ORDINANCE NO. 9074
AN ORDINANCE AMENDING ZONING RESTRICTIONS IN
THE NORTH VISTA PLANNED UNIT DEVELOPMENT FOR
PROPERTY COMMONLY KNOWN AS NORTH VISTA
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property and generally
identified in the attached Rezone Exhibit is hereby changed from North Vista Planned
Unit Development to North Vista Planned Unit Development, 1st Amendment:
All of Fountain Lake Subdivision. Pueblo Col.
AND
Section 5: SW 1/4 of the NE '/4, W '/z of the SE 1/4, NW '/a of the SW '/4
Section 6: NE 1/4 of the SE 'A
Section 7: NW 1/4
Section 8: NE 1/4 all being in Township 20 South, Range 64 West of the 6th
P.M.
Total boundary 1188.46 acres, more or less
EXCEPTING THEREFROM:
All of Lots 23 to 27 both inclusive, Block 55 and all of New York Avenue and
all of the alley adjacent thereto;
AND
All of Lots 14 to 17 both inclusive, Block 55 and all of Delaware Avenue and
Schuler Avenue and all of the alley adjacent thereto;
AND
All of Lots 1 to 28 both inclusive, Block 86 and all of Madison Avenue,
Oriental Avenue, Columbia Avenue, Lafayette Avenue and all of the alley
adjacent thereto;

SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS IN THE NORTH
VISTA PLANNED UNIT DEVELOPMENT FOR PROPERTY COMMONLY
KNOWN AS NORTH VISTA
SUMMARY:
The applicant is requesting to amend the Circulation Plan contained within the North Vista
Planned Unit Development Guide.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The applicant is proposing to amend the Circulation Plan contained within the North Vista
PUD Development Plans. The amendments will change the configuration/layout of Home
of Heroes Parkway to allow for the installation of the Black Hills Energy Substation just
south of the 120’ power lines. Black Hills Energy obtained approval from the Zoning
Board of Appeals to locate the Substation at the proposed location.
The general layout of the proposed Home of Heroes Parkway has been reviewed and
approved by the Transportation and Public Works Departments. In addition, the uses of
land, and all other requirements contained within the existing Development Guide are not
being amended.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their April 13th, 2016 Regular Meeting, voted
7-0 to approve the rezoning.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
