RESOLUTION NO. 13564 A RESOLUTION AMENDING THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF PUEBLO AND AECOM IN THE AMOUNT OF $630,000 FOR CONSTRUCTION ENGINEERING MANAGEMENT SERVICES, FIELD/MATERIAL TESTING, AND DESIGN SUPPORT SERVICES FOR PROJECT NO. 16-001 WEST th 11 STREET BRIDGE REPLACEMENT PROJECT (CI 1606), AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME WHEREAS, the City of Pueblo and AECOM (formerly URS Corporation ) have entered into a Professional Engineering Services Agreement (henceforth “Agreement”) th for the design and related pre-construction services for the West 11 Street Bridge Replacement Project (Project No. 10-001), and, WHEREAS, the Colorado Department of Transportation (CDOT) has approved and issued a Policy Memorandum No. 23 which allows for the project design engineering firm to submit a proposal for construction management and related services for the construction phase of said project. and, WHEREAS, AECOM’s proposal to provide construction engineering management services, field/material testing, and design support services for said project has been reviewed and is reasonable and responsive, now therefore BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. An Addendum to the Agreement between AECOM and the City of Pueblo for th Project No. 10-001 – West 11 Street Bridge Replacement Project (Design Phase) for Construction Engineering Management Services, Field/Material Testing, and Design Support Services, a copy of which is attached hereto, is hereby approved in the amount of $630,000. SECTION 2. The Purchasing Agent is hereby authorized to execute said Addendum No. One on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 3. th Funds for the said project shall be paid from Project Number CI1606 – West 11 Street Bridge Replacement Project. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the attached Addendum No. One to effectuate the transactions described therein. SECTION 5. This Resolution shall become effective immediately upon passage and approval. FINANCIAL IMPLICATIONS: th Funds for the Project will be paid out of CI1606 - West 11 Street Bridge Replacement. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: There have been two public meetings for this Project. ALTERNATIVES: Denial of this Resolution will result in delaying the start of the construction phase and will require finding alternatives for construction management, field/materials testing and design support services. RECOMMENDATION: Approval of this Resolution. Attachment: Addendum No. One (Professional Engineering Services Agreement) ADDENDUM NO. 1 TO AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES WHEREAS, the City of Pueblo, a municipal corporation ("City"), entered into an Agreement for Professional Engineering Services with URS Corporation dated April 12, 2010 ("Agreement"); WHEREAS, AECOM Technical Services, Inc.("AECOM"), is the successor and assign of URS Corporation under the Agreement and has assumed and is obligated to perform all the terms and obligations of URS Corporation under the Agreement; WHEREAS, City and AECOM wish to amend the Agreement to provide for additional work and services to be performed by AECOM under the Agreement and for the consideration herein set forth. NOW THEREFOR, AECOM and City agree as follows 1. Paragraph 1.1 of the Agreement is hereby amended to read as follows: 1.1 Engineer shall satisfactorily perform professional engineering services for all phases of Project indicated below by mark placed in the appropriate box or boxes: [ X ] -Study and Report Phase [ X ] -Preliminary Design (Schematic) Phase [ X ] -Final Design Phase [X] -Construction Documents & Bidding Phase [X ] -Construction Phase Upon completion of any phase, Engineer shall not proceed with work on the next phase, if any, until authorized in writing by Owner to proceed therewith. Such services shall include all usual and customary professional engineering services and the furnishing (directly or through its professional consultants) of customary and usual civil, structural, mechanical, electrical engineering, environmental, and planning services. Engineer shall also provide any landscape engineering, surveying and geotechnical services incident to its work on the Project. 2. Subsection (a) of Paragraph 2.6 is amended to read as follows: 2.6 Additional Responsibilities. This paragraph applies to all phases of Engineer's work. (a) Engineer shall be responsible for the professional quality, technical accuracy, timely completion and coordination of all of Engineer's work, including that performed by Engineer's consultants, and including designs, Drawings, Specifications, reports and other services, irrespective of Owner's approval or acquiescence in same. Engineer specifically acknowledges and agrees that it shall be responsible for all services provided by Engineer's consultant Kleinfelder including but not limited to the professional quality, technical accuracy and sufficiency of the field/laboratory quality assurance materials testing services to be provided by Kleinfelder and generally identified in Appendix E. Engineer shall, without