HomeMy WebLinkAbout09130 ORDINANCE NO. 9130 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE STATE OF COLORADO DEPARTMENT OF LOCAL AFFAIRS IN THE AMOUNT OF $25,000, ACCEPTING MATCHING GRANT FUNDS FROM THE PUEBLO CONSERVANCY DISTRICT $15,000, TRANSFERRING FUNDS IN THE AMOUNT OF $10,000 FROM CI1111, ESTABLISHING PROJECT NUMBER PL1703 AND BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $50,000 RELATING TO THE PUEBLO ARKANSAS RIVER FLOOD LEVEE MASTER PLAN PROJECT, AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, the State of Colorado Department of Local Affairs has offered funds through Contract EIAF 8250; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Contract between the City of Pueblo, a Municipal Corporation, and the State of Colorado Department of Local Affairs EIAF 8250 (hereinafter referred to as the “Contract”), a copy of which is attached, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. Subject to encumbrances by the State of Colorado Department of Local Affairs, funds from EIAF 8250 in the amount of $25,000 are hereby budgeted and appropriated for the Arkansas River Levee Master Plan Project, PL1703. SECTION 3. Matching funds in the amount of $25,000 are hereby budgeted and appropriated for said Project from the Pueblo Conservancy District in the amount of $15,000 and the amount of $10,000 is authorized to be transferred from Capital Improvement Project No. CI1111, and deposited to PL1703. SECTION 4. On October 3, 2016, the Colorado Department of Transportation awarded the City of Pueblo $200,000 in Transportation Alternates Program (TAP) funds to be used for the Arkansas River Levee Master Plan Project. Funding from TAP will not be available until July 2017. The funds budgeted and appropriated in accordance with this Ordinance shall be authorized to be expended contingent upon execution of the funding contract with CDOT. SECTION 5. The President of the City Council is authorized to execute and deliver the Contract in the name of the City and the City Clerk is directed to affix the seal of the City. SECTION 6. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance and Contract to effectuate the policies and procedures described therein. SECTION 6. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE STATE OF COLORADO DEPARTMENT OF LOCAL AFFAIRS IN THE AMOUNT OF $25,000, ACCEPTING MATCHING GRANT FUNDS FROM THE PUEBLO CONSERVANCY DISTRICT $15,000, TRANSFERRING FUNDS IN THE AMOUNT OF $10,000 FROM CI1111, ESTABLISHING PROJECT NUMBER PL1703 AND BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $50,000 RELATING TO THE PUEBLO ARKANSAS RIVER FLOOD LEVEE MASTER PLAN PROJECT, AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME SUMMARY: This Ordinance establishes the Pueblo Arkansas River Flood Levee Master Plan Project and appropriates funds by approving a grant from the Colorado Department of Local Affairs, in the amount of $25,000, accepting funds from Pueblo Conservancy District of $15,000, and providing for City matching funds of $10,000. PREVIOUS COUNCIL ACTION: City Council approved the submittal of the grant application for Arkansas River Flood Levee Master Plan Project in 2016. BACKGROUND: The Department of Planning and Community Development, in partnership with the Pueblo Conservancy District (PCD) and Colorado Department of Transportation (CDOT), has obtained funding in the amount of $25,000 from the Colorado Department of Local Affairs. The Pueblo Conservancy District is providing $15,000 and the City of Pueblo is providing $10,000 in local match monies which is being transferred for Project CI1111. October 3, 2016, the Colorado Department of Transportation awarded the City of Pueblo $200,000 in Transportation Alternates Program (TAP) funding to be used for the Arkansas River Levee Master Plan Project. Funding from TAP will not be available until July 2017, when CDOT’s fiscal year begins. Therefore, the Arkansas River Levee Master Plan Project and funding awarded by DOLA will be contingent upon execution of the funding contract with CDOT. The total amount of the Project PL1703 will be $250,000. The Project consists of contracting with a consultant to develop a Master Plan for 2.75 th miles of the Arkansas River Flood Levee corridor extending from 15 Street to the Runyon Lake State Wildlife Area. The Plan will include an analysis of existing conditions, and will identify potential improvements to recreation, infrastructure and neighborhood connectivity. FINANCIAL IMPLICATIONS: The Project budget, PL1703 will be funded through the following sources: Colorado Department of Local Affairs $25,000 Pueblo Conservancy District $15,000 City of Pueblo – transferred from CI1111 $10,000 Total $50,000 Colorado Department of Transportation (approved per future contract provided after July 1, 2017) $200,000 Total project including all funding sources $250,000 This Project will require staff time for grant management and oversight of the improvements. BOARD/COMMISSION RECOMMENDATION: Not Applicable. STAKEHOLDER PROCESS: The City of Pueblo has coordinated with the Pueblo Conservancy District to integrate public improvements as part of the reconstruction of the Arkansas River Flood Levee. The PCD has conducted numerous public meetings in preparation for the reconstruction of the levee, and additional public outreach will be incorporated into this planning effort.
