AN ORDINANCE AMENDING THE FISCAL YEAR 2017
STAFFING ORDINANCE BY REVISING A POSITION WITHIN
THE LAW DEPARTMENT, ABOLISHING A POSITION IN THE
WASTEWATER DEPARTMENT AND DOWNGRADING A
POSITION WITHIN THE STORMWATER DEPARTMENT
WHEREAS, it is necessary to revise the positions for the ultimate efficiency and functionality
for the Law, Wastewater, and Stormwater Department(s); NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter
being deleted, underscore indicates matter being added)
SECTION 1.
The following section(s) captioned “LAW, STORMWATER, AND WASTEWATER-
ENGINEERING” of Ordinance No. 9079, being the 2017 Staffing Ordinance, is amended as
follows:

SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance to effectuate the transactions described therein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and approval.

SUBJECT: AN ORDINANCE AMENDING THE FISCAL YEAR 2017 STAFFING
ORDINANCE BY REVISING A POSITION WITHIN THE LAW DEPARTMENT,
ABOLISHING A POSITION IN THE WASTEWATER DEPARTMENT AND
DOWNGRADING A POSITION WITHIN THE STORMWATER DEPARTMENT
SUMMARY:
The Law Department requests to revise its staffing by downgrading the Assistant City Attorney
III to an Assistant City Attorney II. The Wastewater Department would like to abolish the WW
Engineering Supervisor classification. The Stormwater Department would like to downgrade an
Equipment Operator IV position to an Equipment Operator II.
PREVIOUS COUNCIL ACTION:
On December 27, 2016, City Council approved Ordinance No. 9079. This Ordinance provided
authorized staffing for Fiscal Year 2017.
BACKGROUND:
The Law Department requests to adjust its staffing by downgrading the Assistant City Attorney
III classification to an Assistant City Attorney II to better suit the operational needs of the
department.
The Wastewater Department would like to abolish the WW Engineering Supervisor
classification. The incumbent is retiring at the end of January. A new classification, WW
Engineering Manager, was approved by City Council in December to allow time to recruit for this
critical position. The requested change allows the department meet its need for a professional
engineer and decreases the Wastewater Engineering staff by one (1) full-time equivalent (FTE).
The Stormwater Department would like to downgrade one (1) vacant, Equipment Operator IV
position to a lower-level Equipment Operator II classification in order to allow for promotional
opportunities for our entry-level employees and to meet the operational needs of the
department.
FINANCIAL IMPLICATIONS:
The actions noted above are cost neutral. All staffing changes were sufficiently budgeted for in
the 2017 budget previously approved by City Council.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
None. The Assistant City Attorney III classification is an appointed position. The Wastewater
Engineering Supervisor is a mid-level management position. The Equipment Operator II is an
existing classification covered in the PAGE collective bargaining agreement.
ALTERNATIVES:
The no action alternative would be to retain the current classifications. This would disallow the
Law, Wastewater and Stormwater departments to redistribute essential functions needed for
optimal operational efficiency, continuing to cause strain on the already limited resources of
each department.
RECOMMENDATION:
Approval of the Ordinance.
