AN ORDINANCE APPROVING A TRANSPORTATION
ALTERNATIVES PROGRAM INTERGOVERNMENTAL
AGREEMENT STE M086-077 (21985) BETWEEN THE CITY
OF PUEBLO, A MUNICIPAL CORPORATION, AND THE
COLORADO DEPARTMENT OF TRANSPORTATION;
AUTHORIZING THE TRANSFER OF $125,000 FROM THE
CONSERVATION TRUST FUND BALANCE; BUDGETING
AND APPROPRIATING ADDITIONAL FUNDS IN THE
AMOUNT OF $825,000 INTO PL1703, TRAIL
CONSTRUCTION-ARKANSAS RIVER LEVEE PROJECT,
AND AUTHORIZING THE PRESIDENT OF COUNCIL TO
EXECUTE SAME
WHEREAS, the State of Colorado, Department of Transportation, has offered
funds through Contract STE M086-077, River Trail Extension Study; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Intergovernmental Agreement between the City of Pueblo, a Municipal
Corporation, and the State of Colorado, for the use and benefit of the State Department
of Transportation for Transportation Alternatives Program STE M086-077 (21985)
(hereinafter referred to as the “IGA”), a copy of which is attached, having been approved
as to form by the City Attorney, is hereby approved.
SECTION 2.
Subject to encumbrances by the Colorado Department of Transportation, funds
from TAP M086-077 (21985) in the amount of $700,000 are hereby budgeted and
appropriated for the Arkansas River Trail Extension Study and First Phase Construction,
Project No. PL1703, Trail Construction-Arkansas River Levee Project.
SECTION 3.
Funds in the amount of $125,000 are hereby transferred from the Conservation
Trust Fund Balance into PL1703, and budgeted and appropriated for said Project.
SECTION 4.
Local matching funds for TAP M086-077 (21985) in the amount of $50,000 were
previously budgeted and appropriated into PL 1703, through Ordinance 9130 approved
on May 22, 2017, including matching funds from the following sources:
Colorado Department of Local Affairs-EIAF 8250 $25,000
Pueblo Conservancy District $15,000
Conservation Trust Funds Transfer from CI1111 $10,000
SECTION 5.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of the Ordinance and the attached agreement to
effectuate the transaction described therein.
SECTION 6.
The President of the City Council is authorized to execute and deliver said IGA in
the name of the City and the City Clerk is directed to affix the seal of the City thereto and
attest same.
SECTION 7.
This Ordinance shall become effective immediately upon final passage and
approval.

SUMMARY:
This Ordinance approves a Transportation Alternatives Program Intergovernmental
Agreement between the Colorado Department of Transportation and the City of Pueblo,
transfers funds from the Conservation Trust Fund Balance in the amount of $125,000
into PL1703 and budgets and appropriates additional funds in the amount of $825,000
into PL1703.
PREVIOUS COUNCIL ACTION:
Ordinance 9130 approved a contract between the City of Pueblo and the Colorado
Department of Local Affairs, accepting matching grant funds from the Pueblo
Conservancy District, establishing project number PL1703, and budgeting and
appropriating funds contingent upon the execution of the funding contract with CDOT for
the Transportation Alternative Program.
BACKGROUND:
The Department of Planning and Community Development, in partnership with the Pueblo
Conservancy District (PCD) and Colorado Department of Local Affairs (DOLA), has
obtained a funding award in the amount of $700,000 from the Colorado Department of
Transportation, Transportation Alternatives Program (TAP). Pursuant to prior Ordinance
9130 approved on May 22, 2017, local matching funds for TAP M086-077 (21985) in the
amount of $50,000 were previously budgeted and appropriated into PL 1703. In October
of 2016, the Colorado Department of Transportation awarded the City of Pueblo
$200,000 in TAP funding for Planning and Design of the Arkansas River Levee Trail
Improvements and $500,000 in TAP funding to be used for the first phase of construction
of the Arkansas River Levee Trail Improvements. Funding from TAP was not available
until July 2017, when CDOT’s fiscal year began. Therefore, the Arkansas River Levee
Master Plan Project and funding awarded by DOLA was contingent upon execution of the
funding contract with CDOT. The total amount of the Project PL1703 will be $875,000.
The Project consists of contracting with a consultant to develop a Master Plan and First
Phase Construction of Trail improvements within the 2.75 miles of the Arkansas River
th
Flood Levee corridor extending from 15Street to the Runyon Lake State Wildlife Area.
FINANCIAL IMPLICATIONS:
The total Project budget, PL1703 will be funded through the following sources:
Colorado Department of Transportation-Arkansas Levee Planning
and Multimodal Connections project $200,000
Colorado Department of Transportation-Arkansas Levee Multimodal
Connections project (future encumbrance and appropriation by CDOT) $500,000
City of Pueblo (transfer from CTF Balance) $125,000
Colorado Department of Local Affairs (budgeted pursuant to Ordinance 9130) $ 25,000
Pueblo Conservancy District (budgeted pursuant to Ordinance 9130) $ 15,000
City of Pueblo (budgeted pursuant to Ordinance 9130) $ 10,000
Total $875,000
BOARD/COMMISSION RECOMMENDATION:
Not Applicable.
STAKEHOLDER PROCESS:
The City of Pueblo has coordinated with the Pueblo Conservancy District to integrate
public improvements as part of the reconstruction of the Arkansas River Flood Levee.
The PCD has conducted numerous public meetings in preparation for the reconstruction
of the levee, and additional public outreach will be incorporated into this planning effort.
ALTERNATIVES:
The Project will not go forward if it is not funded.
RECOMMENDATION:
Approval of the Ordinance.
