HomeMy WebLinkAbout13518 RESOLUTION NO. 13518 A RESOLUTION PRELIMINARILY DETERMINING THAT THE PETITION FOR THE ANNEXATION OF THE AREA COMMONLY KNOWN AS THE AIRPORT WEST ANNEXATION, TH PHASE 2 DESCRIBED AS WEST OF NORTH 27 LANE AND NORTH OF RAWLINGS BOULEVARD IS VALID UNDER THE PROVISIONS OF COLORADO REVISED STATUTES SECTION 31-12-107(1), TABLING FINAL ACTION ON THE PETITION FOR A PERIOD OF NOT MORE THAN 180 DAYS, AND REFERRING THE PETITION TO THE PLANNING AND ZONING COMMISSION FOR REVIEW AND RECOMMENDATION WHEREAS, a Petition for Annexation of the area described in Section 1 hereof has been filed with the City Clerk, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Petition for Annexation (“Petition”) of the following described area situated in Pueblo County, Colorado, is hereby preliminarily found and determined to be valid under the provisions of C.R.S. §31-12-107(1): PHASE 2 ANNEXATION I. AREA TO BE ANNEXED: A parcel of land, located in the N 1/2 of Section 15, Township 20 South, Range 64 West of the 6th P.M., County of Pueblo, State of Colorado, with all the bearings contained herein based upon a bearing of N88°04'28"E, as measured between the W 1/4 Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap on #6 rebar, PLS 31161, 2000, found in place, and the E 1/4 Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap on #6 rebar, PLS 10093, 19840, found in place, said parcel being more particularly described as follows: PARCEL 1 Beginning at the NW Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap, PLS 31161, 2000, found in place; 1) thence along the North line of said Section 15, N88°05'36"E, a distance of 2595.90 feet, to the N 1/4 Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap, PLS 31161, 2000, found in place; 2) thence continuing along said North line of Section 15, N88°04'42"E, a distance of 2268.34 feet, to a point on the West right-of-way line of North 27thLane, recorded under said Reception No. 1893083; 3) thence along said West right-of-way line, S01°21'42"E, a distance of 2638.65 feet, to a point on the North right-of-way line of Rawlings Boulevard, recorded under said Reception No. 1893083; 4) thence along said North right-of-way line, the following four (4) courses: 1) S88º04’28”W, a distance of 3607.13 feet; 2) 646.61 feet, along a curve to the left, having a radius of 1310.00 feet, a tangent of 330.03 feet, a delta of 28º16’52”, and a chord of 640.07 feet that bears S73º56’03”W; 3) S59º47’37”W, a distance of 100.00 feet; 4) 573.24 feet, along a curve to the right, having a radius of 1160.00 feet, a tangent of 292.60 feet, a delta of 28º18’51”, and a chord of 567.43 feet that bears S73º57’02”W, to a point on the West line of said Section 15; 5) thence N01°23'28"W, a distance of 342.23 feet, to the West 1/4 Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap on #6 rebar, PLS 31161, 2000, found in place; 6) thence along said West line of the Section 15, N01°23'23"W, a distance of 1649.78 feet, to the Southeast Corner of the property recorded under Reception No. 1399111; 7) thence along the South line of said property recorded under Reception No. 1399111, N88°05'11"E, a distance of 1297.95 feet, to a point of the East line of the NW 1/4 of the NW 1/4 of said Section 15; 8) thence along said East line of the NW 1/4 of the NW 1/4 of Section 15, N01°23'23"W, a distance of 405.41 feet, to the Northwest Corner of the property recorded under Reception No. 1267842; 9) thence along the North line of said property recorded under Reception No. 1267842, S88°05'19"W, a distance of 1297.95 feet, to a point on said West line of Section 15; 10) thence along said West line of Section 15, N01°23'23"W, a distance of 584.41 feet, to the point of beginning. Said Parcel contains 287.387 acres, more or less. II. NEW CITY LIMIT: Beginning at the NW Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap, PLS 31161, 2000, found in place; 1) thence along the North line of said Section 15, N88°05'36"E, a distance of 2595.90 feet, to the N 1/4 Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap, PLS 31161, 2000, found in place; 2) thence continuing along said North line of Section 15, N88°04'42"E, a distance of 1299.26 feet, to the E 1/16 Corner of Section 10 and said Section 15, being marked on the ground by an original axle, found in place, said point