HomeMy WebLinkAbout09024 ORDINANCE NO. 9024 AN ORDINANCE AMENDING CHAPTER 13 OF TITLE VI, CIVIL SERVICE RULE 32, RELATING TO CANCELLATION OF ELIGIBLE LISTS WITH RESPECT TO THE ENTRY LEVEL POLICE PATROL OFFICER CLASSIFICATION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicates new matter being added) SECTION 1. Civil Service Rule 32 of Chapter 13 of Title VI is hereby amended to read as follows: \[ Rule 32. – Certification of eligibles; number certified. (a) When a vacancy in any position is to be filled from an eligible list, the Commission upon request of the Director shall certify the names of the three (3) persons ranking highest on the appropriate list. If any person so certified fails to accept, qualify for or meet any requirement of the position, the Commission upon request of the Director shall certify one (1) additional name for each such person. (b) If more than one (1) appointment is to be made from any eligible list, the Commission upon request of the Director shall certify for the second and each subsequent vacancy one (1) additional name for each such vacancy. (c) If at any time the Commission is unable to comply with a request for certification of three (3) persons from an existing eligible list, the Commission shall establish a new eligible list for the class pursuant to Civil Service Rule 29, unless the City Manager authorizes an appointment from the existing list. (d) Each appointment from an eligible list to any position in the classified service shall be filled by a person certified by the Commission pursuant to this Rule. (e) Names shall be certified from eligible lists in the rank order in which they appear on such lists. (f) Notwithstanding the provisions of Subsection (a) above, when a vacancy in a position in the classified service is to be filled through the procedure set out in Section 6-8-6(6) of the Code, the Commission, upon request of the Director, shall certify the names of the five (5) persons ranking highest on the appropriate list. If any person so certified fails to accept, qualify for or meet any requirement of the position, the Commission, upon request of the Director, shall certify one (1) additional name for each such person. (g) Notwithstanding the provisions of Subsection (c) above, if at any time the Commission is unable to comply with a request for certification of five (5) persons from an existing eligible list for a vacancy in a position in the classified service which is to be filled through the procedure set out in Section 6-8-6(6) of the Code, the Commission shall establish a new eligible list for the class pursuant to Civil Service Rule 29, unless the City \] Manager authorizes an appointment from the existing list. Cancellation of Eligible List. (a) If at any time the Commission is unable to certify the minimum number of highest-ranking persons on the appropriate eligible list as required pursuant to Section 6-8-6 of the Code, the City Manager may request in writing the establishment of a new eligible list. Upon receipt of such written request, the Commission shall establish a new eligible list, and the prior list shall expire upon certification of the new list. (b) With respect to any eligible list created for the entry level police patrol officer classification, the following alternatives shall be available and may be exercised separately or jointly: (1) During the life of a certified and unexpired eligible list and upon receipt by the Commission of a written determination by the City Manager that the certified and unexpired eligible list contains insufficient persons to timely or adequately fill the vacancies for the next academy class, the Commission shall commence with the establishment of a new eligible list to become effective upon the expiration of the prior list. (2) If more than half of the persons originally certified on the eligible list have been removed, the City Manager may verify such facts in writing to the Commission and request the establishment of a new eligible list. Upon receipt of such written verification and request, the Commission shall establish a new eligible list, and the prior list shall expire upon certification of the new list. (3) If more than twelve months have elapsed since certification of the eligible list, the City Manager may verify such facts in writing to the Commission and request the establishment of a new eligible list. Upon receipt of such written verification and request, the Commission shall establish a new eligible list, and the prior list shall expire upon certification of the new list. An eligible on the prior list shall have no right under Rule 21 to elect to be placed on the subsequent eligible list. (c) In the event of a conflict between the provisions of this Rule and the provisions of Title VI, including without limitation Subsection 6-8-5(e) of the Code, the provisions of this Rule shall control. SECTION 2. The officers of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval; provided, however, the provisions of Subsection (b)(2) of Rule 32, as set forth in this Ordinance, shall not be exercised with respect to any entry level police patrol officer eligible list in existence on the effective date of this Ordinance. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Manuel Alcala, Civil Service Administrator SUBJECT: AN ORDINANCE AMENDING CHAPTER 13 OF TITLE VI, CIVIL SERVICE RULE 32, RELATING TO CANCELLATION OF ELIGIBLE LISTS WITH RESPECT TO THE ENTRY LEVEL POLICE PATROL OFFICER CLASSIFICATION SUMMARY: The proposed Ordinance amends Civil Service Rule 32 to provide for a more efficient and expedient process for hiring entry level Police Patrol Officers. PREVIOUS COUNCIL ACTION: Not applicable. BACKGROUND: See attached Report to City Council from the Pueblo Civil Service Commission. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: See attached Report to City Council from the Pueblo Civil Service Commission. STAKEHOLDER PROCESS: An administrative hearing was held before the Civil Service Commission pursuant to Civil Service Rule 40 after publication of notice of said hearing. At said hearing, any party desiring to speak in favor or against the proposal were given the opportunity to testify. At the conclusion of the hearing, the Civil Service Commission prepared a report on the proposal and hearing and submits said report to the City Council along with the proposal. ALTERNATIVES: Council can refuse to approve the proposed Ordinance. If the proposed Ordinance is not approved, the language of the Civil Service Rule 32 will remain as it is currently. RECOMMENDATION: The Pueblo Police Department and the Civil Service Commission recommend passage and approval of the proposed Ordinance.