additional compensation, correct or revise any errors, omissions or other deficiencies in his work. 3. Paragraph 5.1 is amended to read as follows: 5.1 Owner will pay to Engineer as full compensation for all services required to be performed by Engineer under this Agreement, except for services for additional work or work beyond the scope of this Agreement, an amount not to exceed $ 1,811,667.26 in the aggregate, and not to exceed those maximum amounts set forth in Appendix B - "Fee Schedule" and computed in accordance with this Section. In the event compensation for services is set forth in Exhibit B as to each phase of work indicated in Section 1.1 of this Agreement, the maximum amount of compensation for any phase shall not exceed the amount specified in Appendix B for such phase, and specifically, the maximum amount of compensation for the construction phase of the services shall not exceed $630,000.00 on a Time and Materials basis. 4. Paragraph 9.1 is amended to read as follows: 9.1 The following Appendices are attached to and made a part of this Agreement: Appendix A - "Scope of Services" consisting of 18 pages and the additional scope of services with respect to the construction phase as set forth in Appendix E attached to Addendum No. 1 to this Agreement. Director of Finance AECOMWest 11th Street Bridge Replacement Project ADDENDUM NO. 1 -APPENDIX E November 9, 2016 CITY OF PUEBLO WEST 11TH STREET BRIDGE REPLACEMENT PROJECT SCOPE OF SERVICES CONSTRUCTION MANAGEMENT, FIELD/MATERIALS TESTING, AND DESIGN SUPPORT SERVICES EXECUTIVE SUMMARY The scope of work and associated cost estimate is for one part-time Construction Project Manager (CPM), one full-time Project Engineer (PE), one intermittent Construction Inspector (CI), as-needed Professional Engineering Design Services required for design assistance during construction, and Field/Laboratory Quality Assurance Materials Testing Services. General Requirements are outlined in Section 1.0. Services are requested to provide construction management, design support services, and field/laboratory materials testing on the West 11th Street Bridge Replacement project in Pueblo, Colorado as outlined in Section 3.0, 4.0, and 5.0 respectively. The project consists of a new pre- stressed concrete girder bridge over Wild Horse Creek; extension of West 11th Street; storm sewer; sanitary sewer; trail improvements, and deep-foundation cast-in-place concrete walls. The bid opening for the project was October 4, 2016 with an estimated construction start date in November 2016. The Consultant CPM and PE will assist the City Project Manager (PM) in administration of the contract. The Project Engineer and Construction Inspector will be responsible for day-to-day documentation and inspection of construction activities and preparation of daily diaries documenting construction activities and relevant observations as assigned by the Consultant CPM and City PM. Section 6.0 includes a list of additional project-required items that are not included as part of this scope of work. If the City desires the Consultant to perform any of these services, a supplement to this task order will be necessary. It is assumed that the City or other project team members will be performing these tasks under separate agreements. Section 7.0 contains assumptions made in preparing the associated fee for this scope of services. Definitions City Project Manager - The City of Pueblo (Local Agency) Project Manager (PM) is responsible to the CDOT Resident Engineer for the quality and successful completion of the project. The City of Pueblo PM authorizes interim and final payments and all changes to Contracts for all Consultants and Contractors. City Field Engineer - The City employee assigned by the City PM to be the duly authorized representative. The City Field Engineer (FE) is in direct charge of the project work and is responsible for the administration and satisfactory completion of the project under contract. City Materials Testing Consultant - The firm or corporation (Kleinfelder) providing personnel under this agreement to perform materials testing services. Consultant - The firm or corporation (AECOM) providing personnel under this agreement to perform construction services as outlined herein. Page 1 of 9 AECOM West 11th Street Bridge Replacement Project Consultant Construction Project Manager (CPM) - The Consultant's Professional Engineer in responsible charge of Consultant services performed as described in this Contract. The Consultant CPM assists the City PM and City FE in administering the project. Consultant Project Engineer (PE) — Consultant employee who performs on-site contract administration, construction inspection, and other project-related services under the direction of the Consultant CPM. Consultant Construction Inspector (Cl) - Consultant employee who performs construction inspection and other project-related services under the direction of the Consultant CPM. Contractor - The individual, firm, or corporation contracting with the City of Pueblo to construct a transportation project. Design Engineer (Team) - The firm or corporation (AECOM) providing personnel under this agreement to perform design services during construction as outlined herein. 