The zoning restrictions covering the following described property and generally identified in the attached Rezone Exhibit are hereby changed from Bella Vista Planned Unit Development, 3rd Amendment to Bella Vista Planned Unit Development, 4th Amendment: All of Bella Vista Subdivision according to the recorded plat thereof as filed for record December 16, 2007 at Reception No. 1745615 in the Pueblo County records and all of Bella Vista Subdivision, Filing No. 2 according to the recorded plat thereof as filed for record February 9, 2009 at Reception No. 1795307 in the Pueblo County records and all of Bella Vista Subdivision, Filing No. 3 according to the recorded plat thereof as filed for record October 15, 2014 at Reception No. 1987440 in the Pueblo County records all located in a portion of the E 1/z of Section 11 and the W Y2 of Section 12, Township 20 South, Range 65 West of the 6th P.M. in the County of Pueblo, State of Colorado. Containing 28.57 acres, more or less. SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance to effectuate the policies and procedures described herein. SECTION 3. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS IN THE BELLA VISTA PLANNED UNIT DEVELOPMENT FOR PROPERTY COMMONLY KNOWN AS BELLA VISTA SUMMARY: The applicant is requesting to amend the Development Guide contained within the Bella Vista rd Planned Unit Development Guide, 3 Amendment. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject property is located in the Bella Vista development, between Ridge Drive and Outlook th Boulevard. On May 9, 2007, this Commission and subsequently City Council approved the original Bella Vista PUD rezone. The PUD was recorded and became the document that would ultimately control the development of the site. The PUD has been amended three (3) times before to allow several changes to the Single Family Attached (SFA) Planning Area, and the Assisted Living (AL) Planning Area. The applicant is proposing to amend the distance required between buildings required for homes in the Single-Family Detached (SFD) Planning Area. The amendment will remove the requirement of 15’ between buildings. The current setbacks of 5’ from the property lines will remain. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their November 9th, 2016 Regular Meeting, voted 5-0 (Schilling and Castellucci absent) to approve the rezoning. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
