AN ORDINANCE VACATING FIVE DRAINAGE
EASEMENTS WITHIN LOTS 1 THROUGH 7, BLOCK 8,
WALKING STICK VISTA, FILING NO. 1
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following easements within Lots 1 through 7, Block 8, Walking Stick Vista, N4omg
Filing No. 1, according to the recorded plat thereof, filed for record April 15, 2008, as mma=s
Reception No. 1765211 in the records of the Pueblo County Clerk and Recorder, located Nm 6F
within a portion of the S 1/2 of Section 8, Township 20 South, Range 64 West of the Sixth m:
Principal Meridian, being more particularly described as follows:

All of the 10 foot wide Drainage Easement adjacent to the common lot line
of said Lots 1 and 2, Block 8, Walking Stick Vista, Filing No. 1, being the
northerly 5 feet of said Lot 1 and the southerly 5 feet of said Lot 2.
Said Vacated Utility Easement contains 1171± s.f.
AND
All of the 10 foot wide Drainage Easement adjacent to the common lot line
of said Lots 2 and 3, Block 8, Walking Stick Vista, Filing No. 1, being the
northerly 5 feet of said Lot 2 and the southerly 5 feet of said Lot 3.
Said Vacated Utility Easement contains 1509± s.f.
AND
All of the 10 foot wide Drainage Easement adjacent to the common lot line
of said Lots 3 and 4, Block 8, Walking Stick Vista, Filing No. 1, being the
northerly 5 feet of said Lot 3 and the southerly 5 feet of said Lot 4.
Said Vacated Utility Easement contains 1423± s.f.
AND
All of the 10 foot wide Drainage Easement adjacent to the common lot line
of said Lots 5 and 6, Block 8, Walking Stick Vista, Filing No. 1, being the
northerly 5 feet of said Lot 5 and the southerly 5 feet of said Lot 6.
Said Vacated Utility Easement contains 1226± s.f.
AND
All of the 10 foot wide Drainage Easement adjacent to the common lot line
of said Lots 6 and 7, Block 8, Walking Stick Vista, Filing No. 1, being the
northerly 5 feet of said Lot 6 and the southerly 5 feet of said Lot 7.
Said Vacated Utility Easement contains 1200± s.f.
are hereby vacated.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance to effectuate the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

SUBJECT:AN ORDINANCE VACATING FIVE DRAINAGE EASEMENTS WITHIN
LOTS 1 THROUGH 7, BLOCK 8, WALKING STICK VISTA, FILING NO. 1
SUMMARY:
The applicant is requesting to vacate five drainage easements within Lots 1 through 7,
Block 8, Walking Stick Vista, Filing No. 1.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The applicant is requesting to vacate five 10’ wide drainage easements, which straddle
the lot lines between Lots 1 & 2, Lots 2 & 3, Lots 3 & 4, Lots 5 & 6 and Lots 6 & 7, Block
8, Walking Stick Vista, Filing No. 1. The easements are located along the property lines,
and the applicant has also submitted two lot line rearrangements, which make the lots
within that block larger. With this vacation, the applicant is also proposing to rededicate
drainage easements along the new property lines.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their December 9, 2015 Regular Meeting, voted
5-0 (Lujan-Slak and Webb absent) to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the easements would remain in their
current configuration.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
