HomeMy WebLinkAbout09010ORDINANCE NO. 9010 AN ORDINANCE ESTABLISHING THE ARKANSAS RIVER TRAIL UPGRADE AND SAFETY IMPROVEMENTS PHASE 4 PROJECT, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $770,618, TRANSFERRING FUNDS IN THE AMOUNT OF $65,887 FROM THE CONSERVATION TRUST FUND, AUTHORIZING FUNDS IN THE AMOUNT OF $88,237 FROM THE BLACK HILLS UNDERGROUND UTILITIY FUND TO BE EXPENDED FOR SAID PROJECT, AND APPROVING AN AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION AND THE COLORADO DEPARTMENT OF TRANSPORTATION FOR SAID PROJECT AND AUTHORIZING THE PRESIDENT OF COUNCIL TO EXECUTE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Arkansas River Trail Upgrade and Safety Improvements Phase 4 Project is hereby established. SECTION 2. Funds in the amount of $770,618 are hereby budgeted and appropriated for said Project. SECTION 3. Funds in the amount of $88,237 are hereby authorized and made available to be expended from the Black Hills Underground Utility Fund to place existing overhead utility lines underground for said Project. SECTION 4. Funds in the amount of $65,887 are hereby transferred and made available for said Project from the Conservation Trust Fund. SECTION 5. The Agreement between the City of Pueblo, a Municipal Corporation, and the Colorado Department of Transportation for the Arkansas River Trail Upgrade and Safety Improvements Project Phase 4, Contract No. M086-072, a copy of which is attached hereto having been approved as to form by the City Attorney, is hereby approved. SECTION 6. The President of City Council is hereby authorized to execute and deliver said Agreement in the name of and on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 7. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance and Agreement to effectuate the policies and procedures described therein. SECTION 8. This Ordinance shall become effective upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Department of Planning & Community Development SUBJECT: AN ORDINANCE ESTABLISHING THE ARKANSAS RIVER TRAIL UPGRADE AND SAFETY IMPROVEMENTS PHASE 4 PROJECT, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $770,618, TRANSFERRING FUNDS IN THE AMOUNT OF $65,887 FROM THE CONSERVATION TRUST FUND, AUTHORIZING FUNDS IN THE AMOUNT OF $88,237 FROM THE BLACK HILLS UNDERGROUND UTILITIY FUND TO BE EXPENDED FOR SAID PROJECT, AND APPROVING AN AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION AND THE COLORADO DEPARTMENT OF TRANSPORTATION FOR SAID PROJECT AND AUTHORIZING THE PRESIDENT OF COUNCIL TO EXECUTE SAME SUMMARY: The proposed Ordinance would establish the Arkansas River Trail Upgrade and Safety Improvements Phase 4 Project, budget and appropriate funds in the amount of $770,618, and approve an Agreement between the City and the Colorado Department of Transportation (CDOT) to receive grant funds in the amount of $616,494 for the Project. The Project includes the construction of a trailhead parking facility along the west side of th the 4 Street bridge, pave the access road connecting to the Kayak Park, and provide for handicapped parking and access to the river trail system along the Arkansas River. PREVIOUS COUNCIL ACTION: City Council approved the submittal of a grant application to CDOT in 2012. The application was approved for funding in June 2013. BACKGROUND: The City of Pueblo will complete Phase 4 of the Arkansas River Trail Upgrade and Safety Improvement Project which includes the construction of a trail head parking area along th the west side of the 4 Street Bridge, a vehicle access road linking to handicapped parking and a loading/unloading area for watercraft using the Arkansas River and the City’s Kayak Park. ADA accessible parking will be provided adjacent to the kayak launch site at the lower drop off area. The City has received a $616,494 grant from the Colorado Department of Transportation "Transportation Enhancement Program" for the upgrade th and Safety Improvement Project along the Arkansas River Trail at the 4 Street Bridge. The Project is the fourth phase of the upgrades to the trail along the Arkansas River and accesses points along adjacent major roadways. The estimated budget for the Project is included in the Capital Improvement Fund for the Arkansas River Corridor Legacy Project. The sources of the Project funds are as follows: $616,494 Colorado Department of Transportation TE21 Funds $ 88,237 Expended from the Black Hills Underground Utility Fund Account $ 65,887 Transferred from the Conservation Trust Fund TOTAL COST $770,618 FINANCIAL IMPLICATIONS: Funds in the amount of $770,618 will be budgeted and appropriated for the Arkansas River Trail, Phase 4 Project which includes $616,494 in CDOT Transportation Alternative Funds, and local matching funds totaling $154,1 24 that includes $88,237 from the Black Hills Underground Utility Fund, and $65,887 from the Conservation Trust Fund. The City Public Works Department, Finance, and Planning will expend staff time to design and manage the grant project and financial reporting. It is estimated that 320 hours of staff time totaling approximately $20,000 of in-kind City staff time will be expended on the project. BOARD/COMMISSION RECOMMENDATION: This Project is included in the City of Pueblo’s Capital Improvement Project reviewed and recommended by the Planning and Zoning Commission to City Council. STAKEHOLDER PROCESS: This Project is included in the 2035 and 2040 Pueblo Long Range Transportation Plan Bike/Pedestrian Priority Projects. ALTERNATIVES: If the Agreement is not approved the Project will not be completed. RECOMMENDATION: Approve the Ordinance.
