Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Earl Wilkinson, Director of Public Works SUBJECT: A RESOLUTION AWARDING A CONSTRUCTION CONTRACT IN THE AMOUNT OF $1,473,762.90 TO MARTIN MARIETTA MATERIALS, INC., AND SETTING FORTH $250,000.00 FOR CONTINGENCIES AND ADDITIONAL WORK FOR PROJECT NO. 16-004 LIME ROAD RE-ALIGNMENT PHASE 2, AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME SUMMARY: This Resolution awards a Construction Contract to Martin Marietta Materials, Inc. for the 2016 Lime Road Re-Alignment Phase 2 Project. PREVIOUS COUNCIL ACTION: None. BACKGROUND: In 2007 Lime Road, lying east of Interstate Highway 25 (I-25), was realigned between I-25 and the BNSF / UP railroad right of way. The 2007 design developed a Phase 1 and Phase 2 implementation plan for the project. The Phase 1 project has since been constructed and included a long-term asphalt detour to connect the new alignment to the old railroad crossing. Phase 2 is now ready to be constructed with the recent Public Utility Commission (PUC) approval of the Phase 2 railroad crossing. The Lime Road Re-Alignment Phase 2 project is located within southeast Pueblo east of Interstate Highway 25 at the intersection of the BNSF / UP railroad tracks. In general, the construction includes removal of existing roadway and temporary detour, excavation and backfill for 2850 lineal feet of roadway construction with hot bituminous pavement surface, installation of drainage culverts and other related construction items. The BNSF / UP railroads will be adjusting tracks to grade and installing new crossing gates during this project. FINANCIAL IMPLICATIONS: Funds for the Project will be paid out of ED1201-Rocla Concrete/Lime Rd. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Denial of this Resolution will result in cancellation of the project. PHASE 2 have been received and examined, and; WHEREAS, the proposal of Martin Marietta Materials, Inc., of Pueblo, Colorado was the lowest of those bids determined to be responsible; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. 16-004 LIME ROAD RE-ALIGNMENT PHASE 2 A contract for PROJECT NO. is hereby awarded to said bidder in the amount of $1,473,762.90. SECTION 2. In addition to the amount of the bid set forth, as aforementioned, an additional amount as stipulated in this section is hereby established for contingencies and additional work. Contingencies and Additional Work . . . . $250,000.00 SECTION 3. Funds for said project shall be from Project Code ED1201 Rocla Concrete/Lime Road. SECTION 4. The Purchasing Agent is hereby authorized to execute said contract on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 5. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the attached contract/agreement to effectuate the transactions described therein.
