ORDINANCE NO. 3093 <9c 1r
' AN ORDINANCE AMENDING CHAPTER 26 (TRAFFIC)
OF THE CODE OF ORDINANCES OF PUEBLO,
COLORADO, REGULATING THE OPERATION AND USE
OF MUNICIPALLY-OWNED OFF-STREET PARKING
LOTS
WHEREAS, the downtown area, bounded by Second Street
on the south, Alban Avenue .;on. the east, Tenth Street on the

north, and Grand ,Avenue „on the west, is and for many years ..has
been considered the principal shopping area of the City of
Pueblo, wherein is located much valuable property which con-
tributes substantially to the tax base of the City, and which
is heavily patronized , by the citizens of the community; and, .
WHEREAS, the streets in said area are insufficient
to accommodate the tremendous load of vehicular traffic and;: at
the same time provide adequate parking space for shoppers,.
business and professional people patronizing the said downtown
- ,areav, n0w, `;therefore;
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: .
SECTION 1 .
The Code of Ordinances of Pueblo, Colorado, is
amended by adding the following sections , to be numbered
Sections 26-21 . through 26-34 , inclusive, which sections read _
as follows :
"ARTICLE-II - MUNICIPAL PARKING LOT ;F
"Sec. 26-21.._';`Off-Street Parking- Declaration
of-Purpos,e.
' It is hereby found and declared that excessive
street parking of motor vehicles in the City of
Pueblo and the 'lack of adequate off-street parking
facilities creates congestion, obstructs the free
.s
circulation .of traffic , diminishes-.property values .`
and endangers the 'health,: safety and welfare of the
citizens of Pueblo. The provision of proper off-
street parking. facilities are, therefore,,' necessary
to alleviate such conditions and to promote the
public health, safety and welfare, and the same are
found and declared to be a public purpose and in
the public interest.
"Sec. 26-22 . . Same--Power to Acquire and
Regulate; Public Street.
The City of Pueblo is hereby empowered to con-
,
struct, condemnand purchase, purchase, acquire,
lease, addto, maintain, conduct and operate off-
street parking facilities for the parking of auto-
mobiles and other vehicles , in whole or in part
consisting of lots, garages or other structures
that may be upon, above or under the surface , and
everything required therefor and accessory thereto, „ .
for such terms ,- and, upon such conditions , as the

Cit _Council shall deem necessary and proper for ,$
the use and .benefit of the public, and the same,
when constructed and placed in operation, shall be
deemed a public street or highway for all.

and subject to all laws and ordinances relating to
the use of same,., except as herein otherwise r ;
provided.
"Sec. 26-23 . Same--Surfacing,
Off-street parking facilities acquired and
used by the City of. Pueblo shall be paved or other-
wise surfaced ,with an all-weather, dust-proof .
material . That portion of the driveway connecting
from the curb line to the property line shall be
paved with concrete materials . Such parking areas
shall be graded, sa as to drain off all surface
water to storm sewer Catch basins ,

"Sec. 26-24 . Same--Signs.
'Signs may be :erected at the'aentrance to each
City-owned or City-operated parking lot identifying
the same, and .setting forth the rates for parking
- therein
�. "Sec . 26-25. Same=-Marking.
Each municipal, :parking lot :may. be marked with
stalls or lines: indicating proper areas for parking,
as directed by the' City Manager, in such a manner
as to provide the greatest number of parking spaces
commensurate with safety and ease of access .
"Sec`. 26-26 . . Same--Parking Meters .
Municipal parking lots are declared to be
metered parking zones , and parking meters may be
installed and maintained thereon as provided by the
Model Traffic Code adopted by .Section -26-1 of this
Code, as amended provided, . there shall. be no. limit
upon,the`>.number .ofhours: any, vehicle may remain
parked in suchmunicipal parking_lot ,upon deposit
of the proper coin or coins except as hereinafter
stated. It`shall be unlawful_ to permit a vehicle
to remain. parked any metered' parking space in a
municipal .parking, lot when- the meter _for such space
shows the. time:..paid. for has expired.
"Sec . 26-27 ..:.. Same=-Hours.
. Me er.ed municipal,.parking lots .shall be open
for :use twe;nty< four- hours; e'ach.'day, including ,
Sundays., and hdlidays ,:;..upon deposit .of the proper
coin .in metered spaces .
"Sec. 26-28 . Same--Fees .
It shall be unlawful to ' park any vehicle upon
any metered, municipal, parking lot..without:,paying }.;.
. the fee provided herefor- „, :,-Thee:fee -shall be 100. - .
each hour.

"Sec. 26-29 . ; , Same-.-Size Limits .
• It shall beunlawful to park . any .v.ehicle or
truck having a- load capacity in excess :of 3/4 ton
upon any metered municipal parking lot.
",Sec. : 26-30 . Same--Handbills Forbidden.

It shall be-unlawful for= any person to- .dis-
' tribute literature ,or place handbills.,. in or upon
any vehicle while .parked in any municipal parking
lot.
"Sec . 26-31. Same--Loading or Unloading
of Vehicles .
It shall ,be unlawful to block ,any public side-

walk' by `stopping -on or across same 'for the purpose `
•
of ,picking::up or, discharging passengers' and it
shallbe unlawful for any person to receive or de-
liver vehicles 'otter than within, the property line ,
of the municipal :-parking lot,or to aid or assist
in 'blocking any sidewalk or street
"Sec,_.; 26`-32.. ` Same--Vendors -Prohibited.
It shall be unlawful for any vendor of goods ,
• wares , or merchandise or services to use any muni-.
cipal parking lot or _portion thereof for the con

duct of such vendor's business .
"Sec. 26-33 . Same--Notification of Claims
for. Damage or Loss .
The City ofPueblo shall not be liable to any
person for:the :hegligent operationof any automobile
upon a,municipally-.owned parking_ lot,; but shall be ,
liable only for its own negligence or the negligence
of. its employees in the operation and maintenance .of,
suchlot and 'appurtenances ,thereto. Before the City
of Pueblo shall •be' liable for, damages,' or injury aus-
tamed on .a ::municipally-owned: parking= 1"ot,' the

injured person ,or; the owner of the property so
.damaged shall notify the Police Department. immediate-
ly bj' the quickest means of communication,. .stating
the -time, place, circumstances and extent of damage
"Sec. 26-34 . Same--Impoundment. or Immobiliza-
tion`.of Improperly Parked Vehicles.
(a) Ind addition to all of the penalties pro-
vided in this Code, ,any automobile parked in viola-
tion of any provision of this article may be im-
mobilized orimpounded as provided by the Model
Traffic Code adopted by Sec. 26-1 of this Code, as ,
amended. . .
(b) Anyvehicle in excess of 3/4 ton load
capacity found parked in any metered municipal
parking lot shall be impounded forthwith and re-
moved from such '.parking lot, and all .costs of tow-
ing.. ,and .impoundment'.shall be ',paid by the, owner. or
- driver thereof before the same shall be released. " .
SECTION 2 .
Subsequent articles in Chapter 26 of this Code shall
be renumbered accordingly.
SECTION 3 .
This ordinance shall become effective immediately
upon adoption following first presentation and ',publication.
