HomeMy WebLinkAbout09039ORDINANCE NO. 9039 AN ORDINANCE APPROVING AND ENACTING AN AMENDMENT TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PUEBLO AND PUEBLO ASSOCIATION OF GOVERNMENT EMPLOYEES AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, the corporate authorities of the City of Pueblo and the sole and exclusive bargaining agent of the classified employees in the other classified employees bargaining unit, i.e. Pueblo Association of Government Employees, have negotiated an amendment to the collective bargaining agreement between the parties (the “Amendment”); WHEREAS, the Amendment has been reduced to writing pursuant to the requirements of Section 8-14(I) of the Charter, City of Pueblo, Colorado; and WHEREAS, Section 8-14(I) of the Charter of the City of Pueblo, Colorado, further requires that the Labor Agreement be enacted as an Ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Amendment to the Collective Bargaining Agreement between the City of Pueblo and the Pueblo Association of Government Employees, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved and enacted as an Ordinance. SECTION 2. The President of the City Council is authorized and directed to execute the Amendment to the Collective Bargaining Agreement in the name of the City and the City Clerk is hereby authorized and directed to affix the Official Seal of the City of Pueblo and attest same. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described herein. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Sam Azad, City Manager SUBJECT: AN ORDINANCE APPROVING AND ENACTING AN AMENDMENT TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PUEBLO AND PUEBLO ASSOCIATION OF GOVERNMENT EMPLOYEES AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME SUMMARY: Attached for consideration is an Ordinance that approves and enacts an amendment to the Collective Bargaining agreement between the City of Pueblo and Pueblo Association of Government Employees (“Union”). PREVIOUS COUNCIL ACTION: Section 8-14(I) of the Charter of the City of Pueblo, Colorado, requires Labor Agreements to be enacted as an Ordinance; therefore, Council has taken action on all previous Labor Agreements. BACKGROUND: In 2014, the City of Pueblo and Pueblo Association of Government Employees negotiated a Collective Bargaining Agreement (the “Agreement”). The Agreement was reduced to writing, signed by the parties, and enacted by Ordinance No. 8744 on June 23, 2014. The Agreement includes a provision that allows the City to extend the contract for two successive one-year terms. The Agreement was extended for the first one-year term pursuant to Ordinance No. 8854. The Agreement was extended for the second one-year term pursuant to Ordinance No. 8968. Said extension was subject to Union’s right to reopen negotiations with respect to wages if there had been greater than a 2.5% increase in sales tax revenue. In April of 2016, the Union did reopen negotiations given the increased sales tax revenue of City. Pursuant to requirements of Charter, City and Union commenced negotiations with respect to wages only and reached agreement providing for $70 a month increase with an additional $10 a month increase for those employees occupying the top step of their job classification. In addition to the wage increases, the pay schedule for the classification Court Technician will be adjusted effective January 1, 2017. The agreement also adjusts the pay schedule for the Wastewater Electrical Specialist upon passage of this ordinance, to allow the Wastewater department to fill this critical position for various projects which are currently underway. FINANCIAL IMPLICATIONS: The Collective Bargaining Agreement provides an across the board increase in wages at a cost of approximately $247,382 (including associated benefits) which includes the wage adjustments for specific classifications outlined above. It was previously negotiated as part of the three year contract and enacted by Ordinance No. 8744 that beginning in 2015 and concluding in 2017 that the City’s share of health insurance premiums would be increased from 75% to 78% across the contract period. 2017 represents the final year of that incremental increase to a total of 78% of the capped premium at a cost of approximately $35,201. Therefore, the financial impact of this contact is approximately $282,583. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Pursuant to Section 8-14(l), the agreement negotiated must be reduced to writing, executed by the parties and enacted as an Ordinance. RECOMMENDATION: Administration recommends approval of this Ordinance. Attachments: Amendment to Collective Bargaining Agreement AMENDMENT TO COLLECTIVE BARGAINING AGREEMENT This Amendment to Collective Bargaining Agreement("Agreement") is executed this day of Alc us �— , 2016 by and between Pueblo, a Municipal Corporation ("City") and Pueblo Msociation of Government Employees ("PAGE"). WHEREAS, City and Union are parties to a collective bargaining agreement commencing January 1, 2015 and ending December 31, 2017 (the "Labor Agreement"); WHEREAS, pursuant to Section 15.1 of the Labor Agreement, PAGE commenced negotiations with respect to the amount of monthly pay rate under Article 15.1; WHEREAS, City and Union have negotiated and reached an agreement with respect to the amount of said monthly pay rate and by this amendment have reduced same to writing; NOW THEREFOR, in consideration of the foregoing and the mutual promises contained herein,the parties agree as follows: 1. The fifth and final paragraph of 15.1 of the Labor Agreement is amended to read as follows: Effective January 1, 2017, the monthly pay rate for each class, grade, step or position of employees covered by this Agreement other than Court Technician, which has been established and/or adjusted herein, shall be increased by Seventy Dollars ($70.00) over the amount set by Ordinance establishing the 2016 pay levels; provided, however, the monthly pay rate for the top step in each class of employees covered by this Agreement other than Court Technician, which has been established and/or adjusted herein, shall be increased by an additional Ten Dollars ($10.00) to the foregoing Seventy Dollars ($70.00) for a total increase of($80.00) over the amount set by Ordinance establishing the 2016 pay levels. Effective July 1, 2016, employees covered by this agreement and occupying the class Wastewater Electrical Specialist shall be paid in accordance with the following monthly salary schedule: Wastewater Electrical Specialist Step 1 `Step2 Step 3 .
