AN EMERGENCY ORDINANCE PARTIALLY TERMINATING AN
INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF
PUEBLO, A MUNICIPAL CORPORATION, AND PUEBLO
COUNTY FOR SHARED INFORMATION TECHNOLOGY
SERVICES AND INFRASTRUCTURE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Letter terminating Section I of the Information Technology Cooperation Agreement
(“Intergovernmental Agreement”) between the City of Pueblo, a Municipal Corporation, and
Pueblo County, relating to shared information technology services and infrastructure, attached
hereto and having been approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The President of the City Council is hereby authorized and directed to execute said Letter
for and on behalf of the City, and the City Clerk is directed to affix the seal of the City thereto.
SECTION 3.
The City Council finds that this Ordinance qualifies for treatment as an emergency
ordinance pursuant to City Charter because the change in GIS licensing affects public safety
systems for police and fire, mapping systems for planning and zoning, and multiple other City
systems. This emergency ordinance is required for the immediate protection of public health,
safety and property of the residents of the City of Pueblo.
SECTION 4.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance and the attached Letter to implement the transactions
described therein.
SECTION 5.
This Ordinance shall become effective immediately upon final passage and approval.

SHARED INFORMATION TECHNOLOGY SERVICES AND
INFRASTRUCTURE
SUMMARY:
Attached is a termination letter that partially terminates information technology services
and infrastructure provided for under an Intergovernmental Agreement between the City
of Pueblo and Pueblo County.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
Over the last decade, the City of Pueblo and Pueblo County Information Technology (IT)
Departments have partnered together on several different types of technology projects.
Through this cooperation, both entities have established and are maintaining one or more
high speed network connections between several City and County agencies. City and
County are sharing GIS (Geographical Information System) system and services as well
as a Planning and Development application used by both agencies. This partnership
allows the City and County IT departments to cost share and leverage efforts to establish
vital infrastructure and services utilized by both organizations.
The Information Technology Cooperation Agreement (“Intergovernmental Agreement”)
was entered into between the City and County on April 7, 2014, and approved by
Ordinance No. 8721 on March 24, 2014. Under section IV(A) of the Intergovernmental
Agreement, it may be partially terminated with three hundred sixty-five (365) days written
notice. Notice of any termination must be sent in writing by certified or registered mail,
return receipt requested, to the Pueblo County Attorney.
Section I of the Intergovernmental Agreement pertains to GIS systems and services.
Under the section, the City is paying the County $25,000.00 per year for GIS software
and related products. Recently, the software licensing model under which the City and
County have interacted, has changed to require that each enter into separate licensing
agreements. As such, the City will no longer be receiving the GIS software and services
from the County, and Section I of the Intergovernmental Agreement needs to be
terminated so that the City no longer pays for them.
FINANCIAL IMPLICATIONS:
After the next contractual year, the City will no longer pay the County $25,000.00 per year
for services.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
City and County Information Technology (IT) Directors and staff have met and worked
jointly together over the last decade to share and design services and infrastructure that
would benefit both entities. Although the City and County Attorneys are working to amend
the Intergovernmental Agreement, the year’s notice required for partial termination
necessitates that the City give notice now, prior to April 7, 2017, so that the City is not
contractually obligated to pay for additional terms.
ALTERNATIVES:
If City Council does not approve this Ordinance, the Intergovernmental Agreement will
continue as is and the City will pay for software and services it is no longer being provided.
RECOMMENDATION:
Approval of the Emergency Ordinance.

Dear Sir or Madam:
The City of Pueblo, Colorado ("City"), entered an Information Technology
Cooperation Agreement dated April 7, 2014 ("ITCA") with Pueblo County, Colorado
("County"). The City now exercises its right under the ITCA to partially terminate said
agreement.
Pursuant to Section IV, Subsection A of the ITCA, said agreement may be partially
terminated by City by providing three hundred sixty-five (365) days' advanced written
notice to County, of City's election to partially terminate. I am the President of City Council
for City and am authorized to give you notice that the City does hereby elect to terminate
the services and responsibilities of Section I, Subsection A, pursuant to the foregoing
provision of said ITCA.