also being the point of terminus. ALSO, Beginning at a point on the West line of said Section 15, being the Southeast Corner of the property recorded under Reception No. 1399111, from where the W 1/4 Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap on #6 rebar, PLS 31161, 2000, found in place, bears S01°23'23"E, a distance of 1649.78 feet; 1) thence along the South line of said property recorded under Reception No. 1399111, N88°05'11"E, a distance of 1297.95 feet, to a point of the East line of the NW 1/4 of the NW 1/4 of said Section 15; 2) thence along said East line of the NW 1/4 of the NW 1/4 of Section 15, N01°23'23"W, a distance of 405.41 feet, to the Northwest Corner of the property recorded under Reception No. 1267842; 3) thence along the North line of said property recorded under Reception No. 1267842, S88°05'19"W, a distance of 1297.95 feet, to a point on said West line of Section 15, from where the NW Corner of said Section 15, being marked on the ground by a 3 1/4" aluminum cap, PLS 31161, 2000, bears N01°23'23"W, a distance of 584.41 feet, said point also being the point of terminus. III. CERTIFICATION OF PERIMETER: The perimeter of the parcel of land to be annexed, as shown and described hereon, meets the required 1/6 contiguity with the current city limits of the City of Pueblo. SECTION 2. Final action on the Petition is hereby tabled for a period of not more than one hundred eighty (180) days and the Petition is hereby referred to the Planning and Zoning Commission for review and recommendation. SECTION 3. Upon receipt of the recommendation of the Planning and Zoning Commission, the City Council, without undue delay, shall make a final determination by Resolution whether the petition substantially complies with the applicable requirements of Section 31-12-107(1), C.R.S. and establish the date, time and place the City Council will hold a public hearing to determine if the proposed annexation complies with sections 31-12-104 and 31-12-105, C.R.S. or such parts thereof as may be required to establish eligibility for annexation. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 5. This Resolution shall become effective immediately upon passage and approval. This resolution will determine if the petition for annexation is valid under the provisions of Colorado Revised Statutes Section 31-12-107(1), tables final action on the petition for a period not more than 180 days, and refer the petition to the Planning and Zoning Commission for review and recommendation. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The Airport West Annexation, Phase 2 is the second of a three-phase annexation of property th totaling 1,311.79 acres located North 27 Lane, Cesar Chavez Boulevard (SH47), and Baculite Mesa Road. This Resolution relates to Phase 2 of the series annexation comprised of 287.39 acres. The Resolution preliminarily determines that the petition for annexation is valid under the provisions of the Colorado Revised Statutes 31-12-107(1). In accordance with the procedure established in the Pueblo Municipal Code, the final action on the petition is tabled for a period of not more than one hundred eighty (180) days and the petition is referred to the Planning and Zoning Commission for review and recommendation. FINANCIAL IMPLICATIONS: The Petitioner acknowledges and agrees that upon the annexation of the area proposed to be annexed, the area shall become subject to the Charter, Ordinances, Resolutions, Rules and Regulations of the City, but that the City shall have no obligation to furnish or extend municipal services, including but not limited to sanitary sewer services, to the are proposed to be annexed. The City of Pueblo will provide police and fire protection services to the property, in addition the public roads and sanitary sewer main extensions will be maintained by the City of Pueblo once they have been constructed and accepted by the City. BOARD/COMMISSION RECOMMENDATION: None at this point in the review process. STAKEHOLDER PROCESS: Not Applicable. ALTERNATIVES: None. RECOMMENDATION: The City Planning staff has reviewed the annexation petition for compliance with Section 31-12- 107(1) of the Colorado Revised Statutes and recommends that City Council preliminarily finds that the petition is valid according to Colorado Revised Statutes.
