HomeMy WebLinkAbout13568 RESOLUTION NO. 13568 A RESOLUTION APPROVING A QUIT CLAIM DEED BETWEEN PUEBLO, A MUNICIPAL CORPORATION AND THE HOUSING AUTHORITY OF THE CITY OF PUEBLO RELATING TO THE TRANSFER OF A FENIX PARK PARCEL AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City Council hereby finds and concludes that the unimproved land described in Exhibit A of the Quit Claim Deed is surplus land that may be transferred without detriment to the City. The Quit Claim Deed, dated November 28, 2016 between the City and the Housing Authority of the City of Pueblo (“HACP”), a copy of which is attached hereto and incorporated herein by this reference, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of the City Council is hereby authorized to execute and deliver the Quit Claim Deed in the name of the City of Pueblo and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the attached Quit Claim Deed which are necessary or desirable to effectuate the transaction described therein. SECTION 4. This Resolution shall become effective immediately upon final passage. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Director of Parks and Recreation SUBJECT: A RESOLUTION APPROVING A QUIT CLAIM DEED BETWEEN PUEBLO, A MUNICIPAL CORPORATION AND THE HOUSING AUTHORITY OF THE CITY OF PUEBLO RELATING TO THE TRANSFER OF A FENIX PARK PARCEL AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME SUMMARY: Attached is a Resolution approving and authorizing the President of City Council to sign a Quit Claim Deed (“Deed”) with the Housing Authority of the City of Pueblo (“HACP”). The Deed completes the transfer of a Fenix Park parcel to facilitate the expansion of the Sangre de Cristo Apartments Complex. PREVIOUS COUNCIL ACTION: On November 9, 2015, by Resolution 13328, Council approved the sale of the Fenix Park parcel to HACP. A quitclaim deed was not executed at that time. On April 25, 2016, by Resolution 13421, Council approved the sale of adjacent Fenix Park parcels to HACP, which were executed with a quitclaim deeds for those parcels. BACKGROUND: HACP has applied to the U.S. Department of Housing and Urban Development (“HUD”) for funds under the Rental Assistance Demonstration Program for the Sangre de Cristo Apartments Complex. A requirement of the grant is that HACP have site control over the location for the new apartments. This will require the transfer from the City to HACP of the first Fenix Park parcel from Resolution 13328. The funding source for the construction of new apartments is the Colorado Housing Finance Administration’s Low Income Housing Tax Credit Program. FINANCIAL IMPLICATIONS: If HACP were to receive the HUD grant an appraisal would be ordered to determine the value of the Fenix Park parcel. This value would count as a contribution to the project by the City of Pueblo. BOARD/COMMISSION RECOMMENDATION: The governing board of HACP recommends approval of this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: If this Resolution is not approved, HACP’s funding from HUD would be jeopardized. RECOMMENDATION: Approval of the Resolution.
