PRINTZ CONSTRUCTORS AND SETTING FORTH $25,986 FOR CONTINGENCIES AND ADDITIONAL WORK FOR PROJECT NO. 16-019 SINGLE FAMILY HOME REPLACEMENT AT 80 PENNWOOD LANE AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME WHEREAS, proposals for Project No. 16-019 Single-family home replacement at 80 Pennwood Lane a have been received and examined; and WHEREAS, the proposal of T.L. Printz Constructors. was the lowest of those bids determined to be responsible; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. A contract for Project No. 16-019 Single-family home replacement at 80 Pennwood Lane is hereby awarded to said bidder in the amount of $259,860. SECTION 2. In addition to the amount of the bid set forth, as aforementioned, an additional amount as stipulated in this section is hereby established for contingencies and additional work. Contingencies and Additional Work…. $25,986. SECTION 3. Funds for said project are available in Funds 250 and 251. CD1313-$90,328, HOPI14- $81,314.60 and HO1560-$114,203.40 SECTION 4 The Purchasing Agent is hereby authorized to execute said contract on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 5 The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the attached contract/agreement to effectuate the transactions described therein. SECTION 6 This Resolution shall become effective immediately upon passage and approval. PRINTZ CONSTRUCTORS AND SETTING FORTH $25,986 FOR CONTINGENCIES AND ADDITIONAL WORK FOR PROJECT NO. 16-019 SINGLE FAMILY HOME REPLACEMENT AT 80 PENNWOOD LANE AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME SUMMARY : The attached Resolution approves a construction contract for the demolition and reconstruction of the existing single-family home located at 80 Pennwood Lane. PREVIOUS COUNCIL ACTION: There has been no previous Council action on this issue. BACKGROUND: This project will consist of the demolition of the existing structure and the reconstruction of a single-family home on the site. The work was competitively bid through the City’s Purchasing Department, and a copy of the bid summary is attached. Affirmatively Furthering Fair Housing (AFFH) is a legal requirement that federal agencies and their grantees further the purposes of the Fair Housing Act. Furthering fair housing requires that the City “take meaningful actions … that overcome patterns of segregation and foster inclusive communities…” Towards this end this property was purchased. The initial plan was to rehabilitate the property, however, environmental test results revealed very high levels of meth throughout the house. Colorado law does not require a seller to disclose past meth contamination once the property is cleaned to Colorado Department of Public Health and the Environment (CDPHE) standards. However, because this is a federally funded City project, staff felt that the most responsible action would be to disclose past contamination. The potential for decreased marketability, combined with a revised HUD regulation requiring that the home be sold within 9-months of completion or it be converted to a rental property lead Staff to revise the scope of work from rehabilitation to demolition and reconstruction. This property will also meet HUD’s “disability” requirements, having accessible routes, 36” wide doors, grab bar blocking, and meeting the clear space requirements. FINANCIAL IMPLICATIONS: Funds for the Project are available in Fund 250 and 251. BOARD/COMMISSION RECOMMENDATION: Not Applicable for this Resolution. STAKEHOLDER PROCESS: Not Applicable for this Resolution. ALTERNATIVES: Denial of this Resolution will result in cancellation of the project. RECOMMENDATION: Approval of the Resolution.
