HomeMy WebLinkAbout09150As Amended August 14, 2017 ORDINANCE NO. 9150 AN ORDINANCE SUBMITTING TO THE ELIGIBLE ELECTORS OF THE CITY OF PUEBLO, COLORADO AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7, 2017, A BALLOT QUESTION CONCERNING THE ESTABLISHMENT OF A STREET REPAIR ENTERPRISE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The ballot question of establishing a Street Repair Enterprise shall be submitted to a vote of the eligible electors of the City at the City’s General Election to be held on November 7, 2017. The ballot question (submission clause and title) therefore shall be as follows: QUESTION NO. 2C - STREET REPAIR ENTERPRISE SHALL THE CITY COUNCIL ESTABLISH A STREET REPAIR ENTERPRISE? YES NO SECTION 2. The officers and staff of the City are directed and authorized take all action necessary, appropriate or required to implement the provisions of this Ordinance. SECTION 3. This Ordinance shall become effective upon final passage and approval. Nawrocki and Members of City Council VIA: Gina Dutcher, City Clerk FROM: Sam Azad, City Manager SUBJECT: AN ORDINANCE SUBMITTING TO THE ELIGIBLE ELECTORS OF THE CITY OF PUEBLO, COLORADO AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7, 2017, A BALLOT QUESTION CONCERNING THE ESTABLISHMENT OF A STREET REPAIR ENTERPRISE SUMMARY: Attached is a proposed Ordinance referring the creation of a Street Repair Enterprise to the voters of the City of Pueblo at the November 7, 2017 General Municipal Election. PREVIOUS COUNCIL ACTION: Not applicable. BACKGROUND: To repair the City’s streets, approximately $3.5 million per year in additional revenue is needed. Revenue from the Street Repair Enterprise would be spent primarily on streets which are in “poor” or “acceptable” condition, which is about forty-seven percent (47%) of the City’s current street network. FINANCIAL IMPLICATIONS: It is anticipated that fees would be assessed which would result in an additional $3.5 million in revenue per year, with a cost adjustment when necessary to keep up with construction inflation. Fees would be charged based on the traffic produced by a particular land use. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Members of the public are the primary stakeholders affected by the proposed Ordinance. The issue of funding street repairs has been discussed at various public Council Meetings and Work Sessions during the past year. ALTERNATIVES: If the Ordinance is not approved, the voters will not have an opportunity to approve or disapprove the creation of a Street Repair Enterprise. RECOMMENDATION: This Ordinance must be adopted in order to refer the ballot measure to the voters. Attachments: Proposed Ordinance