1.0 CITY GENERAL REQUIREMENTS A. Work Duration The time period for the work described in this scope of work covers approximately 12 months; November 2016 thru November 2017. Work may be required on weekends, holidays and/or on a split shift basis. Work weeks may be in excess of or less than the standard 40-hour week. B. Authorization to Proceed Work shall not commence until written Notice to Proceed is received by the Consultant, and shall be completed in the time specified. C. Routine Billing & Reporting The Consultant shall provide the following on a regular basis: o Monthly billing formats, suitable to the City PM, for all contract activities performed by the Consultant. ® Periodic reports and billings required by CDOT Procedural Directive 400.2. D. Status of Contract The Consultant shall monitor the fiscal status of the contract, and advise the City PM of any potential need for supplementing their contract or negotiating an additional task order. E. Project Standards Inspection and documentation shall be in accordance with the Colorado Department of Transportation (CDOT) Field Materials Manual, Construction Manual, CDOT M&S Standards, CDOT Inspector's Checklist and applicable Project and Standard Special Provisions in the construction project contract and the applicable CDOT Standard Specifications for Road and Bridge Construction. The applicable CDOT Field Materials Manual, including Colorado Procedures and Colorado Procedure-Laboratory, shall be the one currently in use when the construction project is advertised. For the purposes of this document, references to "the specifications" shall include all applicable City of Pueblo Standard Specifications, CDOT Standard Specifications for Road and Bridge Construction, Project Standard Revisions and Project Special Provisions, and project plans and specifications. Page 2 of 9 ® West 11th Street Bridge Replacement Project The Consultant shall maintain onsite copies of applicable CDOT Standard Specifications for Road and Bridge Construction including Supplemental Specifications, Project Standard Revisions and Project Special Provisions, and project plans and specifications. Proposed work procedures shall be coordinated with the City PM prior to the start of work. F. Labor, Materials, Vehicles & Equipment It is anticipated that the City of Pueblo will require a Consultant team that includes one part-time CPM, one full-time PE, one intermittent CI, one part-time Materials Tester, as-needed Professional Engineering Design Services required for design assistance during construction, and as-needed Laboratory Materials Testing services. The Consultant shall furnish all personnel, materials, equipment and transportation required to perform the work. Consultant personnel shall have appropriate vehicles (equipped with flashing amber beacon), cellular phones, computers and miscellaneous equipment and supplies (printers, calculators, manuals, office supplies, safety equipment, etc.) required to perform the work. Field Office and Field Laboratory will be provided by construction Contract pay items or by other means outside of this agreement. Each consultant staff shall be supplied with a state of the art computer w/modem (phone, ISDN or cable as required), a writeable CD drive, a color printer and loaded with the most current version of MS Office software (Microsoft Project& SiteManager or QA/QC program if applicable). The Consultant shall have a digital camera available and document the project accordingly. G. Project Staffing Authority The City PM is in direct charge of the work and is responsible for administration of the project contract as defined in the CDOT Standard Specifications and Standard Special Provisions. This includes approving and setting work hours for both project construction and the materials sampling, testing, and inspection. Consultant personnel shall be on the project when the contractor is working. Personnel qualifications, staffing level, and number and types of vehicles shall be subject to the approval of the City PM prior to NTP. The Consultant shall assign key personnel for the duration of the project unless otherwise approved by the City PM. Personnel provided by the Consultant who do not meet all of the specified requirements, or who fail to perform their work in an acceptable manner, shall be removed from the project when determined and directed by the City PM. Back-up Consultant resources should be available in case of loss of staff, sickness, or vacations or as required for the project. H. Project Meetings The City PM and/or City FE will schedule, conduct, prepare agendas, and prepare and distribute meeting notes for all project meetings. The Consultant personnel shall be present at project meetings as required. It is assumed that the CPM and PE will attend the Pre-Construction Conference, Weekly Progress Meetings, and other coordination meetings as necessary. Members of the design team will attend meetings as requested by the City PM. I. Documentation Each of the Consultant's on-site project