HomeMy WebLinkAbout09160 ORDINANCE NO. 9160 AN ORDINANCE ESTABLISHING CAPITAL IMPROVEMENT PROJECT ED1702 – UNITED AVENUE RAILROAD CROSSING REPLACEMENT AND MAINTENANCE CONTRACT PROJECT, BUDGETING AND APPROPRIATING $300,000 FOR SAID PROJECT, AND TRANSFERING FUNDS FROM THE 1992-2021 SALES AND USE TAX CAPITAL IMPROVEMENT PROJECTS FUND WHEREAS, the City of Pueblo has an obligation to maintain the industrial railroad spur at the Airport Industrial Park, and WHEREAS, the deterioration of the railroad crossing poses a danger to the motoring public; and, WHEREAS, this project fulfills the intent of the 1992-2021 Sales and Use Tax Capital Improvement Projects Fund. WHEREAS, Capital Project ED1702 - United Avenue Railroad Crossing Replacement and Maintenance Contract project needs to be established and funds budgeted and appropriated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Project No. ED1702 - United Avenue Railroad Crossing Replacement and Maintenance is hereby established. The amount of $300,000 is hereby budgeted and appropriated to said project SECTION 2. Funds in the aggregate amount of $300,000 are hereby authorized to be transferred, expended and made available out of the 1992-2021 Sales and Use Tax Capital Improvement Projects Fund for the sole purpose of the job creating capital improvement project. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Earl Wilkinson, P.E., Director of Public Works SUBJECT: AN ORDINANCE ESTABLISHING CAPITAL IMPROVEMENT PROJECT ED1702 – UNITED AVENUE RAILROAD CROSSING REPLACEMENT AND MAINTENANCE CONTRACT PROJECT, BUDGETING AND APPROPRIATING $300,000 FOR SAID PROJECT, AND TRANSFERING FUNDS FROM THE 1992- 2021 SALES AND USE TAX CAPITAL IMPROVEMENT PROJECTS FUND SUMMARY: This Ordinance establishes a capital project, budgets and appropriates funds in the amount of $300,000 for the United Avenue Railroad Crossing and Maintenance Contract Project. PREVIOUS COUNCIL ACTION: There have been numerous actions in the past to maintain the industrial railroad spur. BACKGROUND: The City of Pueblo is responsible for the maintenance of the industrial railroad spur that services the properties at the east end of the Airport Industrial Park. The railroad crossing was reconstructed as part of the United Avenue reconstruction project several years ago by Pueblo County; however, the wooden ties and subgrade have deteriorated and no longer provide adequate support for the trackage and concrete crossing panels. FINANCIAL IMPLICATIONS: The total project cost is $300,000. Funding will come from the 1992-2021 Sales and Use Tax Capital Improvement Projects Fund. BOARD/COMMISSION RECOMMENDATION: None STAKEHOLDER PROCESS: Not Applicable ALTERNATIVES: The railroad crossing would be closed to railcar deliveries and/or car/truck traffic restrictions (lane closures / reduced speed limits) would be imposed on United Avenue in the vicinity of the crossing If the City does not approve this Ordinance and repair the railroad crossing, RECOMMENDATION : Approval of the Ordinance.
