HomeMy WebLinkAbout09117ORDINANCE NO. 9117 AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY GENERALLY LOCATED NORTH AND SOUTH OF LIME ROAD, EAST AND WEST OF THE BURLINGTON NORTHERN AND SANTA FE RAILROAD RIGHT-OF-WAY BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property and generally identified in the attached Rezone Exhibit is hereby changed from A-1, Agricultural One District to I-3, Heavy Industrial District: A parcel of land located in a portion of the E ½ of Section 1, Township 22 th South, Range 65 West of the 6 P.M. in the County of Pueblo and State of Colorado, being more particularly described as follows. Beginning at a point on the Easterly line of Lot 1 in St Charles Industrial Park, Filing No. 1 according to the recorded plat thereof as filed for record at Reception No. 1909383 in the Pueblo County records said point also being on the Northwesterly right-of-way line of Lime Road as recorded at Reception No. 1797037 in the Pueblo County records; thence along the right-of-way of said Lime Road the following four (4) courses: 1. N. 41°45’01” E., a distance of 262.68 feet; 2. S. 48°14’59” E., a distance of 110.00 feet; 3. S. 41°45’01” W., a distance of 1114.06 feet; 4. Southwesterly along the arc of a curve to the right whose radius is 705.00 feet a distance of 337.96 feet thence N. 20°46’59” W., a distance of 55.00 feet; thence Southwesterly along the arc of a curve to the right whose radius is 655.00 feet and whose center bears N. 20°46’59” W., a distance of 190.21 feet; thence S. 85°59’00” W., a distance of 209.08 feet to a point on the Easterly right-of- way line of the Burlington Northern & Santa Fe Railroad (Line Segment No. 0477); thence N. 03°00'08” E., along the Easterly right-of-way line of the said Burlington Northern & Santa Fe Railroad (Line Segment No. 0477), a distance of 786.98 feet to a point on the North line of the SE ¼ of said Section 1 said point also being on the Southerly line of said Lot 1 in St. Charles Industrial Park, Filing No. 1; thence S. 88°31’41” E., along the North line of the SE ¼ of said Section 1and the Southerly line of said Lot 1, a distance of 1006.25 feet to a point on the Southeasterly Line of said Lot I and the Northwesterly right-of-way of said Lime Road; thence N. 41°45’01” E. along the Southeasterly line of said Lot 1 and the Northwesterly right-of- way of said Lime Road, a distance of 190.30 feet to the Point of Beginning. Commencing at the S ¼ Corner of Section 1, Township 22 South, Range th 65 West of the 6 P.M.; thence N. 53°37’35” W., a distance of 3228.58 feet to the Point of Beginning said Point being on the Northerly right-of-way line of Lime Road in Vestas Towers America according to the recorded plat thereof as filed for record at Reception No. 1821580 in the Pueblo County records and also being on the Westerly right-of-way line of the Burlington Northern & Santa Fe Railroad (Line Segment No. 0477); thence S. 03°00’08” W., along the Westerly right-of-way line of the Burlington Northern & Santa Fe Railroad (Line Segment No. 0477); a distance of 110.83 feet; to a point on the Southerly right-of-way line of said Lime Road as recorded in the Pueblo County records; thence along the right-of-way line of said Lime Road the following three (3) courses: 1. Containing 2.46 acres, more or less SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance to effectuate the policies and procedures described herein. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY GENERALLY LOCATED NORTH AND SOUTH OF LIME ROAD, EAST AND WEST OF THE BURLINGTON NORTHERN AND SANTA FE RAILROAD RIGHT-OF-WAY SUMMARY: The City of Pueblo, as the applicant is requesting to rezone the subject property including the realigned segment of Lime Road and the property north of Lime Road from A-1 to I- 3, Heavy Industrial District and the portion of the property south of the realigned Lime Road from A-1 to S-1, Governmental Use District. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject property is located north and south of the realigned section of Lime Road that crosses the Burlington Northern and Santa Fe Railroad Right-of-Way tracks. The applicant is requesting to rezone Lime Road, along with a parcel north of the realigned section of Lime Road (Lot 1) from A-1 to I-3, Heavy Industrial District. In addition, two (2) new parcels located to the south of the realigned section of Lime Road, will be created with the subdivision. These parcels are proposed to be rezoned to S-1, Governmental Use District and will be platted as a parcel, reserved for utility, drainage and maintenance purposes. The rezoning will continue the heavy industrial uses that are common in this area. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their March 8, 2017 Regular Meeting, voted 6- 0 with Commissioner Lucas absent, to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
