INTRODUCED July 25, 2016 BY: Ed Brown PASSED AND APPROVED: August 8, 2016 City Clerk’s Office Item # R-3 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: July 25, 2016 TO: President Stephen G. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Luis Velez, Police Chief Karen Willson, Code Enforcement Manager SUBJECT: AN ORDINANCE AMENDING SECTION 3 OF CHAPTER 8 OF TITLE IV OF THE PUEBLO MUNICIPAL CODE TO REDEFINE THE TYPES OF RESIDENTIAL PROPERTIES THAT FALL WITHIN THE SCOPE OF THE INTERNATIONAL PROPERTY MAINTENANCE CODE SUMMARY: The Pueblo Municipal Code Section 4-8-3 is currently only applicable to residential properties that are vacant or rental properties instead of all residential properties, including those that are occupied by the property owner. PREVIOUS COUNCIL ACTION: The International Property Maintenance Code was adopted by Council on June 13, 2011 pursuant to Ordinance No. 8359. Section 4-8-3 was revised to change the criteria for application to commercial properties and the application of select provisions of the Code to all properties on December 12, 2011 in Ordinance No. 8421. BACKGROUND: City Council has determined that it is beneficial for the International Property Maintenance Code to apply to all residential properties rather than just rental properties. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: All residents of the City of Pueblo may be affected by this change. The public will benefit from the positive impact the change will have upon neighborhoods in the City by preventing blight and protecting the health and safety of residents. ALTERNATIVES: Council may choose not to pass this Ordinance. If that occurs, the current Pueblo Municipal Code Section 4-8-3 will remain in effect as is and owner-occupied residential properties will not be regulated pursuant to the I.P.M.C. RECOMMENDATION: The Code Enforcement Unit recommends approval of this change as it benefits all properties. Attachments: None
