A RESOLUTION SETTING A PUBLIC HEARING FOR
AUGUST 14, 2017 TO DETERMINE IF THE AREA
PROPOSED TO BE ANNEXED COMMONLY KNOWN AS
THE AIRPORT WEST ANNEXATION, PHASE 1, PHASE 2,
AND PHASE 3 MEETS THE APPLICABLE REQUIREMENTS
OF C.R.S. 31-12-104 AND 31-12-105 TO ESTABLISH
ELIGIBILITY FOR ANNEXATION UNDER THE MUNICIPAL
ANNEXATION ACT OF 1965
WHEREAS, a Petition for Annexation of the area described in Section 1 hereof
has been filed with the City Clerk,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Petition for Annexation of the following described area situated in Pueblo
County, Colorado, through the Resolutions 13517, 13518, and 13519, approved by the
Pueblo City Council on September 12, 2016, was hereby found and determined to be in
substantial compliance with the provisions of C.R.S. §31-12-107 (1) of the Municipal
Annexation Act of 1965:
PHASE 1 ANNEXATION
I. AREA TO BE ANNEXED:
A parcel of land, located in the S 1/2 of Section 15, the NE 1/4 of Section 21, Section 22
and the N 1/2 of Section 27, all being located in Township 20 South, Range 64 West of
the 6th P.M., County of Pueblo, State of Colorado, with all the bearings contained herein
based upon a bearing of N88°04'28"E, as measured between the W 1/4 Corner of said
Section 15, being marked on the ground by a 3 1/4" aluminum cap on #6 rebar, PLS
31161, 2000, found in place, and the E 1/4 Corner of said Section 15, being marked on
the ground by a 3 1/4" aluminum cap on #6 rebar, PLS 10093, 19840, found in place, said
parcel being more particularly described as follows:

III. CERTIFICATION OF PERIMETER:
The perimeter of the parcel of land to be annexed, as shown and described hereon, meets
the required 1/6 contiguity with the current city limits of the City of Pueblo.
SECTION 2.
A public hearing to determine if the area proposed to be annexed meets the
applicable requirements of C.R.S. §31-12-104 and C.R.S. §31-12-105 to establish
eligibility for annexation under the Municipal Annexation Act of 1965 shall be held before
the City Council in Council Chambers, Second Floor, City Hall, One City Hall Place,
Pueblo, Colorado on Monday, August 14, 2017, commencing at 7:00 p.m. or as soon
thereafter as City Council business allows. The City Clerk shall publish notice of the public
hearing once a week for four successive weeks in the Pueblo Chieftain. The first
publication of such notice shall be at least thirty (30) days prior to the date of the hearing.
A copy of the published notice, together with a copy of the Petitions for Annexation, shall
be sent by registered mail by the City Clerk to the Board of County Commissioners and
the County Attorney of Pueblo County and to any school district or special district having
territory within the area to be annexed at least twenty-five days prior to the date of the
hearing.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Resolution to effectuate the policies and
procedures described herein.
SECTION 4.
This Resolution shall become effective immediately upon passage and approval.

1, PHASE 2, AND PHASE 3 MEETS THE APPLICABLE REQUIREMENTS
OF C.R.S. 31-12-104 AND 31-12-105 TO ESTABLISH ELIGIBILITY FOR
ANNEXATION UNDER THE MUNICIPAL ANNEXATION ACT OF 1965
SUMMARY:
This Resolution sets a public hearing for City Council to determine if the areas proposed
for annexation commonly known as the Airport West annexation comprised of 1,311.79
acres meet the applicable requirements of C.R.S. 31-12-104 and 31-12-105 under the
Municipal Annexation Act of 1965.
PREVIOUS COUNCIL ACTION:
The City Clerk received annexation petitions on August 29, 2016 for the annexation of
1,311.79-acre area separated into three phases including Phase 1 - 867.39 acres, Phase
2 - 287.387 acres, and Phase 3 - 157.013 acres. On September 12, 2016 City Council
approved Resolutions 13517, 13518, and 13519, finding that the petitions for annexation
were valid under the provisions of Colorado Revised Statutes Section 31-12-107(1).
BACKGROUND:
The Airport West Annexation is a three-phase annexation of property totaling 1,311.79
th
acres located between North 27 Lane, Cesar Chavez Blvd (SH47), and Baculite Mesa
Road,south of Pete Jimenez Blvd, and north of Rawlings Blvd. This Resolution sets a
public hearing on August 14, 2017 for City Council to determine if the areas proposed for
annexation meet the applicable requirements of C.R.S. 31-12-104 and 31-12-105 under
the Municipal Annexation Act of 1965. The City Clerk will publish notice of the public
hearing once a week for four successive weeks in the Pueblo Chieftain. The first
publication of such notice shall be at least thirty (30) days prior to the date of the hearing.
A copy of the published notice, together with a copy of the Petitions for Annexation, shall
be sent by registered mail by the City Clerk to the Board of County Commissioners and
the County Attorney of Pueblo County and to any school district or special district having
territory within the area to be annexed at least twenty-five days prior to the date of the
hearing.
FINANCIAL IMPLICATIONS:
The Petitioners acknowledge and agree that upon the annexation, the property shall
become subject to the Charter, ordinances, resolutions, rules, and regulations of the City,
but that the City shall have no obligation to furnish or extend municipal services, including
but not limited to sanitary sewer services, to the area proposed to be annexed. The City
of Pueblo will provide police and fire protection services to the area, in addition the public
roads and sanitary sewer main extensions will be maintained by the City of Pueblo once
they have been constructed and accepted by the City.
BOARD/COMMISSION RECOMMENDATION:
The City Planning and Zoning Commission reviewed the annexation at the February 8,
2017 Regular Meeting. A motion to approve the proposed annexation was made by
Commissioner Lucas, seconded by Commissioner Webb with the following conditions of
approval:
1. The annexation plats for the three phases shall be approved by the Director of Public
Works.
2. An annexation agreement is approved and signed by all Petitioners and/or authorized
representatives.
3. In compliance with C.R.S.31-12-105\[1\]-\[e\], the City Council shall approve an update
to the three-mile annexation plan prior to any final approval of the annexation.
Motion passed 5-0 (Latka and Lujan-Slak absent).
STAKEHOLDER PROCESS:
The annexation petitions have followed the required process established by State
Statutes within Municipal Annexation Act of 1965.

Approval of the Resolution setting the public hearing for the Airport West Annexation.
