HomeMy WebLinkAbout09035 ORDINANCE NO. 9035 AN ORDINANCE ENTERING INTO A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, THE COLORADO DEPARTMENT OF LOCAL AFFAIRS AND THE UNIVERSITY OF COLORADO DENVER, ESTABLISHING PROJECT PL1604, ACCEPTING THE LOCAL MATCH IN THE AMOUNT OF $2,800, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $2,800 RELATING TO THE PUEBLO ARTS ALLIANCE PROJECT AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, the Colorado Department of Local Affairs has contracted with the University of Colorado Denver, Colorado Center for Community Development, to provide technical assistance in a 64 City area of Colorado; and, WHEREAS, Pueblo Arts Alliance, a Colorado non-profit corporation, is the administrator of the Pueblo Creative Corridor, a Colorado Certified Creative District; and, WHEREAS, Pueblo Arts Alliance and the City of Pueblo, a Municipal Corporation (“City”) have requested assistance through this program to assist in Conceptual Design for Renovated Artist Cooperative Complex (“Project”); NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Memorandum of Understanding between the City of Pueblo, a Municipal Corporation, the Colorado Department of Local Affairs and the University of Colorado Denver (hereinafter referred to as the “MOU”), a copy of which is attached, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of the City Council is authorized to execute and deliver the MOU in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance and MOU to effectuate the policies and procedures described therein. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT:AN ORDINANCE ENTERING INTO A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, THE COLORADO DEPARTMENT OF LOCAL AFFAIRS AND THE UNIVERSITY OF COLORADO DENVER, ESTABLISHING PROJECT PL1604, ACCEPTING THE LOCAL MATCH IN THE AMOUNT OF $2,800, BUDGETING AND APPROPRIATING THE AMOUNT OF $2,800 IN PL1604 RELATING TO THE PUEBLO ARTS ALLIANCE PROJECT AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME SUMMARY: The Pueblo Arts Alliance has applied to the Colorado Department of Local Affairs (DOLA) for technical assistance for architectural design for their property. DOLA has contracted with the University of Colorado Denver (UCD), Colorado Center for Community Development to provide technical assistance from the UCD students and staff. DOLA requires the local municipalities enter into a Memorandum of Understanding to administer the program. PREVIOUS COUNCIL ACTION: No previous City Council action. BACKGROUND: The City of Pueblo has agreed to enter into a Memorandum of Understanding with the Colorado Department of Local Affairs (DOLA) and the University of Colorado Denver (UCD) related to the Technical Assistance Program. DOLA has a contract with UCD to provide technical assistance from the UCD students of architecture and design department for eligible cities. UCD will provide the personnel and administrative oversight to accomplish the objectives as described. The project will provide for the preparation of site plans, presentation boards, program development, design concepts, development plans and construction cost estimates for the Arts Alliance facility. The Project, located at the Pueblo Arts Alliance, Artist Workspace and Galleries at 107 South Grand Avenue, will provide design alternatives to the entrance, outdoor plaza and other improvements. The Project work will take 4 to 6 months with final completion by June 2017. FINANCIAL IMPLICATIONS: The Pueblo Arts Alliance will supply to the City of Pueblo the local match required by the MOU for technical assistance in the amount of $2,800. Staff time will be provided by the Planning and Community Development Department to administer the Project. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: The Project will not go forward if it is not approved. RECOMMENDATION: Approve the Ordinance. Attachments: Memorandum of Understanding Re: Ord# 9035 MEMORANDUM OF UNDERSTANDING Between Colorado Department of Local Affairs — University of Colorado Denver, Colorado Center for Community Development And City of Pueblo, Colorado WHEREAS, the Colorado Department of Local Affairs, hereinafter DOLA, has contracted with the University of Colorado Denver Colorado Center for Community Development, hereinafter UCD, to provide technical assistance in a 64 county area of Colorado, and WHEREAS, City of Pueblo. Colorado, hereinafter the CITY (211 East D Street, Pueblo, CO 81003), has requested assistance through this program to provide Conceptual Design for Renovated Artist Cooperative Complex for the Pueblo Arts Alliance, and WHEREAS, the DOLA and UCD desire to assist the CITY and political subdivisions of the State that are experiencing social and economic impacts resulting from the development of energy/mineral resource industries in Colorado, and, WHEREAS, it is necessary and desirable to specify these services, the desired end products, and the responsibilities of both the DOLA, UCD, and the CITY in completing this project, NOW, THEREFORE, it is hereby agreed that: I. SCOPE OF WORK UCD shall provide the services to the CITY as detailed in Attachment A-Scope of Services Dated June 6th, 2016. II. COST ESTIMATE Work will be billed to the CITY at completion of the final work task. It is estimated that work on this project will be $5,600 and the CITY is requested to contribute or match a not to exceed amount of $2,800 of the project costs to cover the time, travel, expenses, follow-up review and preparation of the final documents. III. PAYMENTS UCD shall submit an invoice to CITY upon completion of services for the CITY contribution of $2,800. Invoices will be sent to the following: William J. Student Employees of UCD may do some necessary research, plans, and prepare documents in accordance with the scope of work. Supervision of the students and their work tasks rests with Jeffrey Wood, Community Development Specialist for UCD. Lee Merkel, Regional Manager will monitor the Project on behalf of DOLA. V. Period of Performance This agreement will be deemed valid by the authorized signatures and it is anticipated that work can begin when fully executed and completed by 05/30/2017. VI. Changes and Termination The UCD Technical Assistance Program, the Colorado Department of Local Affairs, or the CITY may, from time to time require changes in the Scope of Services of this agreement. In the event changes are required they must be made with the agreement of all parties. Either party may terminate this agreement by giving written notice of such termination and specifying the effective date thereof, at least thirty (30) days before the proposed date of termination.
