RESOLUTION NO. 13553
A RESOLUTION VACATING A SANITARY SEWER EASEMENT
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following easement:
A parcel of land located in the NW 1/4 of Section 12, Township 20 South, Range 65
West of the 6th P.M. in the County of Pueblo and State of Colorado and being more
particularly described as follows:
All of 20' Sanitary Sewer easement located in Blocks 4 and 5 and Parcel "C" in
Eagleridge Estates, Filing No. 2 according to the recorded plat thereof as filed for
record at Reception No. 1702445 filed for record November 16, 2006 in the Pueblo
County Records.
Containing 0.29 acres, more or less.
is hereby vacated.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution to effectuate the policies and procedures described
herein.
SECTION 3.
This Resolution shall be approved but shall not become effective until the final vacation
plat is recorded in the office of the Pueblo County Clerk and Recorder. If the vacation plat is not
recorded within one (1) year after of this Resolution, or within any extended period granted by
Resolution of the City Council, this Resolution shall automatically be rescinded and repealed thirty
(30) days after written notice of such rescission and repeal is given to the applicant. No vested
rights shall accrue to the subdivision or be acquired until this Resolution becomes effective.

SUBJECT: A RESOLUTION VACATING A SANITARY SEWER EASEMENT
SUMMARY:
The applicant is requesting to vacate a sanitary sewer easement, located at the corner of Outlook
Boulevard and Ridge Drive.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The applicant is requesting to vacate the full 20 foot wide sanitary sewer easement, which is no
longer necessary with the subdivision of the Eagleridge Estates Subdivision, Filing No. 3. A new
20 foot sanitary sewer easement will be dedicated with the new subdivision. The Wastewater
Department has no issues with the vacation of the easement.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their September 14, 2016 Regular Meeting, voted 6-0
(Lucas absent) to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing
to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing.
ALTERNATIVES:
If City Council does not approve this Resolution, the easement would remain in its current
configuration.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Resolution.
