HomeMy WebLinkAbout09036ORDINANCE NO. 9036 AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF WILLS BOULEVARD AND OUTLOOK BOULEVARD BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property and generally identified in the attached Rezone Exhibit are hereby changed from A-1, Agricultural One District to S-1, Governmental Use District: A parcel of land located in the SW 1/4 of Section 1 and the SE 1/4 of Section 2, Township 20 South, Range 65 West of the 6th P.M., County of Pueblo, State of Colorado, with all of the bearings contained herein based upon a bearing of N. 73° 42' 39" E. as measured between a portion of the north line of Lot 1 of the recorded plat of Pueblo Crossing Filing No. 2 as filed for record on December 8, 2006 at Reception No. 1705314 in the office of the Pueblo County Clerk and Recorder, said parcel being more particularly described as follows: Commencing at the northwest corner of the aforementioned Lot 1 of Pueblo Crossing Filing No. 2, thence S. 43° 15' 13" W. a distance of 757.49 feet to the Point of Beginning; thence N. 72° 33' 09" E., a distance of 736.24 feet to a point on the west line of said Lot 1 of Pueblo Crossing Filing No. 2;thence S. 17° 19' 49" E. along said west line of Lot 1, along with the west line of Lots 1 and 2 of Pueblo Crossing Filing No. 1 according to the recorded plat as filed for record on December 18, 2003 at Reception No. 1542506 in the office of the Pueblo County Clerk and Recorder, a distance of 1059.78 feet to the southwest corner of Lot 1, of Pueblo Crossing Filing No. 1 and the north line of Wills Boulevard as presently located; thence S. 41° 20' 25" W., a distance of 40.00 feet; thence N. 48° 39' 36" W., a distance of 164.56 feet; thence along the arc of curve to the left whose radius is 382.44 feet, a distance of 434.42 feet; thence S. 66° 15' 24" W., a distance of 191.00 feet to the centerline intersection of Wills Boulevard and Outlook Boulevard according to the recorded plat of Eagleridge Estates, Filing No. 2 as filed for record on November 16, 2006 at Reception No. 1702445 in the office of the Pueblo County Clerk and Recorder; thence; thence N. 22° 34' 19" W., a distance of 511.85 feet; thence along the arc of a curve to the right whose radius is 2500.00 feet, a distance of 223.60 feet; thence N. 17° 26' 51" W., a distance of 45.66 feet to the Point of Beginning. Containing 13.59 acres, more or less SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance to effectuate the policies and procedures described herein. SECTION 3. In accordance with Section 17-4-51 a. (27) b. of the Pueblo Municipal Code, a development plan shall be approved by the Planning and Zoning Commission prior to development or redevelopment of the property. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF WILLS BOULEVARD AND OUTLOOK BOULEVARD SUMMARY: The applicant is requesting to rezone the property from A-1 to S-1, Governmental Use District for the CDOT Headquarters facility. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject property is located at the northwest corner of Wills Boulevard and Outlook Boulevard. The applicant is requesting to rezone the 12 acre property, from A-1 to S-1, Governmental Use District for the purpose of construction of the CDOT Headquarters facility. Once the property is rezoned to S-1, a development plan for the property must be reviewed and approved by the Planning and Zoning Commission. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their July 13, 2016 Regular Meeting, voted 6-0 with Commissioner Lujan-Slak absent, to recommend approval with the following condition: Complete construction plans must be reviewed and approved by Planning and Zoning Commission. The condition of approval has not been complied with by the applicant. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