personnel shall maintain a daily diary for each day they perform work on the project. They shall use CDOT Form 103, Project Diary, or a form approved by the City PM. The contents of the diary shall be brief and accurate statements of progress and conditions encountered during the prosecution of the work. Editorial comments shall not be Page 3 of 9 maw West 11th Street Bridge Replacement Project incorporated in the diaries or on any written correspondence applicable to the project. A copy of the daily diary shall be given to the City FE within one working day of its date. The Consultant CPM and PE shall be capable of preparing Contract Modification Orders (CMO's), justifications for CMO's for approval by the City; price justification (force account analysis); review of MHTs, construction quantity calculations required for this type of project; inspection reports; daily diaries; review of 205's; and other construction administration documentation required per the CDOT Construction Manual. The City FE, Consultant PE, and field tester(s) shall be required to review project quantities on a monthly basis to ensure that sufficient tests have been performed for the material placed to date. The Materials Testing firm shall coordinate the schedule for Independent Assurance Tests for the project in accordance with CDOT Form 379, with the CDOT Residency Head Tester, or directly with the Region IAT person. The Consultant CPM shall notify the CDOT Project Engineer, CDOT Tester, and Region Materials Engineering/Physical Science Technician when project quantities are expected to over-run the quantities represented on CDOT Forms 250 or 379. J. Submittal of Final Documentation Final documentation shall be submitted to the CDOT Resident Engineer within 20 working days after project acceptance. The Materials Testing consultant will submit a completed CDOT Form 250, Form 379, and all Materials Books as required by the CDOT Field Materials Manual to the City PM 14 calendar days after the Consultant has been notified of final quantities. The Consultant CPM and PE will conduct the project closeout and prepare the final documentation package in accordance with the CDOT Local Agency Manual —Chapter 11. K. Enciineer's Certification The Consultant CPM shall certify in writing that all inspection activities conform to the plans, specifications, and purpose of the design. The Consultant CPM shall be available to review work, resolve problems, and make decisions in a timely manner as requested by the City. The City PM shall be the final authority regarding acceptance of work performed by the Consultant and shall be the final authority regarding acceptance of work not conforming to the plans and specifications. 2.0 CONSULTANT PROJECT MANAGEMENT Project Management tasks include required work to report progress on the project; direct construction management tasks in an orderly fashion, and keep the City informed of project activity and decisions that have been made. The project manager will prepare progress reports on a monthly basis to be included with the invoices that describe monthly progress by task. This task will also include involvement in coordination meetings with all parties involved with the project. A. Progress Reporting (12 months) B. Budget Management and Reporting C. Correspondence Distribution 3.0 CONSTRUCTION MANAGEMENT SERVICES The City has requested AECOM to provide construction management services of the 11 th Street Bridge Replacement Project. This will include the work tasks necessary to provide construction management for the duration of construction, which is assumed to be nine months, plus 1 Page 4 of 9 AECOM West 11th Street Bridge Replacement Project month of Pre-Construction Activities and 2 months of Post-Construction Activities. Bidding support is provided under a separate agreement. AECOM will provide a Construction Management team that will serve as an extension of the City of Pueblo's staff on the Project. The team will provide coordination, inspection, and documentation. AECOM team members will be on the project site for inspection of construction activities and documentation and will act as a representative of the City's interests. A. Pre-Construction Activities 1. Review contractor bids and tabulations for unbalanced loadings or possible quantity errors. 2. Review bid packages and provide a written recommendation to the City. 3. Set up field and electronic project central file documentation system in accordance with CDOT requirements. 4. Set up project-specific forms and logs meeting CDOT requirements for construction documentation. 5. Prepare Issued-for-Construction drawings and specifications that address addenda changes during bidding. B. Construction Project Management 1. Prepare routine correspondence to the contractor, CDOT Staff, stakeholders, etc. 2. Coordinate directly with the Design Team to schedule site visits and construction issues. 3. Maintain contract time counts. 4. Maintain project documentation using City of Pueblo and/or CDOT forms and processes. 5. Field engineering design and sketches for unforeseen changes and/or minor modifications. 