HomeMy WebLinkAbout13598RESOLUTION NO. 13598 A RESOLUTION FIXING THE NUMBER OF COMMISSIONERS OF THE PUEBLO URBAN RENEWAL AUTHORITY WHEREAS, the Pueblo Urban Renewal Authority was created by Resolution No. 1133 adopted on March 9, 1959; and WHEREAS, the number of commissioners of the Pueblo Urban Renewal Authority was fixed at eleven (11) by Resolution No. 7285; and WHEREAS, C.R.S. 31-25-104(2)(a)(I) has been amended to modify the statutory provisions governing an urban renewal authority regarding the number of commissioners of an urban renewal authority the number of commissioners at 13 commissioners; WHEREAS, the residents of Pueblo have a strong commitment to participating in their local government; and WHEREAS, it would be best serve the interest of the City if the Pueblo Urban Renewal Authority consisted of thirteen commissioners, one of whom would be a member of the City Council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1: The number of commissioners of the Pueblo Urban Renewal Authority shall be and hereby is fixed at thirteen (13). SECTION 2: The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Resolution to effectuate the policies and procedures described herein. SECTION 3: This Resolution shall become effective immediately upon final passage. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Office of the City Clerk FROM: Gina Dutcher, City Clerk SUBJECT: A RESOLUTION FIXING THE NUMBER OF COMMISSIONERS OF THE PUEBLO URBAN RENEWAL AUTHORITY SUMMARY: This Resolution will fixes the number of Commissioners appointed to the Pueblo Urban Renewal Authority (“PURA”) pursuant to C.R.S. 31-25-104(2)(a)(I), as amended. PREVIOUS COUNCIL ACTION: Appointments to PURA are made on an annual basis. BACKGROUND: Resolution No. 7285, passed and approved by City Council on December 27, 1993 fixed the number of commissioners at eleven. C.R.S. 31-25-104(2)(a)(I) has been amended to set the number of Commissioners of an Urban Renewal Authority (“URA”) at 13. The state statute governing membership in PURA has been amended in three significant ways. First, it is now required that one commissioner be appointed by agreement of the board of county commissioner of each county whose property taxes are subject to allocation under any such plan. Secondly, where any plan managed by the authority includes an allocation of property tax increment generated by the mill levy imposed by an special district or school district, one such commissioner must also be a board member of a special district whose property taxes are subject to allocation under any such plan, selected by agreement of such special districts whose property taxes are subject to allocation under any such plan. Thirdly, one such commissioner must also be an elected member of a board of education of a school district, selected by agreement of the school district whose property taxes are subject to allocation under any such plan.
