SWERDFEGER CONSTRUCTION, INC. FOR THE LINING OF SANITARY SEWER MAINS, ADDING AN ADDITIONAL SITE AS WELL AS THE REHABILITATION OF ASSOCIATED MANHOLES AND APPROVING THE TRANSFER OF $203,508 FROM ANNUAL LARGE MAIN REHAB (WWAN02) TO PROJECT WL1401 TO COVER THE FULL AMENDMENT INCLUDING POSSIBLE CONTINGENCIES AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME WHEREAS, Resolution 13402 awarded Project No. 16-002 (WL1401) \[CO #160012\] FY2015 Beulah Heights Redirection Project to K.R. Swerdfeger Construction, Inc. of Pueblo, Colorado; and WHEREAS, there are remaining funds granted from the State Revolving Fund Loan; and WHEREAS, a 30” sanitary sewer main and associated manholes, all in the Fountain Creek Area, are in need of lining and/or rehabilitation; and WHEREAS, such work needed in the Fountain Creek Area, coincides with the original project approved by the Colorado Water Resources and Power Development Authority; and WHEREAS, an amendment (change order) to the existing contract with K.R. Swerdfeger, in the amount of $535,476, is needed in order to perform the additional work, and use the remaining loan funds; and WHEREAS, Annual Large Main Rehab (WWAN02) currently has a balance of approximately $2,600,000; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The amendment (change order) to an existing contract with K.R. Swerdfeger Construction, Inc., Project No. 16-002 (WL1401) \[CO #160012\], for lining of the sanitary main and associated manholes, in the City of Pueblo (“Amendment”) a copy of which is attached hereto, having been approved as to form by the City Attorney, shall be and hereby is approved. SECTION 2. Funds for the Amendment to Project 16-002 (WL1401) \[CO #160012\] shall come from the balance of the State Revolving Fund Loan. SECTION 3. Additional funds needed for completion of the Amendment (change order), including possible contingencies, shall be transferred from the Annual Large Main Rehab (WWAN02) fund. SECTION 4. The Purchasing Agent is hereby authorized to execute said contract Amendment on behalf of the City. SECTION 5. In addition to the amount of the bid set forth, as aforementioned, an additional amount as stipulated in this section is hereby established for contingencies and additional work, as follows: Contingencies and Additional Work………$107,095. SECTION 6. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the attached Amendment to effectuate the transactions described therein. SECTION 7. This Resolution shall become effective immediately upon passage and approval. FOR THE LINING OF SANITARY SEWER MAINS, ADDING AN ADDITIONAL SITE AS WELL AS THE REHABILITATION OF ASSOCIATED MANHOLES AND APPROVING THE TRANSFER OF $203,508 FROM ANNUAL LARGE MAIN REHAB (WWAN02) TO PROJECT WL1401 TO COVER THE FULL AMENDMENT INCLUDING POSSIBLE CONTINGENCIES AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME SUMMARY: This Resolution approves an amendment (change order) on a construction contract previously awarded to K.R. Swerdfeger Construction, Inc. The amendment will allow for the lining of a 30” VCP sanitary sewer main and the rehabilitation of associated manholes in the Fountain Creek area, utilizing the remaining funds available under the State Revolving Fund (SRF) loan. The Resolution will also transfer additional funds needed, including possible contingency amounts, from Annual Large Main Rehab (WWAN02) to Project WL1401. PREVIOUS COUNCIL ACTION : On March 24, 2014, the City Council passed Ordinance 8707 approving a State Revolving Fund (SRF) loan in the amount of $4,202,875 to fund the South Prairie Avenue Sewer Separation Project. On July 28, 2014, the City Council passed Resolution 13022 awarding a construction contract to K.R. Swerdfeger Construction for the construction of the South Prairie Avenue Sewer Separation Project, using SRF funds. On March 28, 2016, the City Council passed Resolution 13402 awarding a construction contract to K.R. Swerdfeger, for the construction of the Beulah Heights Redirection Project, using remaining SRF funds. BACKGROUND : Currently, K.R. Swerdfeger Construction, Inc. is completing a previously awarded sanitary sewer removal and replacement project on the 2700 block of Aster Street, also known as Beulah Heights. The funding for such project was SRF Loan money. Upon completion of the Beulah Heights project, there will be approximately $439,063 remaining of the total SRF Loan obtained. Upon recommendation of the Colorado Water Resources and Power Development Authority, an amendment to the existing construction contract with K.R. Swerdfeger, allowing for the addition of construction in the Fountain Creek Area, the remaining loan funds can be put to use in a timely manner. The change order work by K.R. Swerdfeger Construction, Inc. would involve the lining of 2,200 lineal feet of 30-inch sewer main, and epoxy coating of nine (9) manholes. The lining of a 30-inch VCP sewer main in the Fountain Creek Bottom and the rehabilitation of the associated manholes will eliminate water infiltration and add years of service to the old main. FINANCIAL IMPLICATIONS : The cost of the construction project will not exceed $535,476. Funds are available from the State Revolving Fund Loan and have been appropriated to Project WL1401. Additional funds needed will be transferred from Annual Large Main Rehab (WWAN02). BOARD/COMMISSION RECOMMENDATION : Not applicable STAKEHOLDER PROCESS : None ALTERNATIVES : No Action Under this alternative, the City would do no improvements to the existing sanitary mains and the system would remain as is. Doing so will continue to allow infiltration of ground water into the main and manholes. This alternative could also result in a sanitary sewer failure possibly leading to a backup due to deteriorating main. RECOMMENDATION : Approval of the Resolution. The CONTRACTOR is directed to make the following changes to the CONTRACT DOCUMENTS: DESCRIPTION: Amendment#1 (change order#2) adds an additional site to a construction contract previously awarded to K.R.
