HomeMy WebLinkAbout09140 ORDINANCE NO. 9140 AN ORDINANCE AMENDING CHAPTER 6 OF TITLE I OF THE PUEBLO MUNICIPAL CODE BY THE ADDITION OF A NEW SECTION 1-6-11 RELATING TO THE CREATION OF A MUNICIPAL COURT MARSHAL POSITION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicates new matter being added) SECTION 1. Title I, Chapter 6 of the Pueblo Municipal Code is hereby amended by the addition of a new section 11 to read as follows: Sec. 1-6-11. Municipal Court Marshal. There is created within the municipal court the position of Municipal Court Marshal. The Municipal Court Marshal shall not be a sworn police agent of the Pueblo Police Department and shall not be entitled to any of the retirement, pension, disability or other benefits to which sworn police agents are entitled. The Municipal Court Marshal may be appointed as a part-time unclassified or classified position and shall be a peace officer, as defined in Article 2.5 of Title 16, C.R.S., while engaged in the performance of his or her duties. Enforcement authority of the Municipal Court Marshal shall be limited to providing security for the Pueblo Municipal Justice Center, transporting, detaining, and maintaining control over prisoners, executing all arrest warrants within the Pueblo Municipal Justice Center and its grounds, executing municipal court arrest warrants within the City limits, and serving legal process issued by the municipal court within the City limits. SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately after final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Carla Sikes, Pueblo Municipal Court Judge SUBJECT: AN ORDINANCE AMENDING CHAPTER 6 OF TITLE I OF THE PUEBLO MUNICIPAL CODE BY THE ADDITION OF A NEW SECTION 1-6-11 RELATING TO THE CREATION OF A MUNICIPAL COURT MARSHAL POSITION SUMMARY: Attached is an Ordinance which makes revisions to Chapter 6 of Title I of the City Municipal Code by the addition of a new Section 1-6-11 relating to the creation of a Municipal Court Marshal Position. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Municipal Court does not currently have any formal security. Police officers may be in or around the Court for trial or other reasons but this presence is not consistent. Municipal Court staff may deal with people who are disoriented, hostile and verbally or physically abusive. This behavior presents a threat to Municipal Court staff and the public. Consistent and regular presence of a Court Marshall will discourage disruptive behavior and allow it to be immediately addressed reducing the risk of injury to staff and the public. In addition, the Court Marshall will have the ability to execute arrest warrants within the City limits. Municipal Court has hundreds of outstanding arrest warrants that are not actively pursued. Typically, an arrest warrant is only acted upon if the defendant has police contact for some other reason. The Court Marshall will be able to notify people of their warrants and if necessary, arrest them and bring them before the Court. This will allow the Court to resolve and close cases more efficiently. FINANCIAL IMPLICATIONS: The Court Marshall is position is a temporary part-time position with a starting wage of $15-$20 per hour depending on experieince. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: Municipal Court could continue to operate without security but with a potential risk to staff and the public. RECOMMENDATION: Approve the Ordinance. Attachments: Proposed Ordinance
