A RESOLUTION ACCEPTING EASEMENTS FOR THE
CONSTRUCTION AND MAINTENANCE OF SANITARY SEWER
AND STORM SEWERS ASSOCIATED WITH THE PROPOSED
TH
WEST 11 STREET BRIDGE REPLACEMENT PROJECT
WHEREAS, the owners of real property located in the vicinity of the existing and proposed
th
W. 11 Street Bridge granted Easements to the City of Pueblo, and
WHEREAS, such easements are necessary for the construction of the sanitary sewer and
th
storm sewers associated with the proposed W. 11 Street Bridge Replacement and adjacent
roadway improvements; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Easements (PE5, PE8, PE9 & PE18) for construction and maintenance of the sanitary

sewer and storm sewers associated with the W. 11 Street Bridge Replacement project, a copy
of each is attached hereto, having been approved as to form by the City Attorney, is hereby
approved and accepted.
SECTION 2.
The City Clerk is directed to cause same to be recorded in the Office of the Pueblo County
Clerk and Recorder forthwith.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution to effectuate the policies and procedures described
herein.
SECTION 4.
This Resolution shall become effective immediately upon final passage and approval.

SUMMARY:
Attached is a Resolution accepting easements for construction and maintenance of the sanitary

and storm sewer associated with the proposed W. 11 Street Bridge Replacement project from
Lucky Star Properties, LLLC, a MAINE LIMITED PARTNERSHIP (PE-5) and from the Pueblo
Conservancy District (PE8, PE9 & PE18).

BACKGROUND:

The geometry of the proposed W. 11 Street Bridge replacement and associated utilities (sanitary
and storm sewers) required easements from adjoining property owners.
FINANCIAL IMPLICATIONS:
All real property Easements described herein were acquired through donation.

STAKEHOLDER PROCESS:
The City of Pueblo has held two public meetings concerning the
bridge replacement project.

EASEMENT
THIS EASEMENT, granted this 20 day of /VOL4-"&/ , 2015, by Lucky
Star Limited Partnership, LLLP, a Colorado limited liability limited partnership, Grantor, to Pueblo, a Municipal
Corporation, Grantee:
WITNESSETH:
THAT IN CONSIDERATION of the sum of One Dollar ($1.00) and other good and valuable
consideration,paid by the Grantee, receipt of which is hereby acknowledged,Grantor hereby grants to Grantee, its
successors and assigns, a 4,250 square foot easement for the purpose of Construction and Maintenance ofSanitary
Sewer, in,through, over, under and across Grantor's property situated in Pueblo County, Colorado, and described
as follows:
See attached Exhibit "A" and "B" for PE-5, FAP Project No.: BRO M086-055; Project Code: 17055
TOGETHER WITH the right to enter upon said property for the purpose of construction, maintenance,
control and repair, and together with the right to use so much of the adjoining property of Grantor for said
purposes. The Grantor reserves the right to use and occupy said property for any purpose consistent with the right
and privilege above granted and which will not interfere with or endanger any of Grantee's equipment or facilities
therein or use thereof. Such reservation by the Grantor shall in no event include the right.to locate or erect or cause
to be located or erected any building or any other structure upon the easement. Grantee shall have the right to
remove, at Grantor's expense, buildings, structures and other objects located on the easement interfering with the
construction, maintenance,operation, control or use of the easement for its intended purpose.
Grantor warrants to Grantee that Grantor (a) has good and sufficient right and title in and to the property
and full power to grant this easement, and (b) will defend Grantee's quiet and peaceful possession of the easement
against all persons who may lawfully claim title to the property.
"Grantee" shall include the plural and the feminine. This easement shall run with the land, he binding
upon, and inure to the benefit of the heirs, personal representatives, successors and assigns of the Grantor and
Grantee.

THIS EASEMENT, granted this 714 day of ACCIA,t,‘eV' , 2015, by The Pueblo
Conservancy District,a Public Corporation,Grantor,to Pueblo, a Municipal corporation, Grantee:
WITNESSETH:
THAT IN CONSIDERATION of the sum of One Dollar ($1.00) and other good and valuable
consideration,paid by the Grantee,receipt of which is hereby acknowledged,Grantor hereby grants to Grantee,its
successors and assigns,a 9,923 square foot easement for the purpose of Maintenance of Stormwater Facilities,in,
through,over,under and across Grantor's property situated in Pueblo County,Colorado,and described as follows:
See attached Exhibits"A"and "B"for PE18, FAP No. BRP-M086-055, Project Code: 17055
TOGETHER WITH the right to enter upon said property for the purpose of construction, maintenance,
control and repair, and together with the right to use so much of the adjoining property of Grantor for said
purposes. The Grantor reserves the right to use and occupy said property for any purpose consistent with the right
and privilege above granted and which will not interfere with or endanger any of Grantee's equipment or facilities
therein or use thereof. Such reservation by the Grantor shall in no event include the right to locate or erect or cause
to be located or erected any building or any other structure upon the easement. Grantee shall have the right to
remove,at Grantee's expense,buildings,structures and other objects located on the easement interfering with the
construction,maintenance, operation, control or use of the easement for its intended purpose.
Grantor warrants to Grantee that Grantor(a)has good and sufficient right and title in and to the property
and full power to grant this easement,and(b)will defend Grantee's quiet and peaceful possession of the easement
against all persons who may lawfully claim title to the property.
"Grantee" shall include the plural and the feminine. This easement shall run with the land, be binding
upon, and inure to the benefit of the heirs, personal representatives, successors and assigns of the Grantor and
Grantee.

DESCRIPTION
A tract or parcel No.PE18 of the City of Pueblo, State of Colorado,Project No.BRO M086-055 Unit II located in a
portion of Block 21, and the West 1/2 of vacated Hunter Avenue lying South of West 11th Street Right-of-Way and
the vacated portion of the alleys within said Block 21,Adee, Chamberlin and Wiley's Subdivision recorded in plat
book 4,Page 9,in the records of Pueblo County,Colorado.More particularly described as follows:
Commencing at the Southwest Block Corner of Block 23,Adee,Chamberlin and Wiley's Subdivision Second
Filing recorded in plat book 4,Page 18 in the records of Pueblo County,Colorado,said point located at the
centerline intersection of Adee Avenue and West 11th Street,Thence S88°23'32"E a distance of 1139.30 feet to the
Northeast corner of the West 1/2 of said vacated Hunter Avenue,point being on the south Right-of-Way line of
West 11th Street;Thence S00°24'46"E a distance of 18.00 feet to the Point of Beginning;
1) Thence S00°24'46"E a distance of 130.65 feet to the Northerly Right-of-Way Line of a 30 foot wide Public
Right-of-Way as described in Book 621,Page 303 in the records of Pueblo County,and a non-tangent
curve to the right;
2) Thence on the arc of said curve and Northerly Right-of-Way Line, having a radius of 85.00 feet,a delta
