and conditions associated with transferring the ownership and maintenance of SH227 (Joplin Avenue) to the City. FINANCIAL IMPLICATIONS: The long-term cost to the City for accepting the ownership and maintenance of this roadway is an ongoing routine expenditure; periodic surface treatment, and long-term maintenance of the bridge structure of the Arkansas River. An annual routine maintenance cost of $29,500 is estimated for maintenance of Sh227. The long-term expenses assumes a 1.5 inch overlay costing approximately $450,000 in 2020 and the rehabilitation of the bridge structure crossing the Arkansas River totaling $3 million in 2023. In the event the bridge crossing needs replaced in the future, the bridge is eligible to receive Off-System Bridge Funds that currently pay 80% of the replacement cost. In addition, the inclusion of the additional miles of roadway will increase the amount of HUTF funding the City receives. BOARD/COMMISSION RECOMMENDATION: Not Applicable.