6. Assist City's PM/FE with review, evaluation, and preparation of Contract Change Order Modification Orders and Minor Contract Revisions. Maintain a Change Log for all CMOs and MCRs. 7. Prepare monthly estimates of Contractor's work performed, materials placed or stockpiled materials on hand in accordance with the Contract. Based on the team's observations, it will be verified that completed quantities are justified for payment. The team will resolve differences and forward the estimate to the City of Pueblo Project Manager for approval and payment. 8. Obtain, log, and distribute Contractor submittals, shop drawings, and RFIs to the City and Design Team for review and approval/response. 9. Review girder erection plans with respect to CDOT's requirements. 10. Assist City's PM with resolving critical construction issues. 11.Assist the City and Design Team with engineering design if necessary to accommodate possible unforeseen field conditions or modifications needed to the contract documents. 12. Assist the City and Design Team with engineering sketches for new scope of work items. 13. Participate in the contractor led utility coordination effort concerning relocation construction and scheduling. Page 5 of 9 AECOM West 11th Street Bridge Replacement Project 14. Maintain As-Built documentation notation during throughout construction. 15. Monitoring of the Contractor's EEO and Labor Compliance through interviews (CDOT Form #280) and review of Contractor and Subcontractor certified payrolls. 16. Monitoring of the Contractor's OJT program through interviews (CDOT Form #200), monthly reporting (CDOT Form 832) and coordination with the CDOT Region EEO Administrative Program Specialist. 17. Monitoring of the Contractor's DBE status through review and approval of CDOT Form #205s and CDOT Form#1425s. C. Construction Inspection 1. Perform routine daily inspections documented on an Inspector Daily Report along with photographs 2. Prepare calculations, measurements, and documentation of interim and final pay quantities including daily pay quantity notes 3. Perform independent field measurements and on-site quality assurance necessary to review and verify the contractor's application for progress payments and supporting data, to the best of our representatives' knowledge, information, and belief and that the quality of the work is in accordance with the Contract Documents. Supplemental survey required for field measurement and inspection to be performed by the City. 4. Inspect and document Contractor's compliance with approved Traffic Control Plan 5. Promptly after notice from the Contractor, AECOM will assist the City in conducting a walk-through inspection to determine if the work is materially complete. From that walk- through, a punch list will be generated and Certificate of Material Completion drafted for the City to issue to the Contractor. D. Coordination/Meetings 1. Assist with preparation of and attend pre-construction meeting 2. Participate at a weekly progress meeting for the purpose of facilitating clear communication among parties. It is assumed that the City and/or the Contractor will be responsible for preparing Agendas and Minutes for all project meetings. 3. Attend routine construction progress meetings and additional specific construction issue meetings 4. Attend critical pre-work meetings 5. Attend Utility Coordination meetings E. Post-Construction Activities 1. Check final quantities, final plans, and prepare the final pay estimate 2. Conduct final project inspection of complete or unacceptable work and prepare punch list for final acceptance 3. Assist City with preparation of the CDOT Final Documentation package in accordance with Chapter 11 of the CDOT Local Agency Manual. AECOM shall have no responsibility for construction means, methods, sequences, techniques or health and safety precautions and programs of the construction contractor(s), including Page 6 of 9 COM ® West 11th Street Bridge Replacement Project construction site safety, all of which shall remain the sole responsibility of the construction contractor. AECOM will review ongoing activities and provide recommendations if necessary to City staff. AECOM shall have no responsibility to monitor the construction contractor's work in regard to any federal, state and local laws, rules and regulations pertaining to health and safety, which includes federal and/or state OSHA rules and regulations. AECOM shall be responsible for safety of AECOM employees only. AECOM Corporation is not responsible for the safety of any other person working on this project. 