HomeMy WebLinkAbout13763As Amended August 28, 2017 RESOLUTION NO. 13763 A RESOLUTION SUBMITTING TO THE ELIGIBLE ELECTORS OF THE CITY OF PUEBLO, COLORADO AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7, 2017, A QUESTION ESTABLISHING A ONE-QUARTER PERCENT SALES AND USE TAX RATE FOR A TEN-YEAR PERIOD FROM JANUARY 1, 2018 THROUGH DECEMBER 31, 2027 TO IMPLEMENT THE VIOLENCE AND CRIME REDUCTION ACT AND ADOPTING ORDINANCE NO. 9145 TO IMPLEMENT THE TAX BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The question of adopting Ordinance No. 9145, thereby amending Title XIV of the Pueblo Municipal Code by the addition of a new Chapter 13 shall be submitted to a vote of the eligible electors of the City at the City's General Municipal Election to be held on November 7, 2017. The ballot question (submission clause and title) therefore shall be as follows: Ballot Question No. 300 (Tax to Reduce Crime and Violence) SHALL THE CITY OF PUEBLO’S TAXES BE INCREASED BY $3.5 MILLION ANNUALLY (FIRST FULL FISCAL YEAR INCREASE) AND BY WHATEVER AMOUNTS ARE RAISED ANNUALLY THEREAFTER, FOR A TEN-YEAR PERIOD FROM JANUARY 1, 2018 THROUGH DECEMBER 31, 2027 BY ADOPTING ORDINANCE NO. 9145 IMPOSING A ONE-QUARTER PERCENT ($0.0025) CITY SALES AND USE TAX RATE AND SHALL THE CITY OF PUEBLO APPROVE POLICE AND YOUTH ORIENTATED COMMUNITY-BASED PROGRAMS TO REDUCE OVERALL VIOLENCE AND CRIME IN PUEBLO, TO INCLUDE NEW AND EXPANDED GRANT- BASED PROGRAMS FOR PREVENTION, INTERVENTION AND OUTREACH, TARGETING AT-RISK YOUTH, YOUNG ADULTS AND MOST AT-NEED NEIGHBORHOODS; WITH FUNDING FOR EACH INDIVIDUAL PROGRAM APPROVED IN CONSULTATION WITH NATIONAL CONSULTANT(S) AND AUDITORS, USING COMMUNITY ASSESSMENTS AND ANNUAL AUDITS TO ENSURE THAT ALL PROGRAMS WORK TO REDUCE VIOLENCE IN CRIME; AND THAT A CITIZEN’S “PUBLIC SAFETY ADVISORY PANEL,” PROGRAM DIRECTOR, GRANT MANAGER AND GRANT COMMITTEE BE IMPLEMENTED FOR ADVISEMENT; AND THAT SALARIES AND TRAINING BE PROVIDED FOR AN ESTIMATED 24 POLICE OFFICERS, TO INCLUDE FUNDING FOR A “COMMUNITY POLICING UNIT” WITH AT LEAST TEN “PROBLEM SOLVING OFFICERS,” BASED OUT OF SUBSTATIONS, TO WORK WITH TEN NEIGHBORHOOD COUNCILS ON CRIME REDUCTION PLANNING; AND AN AT LEAST FIVE MEMBER “VIOLENCE AND CRIME REDUCTION UNIT;” ALL WITH QUARTERLY ACCOUNTABILITY REPORTS TO COUNCIL AND ANNUAL COMMUNITY MEETINGS TO PROMOTE COOPERATION BETWEEN POLICE AND “SAFE PUEBLO” PROGRAMS PROVIDED BY FOR THIS ORDINANCE? YES _____ NO _____ SECTION 2. The City Council does hereby find, determine, and declare that the ballot title set forth in Section 1 hereof fairly expresses the true meaning and intent of the proposed Ordinance. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to implement the policies and procedures described herein. SECTION 4. This Resolution shall become effective upon final passage and approval. Kogovsek, City Attorney, Law Department SUBJECT: A RESOLUTION SUBMITTING TO THE ELIGIBLE ELECTORS OF THE CITY OF PUEBLO, COLORADO AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7, 2017, A QUESTION ESTABLISHING A ONE-QUARTER PERCENT SALES AND USE TAX RATE FOR A TEN-YEAR PERIOD FROM JANUARY 1, 2018 THROUGH DECEMBER 31, 2027 TO IMPLEMENT THE VIOLENCE AND CRIME REDUCTION ACT AND ADOPTING ORDINANCE NO. 9145 TO IMPLEMENT THE TAX SUMMARY: This Resolution refers initiated Ordinance No. 9145, referred to as “Tax to Reduce Violence and Crime” to the voters of the City of Pueblo at the November 7, 2017 General Municipal Election. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Petition Representatives Jenny Paulson, Russell A. Johnson and Sarah Lott have circulated and submitted a Petition signed by registered electors equal in number to five (5) percent of the total votes cast in the last General Municipal Election pursuant to Section 18-1 and 18-2 of the City Charter. The City Clerk issued a Certification on August 24, 2017 validating the Initiated Petition for Ordinance No. 9145 determining that the number of signatures on said Petition to be sufficient under the City Charter to qualify this ballot question as an Initiative to be submitted to the voters of the City of Pueblo. No Protest of the Initiated Petition has been filed by a registered elector residing in the City of Pueblo pursuant to C.R.S. 31-11-110 (1). FINANCIAL IMPLICATIONS: This Resolution will have no financial impact on the cost of the upcoming municipal general election. BOARD/COMMISSION RECOMMENDATION: Not Applicable STAKEHOLDER PROCESS: Petition Representatives have submitted the Proposed Ordinance to the City Council as an Initiative under the City Charter. ALTERNATIVES: The City Clerk issued a Certification on August 24, 2017 which validated the Initiated Petition for Ordinance 9145 by finding the number of signatures on said petition to be sufficient under the City Charter. Pursuant to the City Charter, Council is required to either adopt Ordinance 9145 within 30 days without alterations, or submit the citizen’s Initiated Ordinance to a vote of the people at the November 7, 2017 General Municipal Election.
