HomeMy WebLinkAbout03112 ORDINANCE NO. 31.12 AN ORDINANCE RELATING TO STATE HIGHWAYS PROVIDING FOR CERTAIN TRAFFIC REGULATIONS THEREON; AND PARTICULARLY RELATING TO STATE HIGHWAY NO . 227 IN THE CITY OF PUEBLO, COLORADO; DEDICATING THE SAME TO THE PEOPLE OF THE STATE OF COLORADO AS A PART OF STATE HIGHWAY NO. 227 , AND RECOG- NIZING THE RIGHTS OF THE DEPARTMENT OF r HIGHWAYS OF THE STATE OF COLORADO TO CON- STRUCT AND MAINTAIN THE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 . This ordinance is to be construed as a contract be- tween the State of Colorado and the City of Pueblo. SECTION 2 . The public necessity and convenience requires that a portion of State Highway No. 227 , specifically that portion of said highway which falls between Portland Avenue and Damson Street, which lies in and on a street of the City of Pueblo, commonly known as Joplin Avenue and Joplin Avenue Extension, be widened and reconstructed in accordance with the plans and specifications of Project No. US 0025 (4) of the Department of Highways , State of Colorado. SECTION 3 . The above mentioned portion of the said street is hereby dedicated to the People of the State of Colorado as connecting links in and as a part of Colorado State Highway No. 227 ; recognizing that the street or highway has priority over local intersecting streets . SECTION 4 . The City of Pueblo recognizes the right of the De- partment of Highways , State of Colorado, and its contractor or contractors , to proceed at once or at any time in the rrr�rrrr� • future, to construct the connecting links of Colorado State Highway No. 227 in the City of Pueblo on the portion of the street involved. SECTION 5 . The portion of the street when constructed and im- proved, shall remain a through street; the City of Pueblo acknowledges the right of the Colorado Department of Highways to place signs and warnings at points selected by the Depart- ment for the purpose of informing the traveling public that the portion of the street is a through street and for the purpose of requiring such stops and speeds and other traffic controls as may be necessary to protect the traveling public in the use of said portion of the street. That no commercial activity or encroachment shall be permitted within the right- of-way boundaries of said street, and that the width from curb-to-curb of said street shall be a minimum of sixty-eight (68) feet. SECTION 6 . On any portion of said State Highway connecting link within the City of Pueblo no person shall violate any of the provisions of Chapter 13 , Colorado Revised Statutes , 1963 , nor any of the laws amending the same, or any of the rules or regulations issued pursuant thereto. Nothing herein shall be deemed to deny the applicability of Chapter 26 of the Code of Ordinances of the City of Pueblo. In the event of conflict, Chapter 26 of the Code of Ordinances of the City of Pueblo shall apply in all matters of local and municipal concern, and Chapter 13 , ' 63 CRS shall apply only in matters of purely State-wide concern. - 2 - • SECTION 7 . Parking is hereby prohibited on said street or por- tion thereof at certain places specified in 13-5-73 CRS 1963 , as amended; parking when and where permitted shall be parallel as provided by law for parallel parking; traffic control de- vices on said street shall conform to the uniform standards as adopted by the State Department of Highways ; and upon the basis of engineering and traffic investigations by the De- partment of Highways, and by the City of Pueblo it has been determined that a reasonable and true prima facie speed limit on the said street shall be a minimum of twenty-five (25) miles per hour in the business districts and a minimum of thirty-five (35) miles per hour on the remaining portions, provided that standard signs are erected giving notice of the authorized speed as provided by Chapter 13-5-33 (4) and -34 (2) , CRS 1963 , as amended. SECTION 8 . There shall be no parking whatsoever on any road- way or contiguous shoulder of said State Highway connecting link within the City of Pueblo during the times and at places where snow removal operations are in progress . SECTION 9 . Any police officer of the City of Pueblo is hereby authorized and required to enforce the provisions of the ordinances of the City of Pueblo upon said highway and the Municipal Judge shall have jurisdiction to hear and try any person charged with such violations and if such person be guilty, to punish such person as provided in the above men- tioned Code of Ordinances of the City of Pueblo. - 3 - SECTION 10 . All traffic and parking regulations hereinafter adopted which pertain to the streets and roadways hereinabove described, shall be submitted to the Department of Highways for approval in accordance with the provisions of Chapter 120-13-35 (8) , CRS 1963 , before they become effective. SECTION 11. All parts of ordinances in conflict herewith are hereby repealed. SECTION 12 . If any provisions of this ordinance, or applica- tion thereof to any person or circumstances is held invalid, such invalidity shall not effect other provisions or appli- cations of this ordinance which can be given effect without the invalid provisions or applications , and to this end the provisions of this ordinance are declared to be severable. SECTION 13 . This ordinance shall be in force and effect im- mediately after passage and final approval. INTRODUCED LL , 1967 BY CHAR-USE.