5.0 DESIGN SERVICES DURING CONSTRUCTION During construction, the contractor may raise issues through RFI or other means that will require response from the Design Team. Support may include clarification, site visits, research, or design modifications. This task will provide a means of documentation and communication of these issues and responses by the Design Team. It is intended for evaluating design options, providing additional information, or providing design solutions to changed field conditions. The Design Team will review and take appropriate action with respect to shop drawings and samples and other data, which the Contractor is required to submit, but only for conformance with the information given in the Contract Documents and compatibility with the design concept of the project. Evaluate and determine the acceptability of substitute "or approved equal" materials and equipment proposed by the Contractor for approval by the City. Such reviews and approvals or other action will not extend to means, methods, techniques, sequences or procedures of construction or to safety, precautions, and programs incident hereto. Field visits by the Design Team will be required intermittently throughout the duration of the project. It will be assumed that a member from the Design Team will visit the site two days per month including attendance of the construction weekly progress team. The Consultant CPM will coordinate directly with the Design Team to keep them informed of construction issues and to effectively schedule site visits. At the conclusion of construction, the Design Team will prepare as-constructed plans to be submitted to the City. This entire task cannot be definitely quantified at this time. As a result, the budget defined will be considered the scope of work. The City will be notified of any work outside the budget and considered out-of-scope, and will not proceed without formal approval by the City. A. Shop Drawing and Submittal Review / Response B. Page 7 of 9 AECOMWest 11th Street Bridge Replacement Project 6.0 ADDITIONAL OPTIONAL SERVICES The following items are not included within the scope of this agreement and are assumed to be performed by the City or other project team members not under this agreement. If the City desires the Consultant to perform any of these items a supplement to this task order will be need to be approved and in place prior to performing the work to cover the additional scope and level of effort. o Preparation and distribution of agendas and minutes for project meetings o Ongoing utility coordination beyond attendance of meetings setup by the City or the Contractor o Review and response to Contractor claims, disputes, requests for equitable adjustment, and/or change order requests. o Performing as the CDOT Transportation Erosion Control Supervisor (TECS) on the project. o Preparation of appropriate CDOT forms and distribution to the CDOT Resident Engineer for CMOs, MCRs, project financial reports, public notices, EEO, DBE, OJT, Sublet Agreements, and Labor Compliance. 7.0 FEE ASSUMPTIONS AND EXPLANATION The attached compensation proposal is TIME AND MATERIALS. A supplement to this task order will be necessary in the event the level of effort required increases beyond that described, including but not limited to increased scope, extended construction duration, and/or additional construction shifts. Direct costs will be expended as required for the proper performance of the work, and in accordance with City of Pueblo requirements and approvals. The Consultant CPM, PE, and CI will require a project vehicle for the full duration of the project. The cost of the vehicle is assumed to be a flat rate of $1,200 per month which will cover direct costs associated with the vehicle. Other Consultant staff travel expenses will be expensed as mileage at the current IRS rate, including for mileage to and from the project site. Man hour estimates will be based on 40 hours maximum per week for the Consultant PE and CI and 8 hours per week for the Consultant CPM. If weekly work shifts exceed these hour assumptions, a supplement to this task order will be necessary. The Scope of Work is based on the assumption that no nights will be worked and will not need to be covered by AECOM staff(night work defined as over 50 hours/week or between 6:00 p.m. and 6:00 a.m. —each work night will be assumed as 10 hours) The attached fee for construction management and design support services is based upon several assumptions and a specific organization throughout construction. Since construction management tasks extend over a long duration of time and tasks will overlap greatly throughout any construction day, the general approach to the fee is based on number of full time employees on the project as opposed to duration of each task. The following assumptions help to define the fee: A. PURPOSE AND SCOPE OF SERVICES The purpose of our services will be to provide the AECOM project team with quality assurance construction observations, field testing, and laboratory testing services to provide data and information to the AECOM project team for your use in order to determine compliance of the project with the project plans and specifications for the project. Our services will include a lead professional to handle coordination of testing and inspection services, review material submittals for project compliance, and management of quality assurance documentation as it relates to our services. Based on the information we were provided we anticipate the following scope of services: We will provide a field professional to perform oversight of the construction activities; including material compliance, materials testing, and coordination