ORDINANCE NO. 9019
AN ORDINANCE AMENDING SECTION 3 OF CHAPTER 8
OF TITLE IV OF THE PUEBLO MUNICIPAL CODE TO
REDEFINE THE TYPES OF RESIDENTIAL PROPERTIES
THAT FALL WITHIN THE SCOPE OF THE INTERNATIONAL
PROPERTY MAINTENANCE CODE
WHEREAS, the City of Pueblo is sensitive to the need to maintain all properties
within the City limits; and
WHEREAS, the City of Pueblo recognizes the need to fight blight efficiently in
neighborhoods, and to protect the public health and safety; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate

SECTION 1.
Section 3 of Chapter 8, Title IV, Pueblo Municipal Code, as amended, is hereby
amended to read as follows:
Section 4-8-3. Applicability.
(a) Except as provided in Subsection (b) of this Section, the I.P.M.C.

shall apply only to the following categories of property:

(1) Residential properties that are vacant, rented or on
hold for rental, including transient housing, rather than owner-occupied

housing;
(2) Commercial properties that are open to the public or had
any time
been open to the public at within the immediately preceding 24
months.
(b) Sections 301.3, 302.5, 308 and 309 of the I.P.M.C. shall apply to all
property, buildings, structures and accessory structures regardless of use.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance and to effectuate the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

PROPERTIES THAT FALL WITHIN THE SCOPE OF THE INTERNATIONAL
PROPERTY MAINTENANCE CODE
SUMMARY:
The Pueblo Municipal Code Section 4-8-3 is currently only applicable to residential properties that
are vacant or rental properties instead of all residential properties, including those that are
occupied by the property owner.
PREVIOUS COUNCIL ACTION:
The International Property Maintenance Code was adopted by Council on June 13, 2011 pursuant
to Ordinance No. 8359. Section 4-8-3 was revised to change the criteria for application to
commercial properties and the application of select provisions of the Code to all properties on
December 12, 2011 in Ordinance No. 8421.
BACKGROUND:
City Council has determined that it is beneficial for the International Property Maintenance Code
to apply to all residential properties rather than just rental properties.
FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
All residents of the City of Pueblo may be affected by this change. The public will benefit from
the positive impact the change will have upon neighborhoods in the City by preventing blight
and protecting the health and safety of residents.
ALTERNATIVES:
Council may choose not to pass this Ordinance. If that occurs, the current Pueblo Municipal Code
Section 4-8-3 will remain in effect as is and owner-occupied residential properties will not be
regulated pursuant to the I.P.M.C.
RECOMMENDATION:
The Code Enforcement Unit recommends approval of this change as it benefits all properties.