of additional field staff as needed, and documentation of work. Our field professional will also perform the majority of the construction observations and materials testing services on the project. We anticipate some work activities will overlap as the project progresses and will have support technicians as needed. Our engineering technicians will observe and test material incorporated into the project, as follows. • Earthwork Testing: We will provide a soil technician to observe earthwork construction and perform density testing to evaluate condition and adherence to the project plans, specifications, and recommendations of the geotechnical report. • Concrete Testing: Our services are anticipated to include: performing slump, temperature, and air content tests and casting concrete specimens for compressive strength testing in accordance with the project specifications. After completing the initial cure period, concrete specimens will be delivered to our Pueblo Laboratory for additional curing and subsequent compressive strength testing. • Drilled Pier Observations: Our services are anticipated to include a full time technician during drilled pier installation to evaluate condition and adherence to the project plans, specifications, and recommendations of the geotechnical report. Our QA will be in general accordance with CDOT. Asphalt samples & cores will be obtained at the project site and delivered to our laboratory for testing. • Laboratory Services: Laboratory testing will be performed in conjunction with the field- testing and observation described above in accordance with the plans, specifications, to evaluate that the materials comply with project requirements and are suitable for their intended use. Our services are anticipated to include compressive strength testing of strength specimens, moisture density relationships (Proctor curves), moisture testing, plasticity index testing, and sieve analysis, core unit weight, asphalt maximum density (Rice), and asphalt content. Professional Services: • Our Project Manager will review construction observation reports, laboratory reports, attend weekly project meetings, conduct periodic field visits and review invoices prior to submittal to AECOM project team. FEE ARRANGEMENT The above-mentioned services will be performed on a time-and-materials and unit-rate basis from portal to portal. The actual cost will deoend on the amount of work reauested. the contractor's schedule. delays due to weather. etc. Based on the preliminary information we have received to date, we believe that an estimated $136,950.00 should be budgeted for our services for the above mentioned project. The estimates are broken down on the Cost Estimate Breakdown included as Attachment A. If this information/time schedule should change, we will adjust our fee accordingly. We will not exceed this estimate without your authorization. ASSUMPTIONS The Proposed scope of services and our estimated fee were prepared using the following assumptions: o Our estimate is based on the man-hours and equipment designed to meet the construction schedule at this time. If additional man-hour or equipment are required based on an increase in production, we will adjust our scope and fees accordingly through discussions with the AECOM project team. • We have assumed an on-site office facility will be provided by others. We assume Kleinfelder will be allowed to utilize an area of this space for a field office. • We have assumed the Kleinfelder Lead Field Professional on-site for 5 months for full time and an additional 2 months on a part time basis to perform construction oversight, field testing, and to assist AECOM field engineer/manager with compliance and/or acceptance of construction material and products. Details of the estimated hours per day for our staff are presented in Attachment A. o We have assumed the samples collected for laboratory testing will be tested at our Pueblo Laboratory. LIMITATIONS Even with diligent monitoring, construction defects may occur. In all cases the contractor is solely responsible for the direction and quality of the work, adherence to plans and specifications, and repair of defects. Kleinfelder offers a range of engineering services to suit the varying needs of our clients. Although risk can never be eliminated, more detailed and extensive investigations yield more information that may help understand and manage the degree of risk. Since such detailed services involve greater expense, our clients participate in determining the level of service that provides adequate information for their purposes at acceptable levels of risk. Acceptance of this proposal will indicate that you have reviewed the Scope of Services, and determined that they do not need or want more services than are being proposed at this time. Any exceptions should be noted and may result in adjustments to our fees. Kleinfelder will perform its services in a manner consistent with the standards of care and skill ordinarily exercised by members of the profession practicing under similar conditions in the geographic vicinity and at the time the services will be performed.
