Nawrocki and Members of the City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Office of the City Clerk SUBJECT: A RESOLUTION APPOINTING A MEMBER TO THE BOARD OF ELECTIONS SUMMARY This Resolution appoints one individual to complete the four-year term expiring June 1, 2018. PREVIOUS COUNCIL ACTION None BACKGROUND On May 27, 2014 City Council appointed Don DiFatta to the Board of Elections for a four-year term expiring on June 1, 2018, subject to removal as provided by Resolution No. 2644 of the City Council, passed and approved August 24, 1970. Resolution No. 2644 Section 1: If any member of a board of commission appointed by this Council shall absent himself from three (3) consecutive regular meetings of the board of commission, such office is automatically declared vacant. Due to a serious illness, it was necessary for Mr. DiFatta to absent himself from duly called meetings of the Board of Elections held on October 8, 2015, November 10, 2015 and November 13, 2015. Because the position was automatically declared vacant, an advertisement was published in The Pueblo Chieftain on January 10, 2016 and a notice on the City Clerk’s webpage, seeking volunteers to fill the vacancy. Mr. DiFatta has indicated that he wishes to continue as Council’s Representative on the Board of Elections and complete his term expiring June 1, 2018. One additional application was received from Alvin D. Rivera FINANCIAL IMPLICATIONS Members of the Board of Elections are paid $25.00 per meeting attended. Funding for this stipend are allocated in the Budget of the City Clerk’s Office; therefore no new funding is necessary. BOARD/COMMISSION RECOMMENDATION None STAKEHOLDER PROCESS None ALTERNATIVES Do not make an appointment and direct Staff to re-advertise for additional applications. Rivera RESOLUTION NO. 13393 A RESOLUTION APPOINTING A MEMBER TO THE BOARD OF ELECTIONS WHEREAS, pursuant to Section 2-5 of the Charter of the City of Pueblo, unless otherwise required by law, all boards and commissions shall be appointed by Council for terms specified by Council and members of such boards are subjected to removal by Council; and WHEREAS, under and by virtue of Resolution No. 2644 of the City Council, passed and approved on August 24, 1970, Council provided that if any member of an appointed board shall absent himself from three consecutive regular meetings of the board, such office is automatically declared vacant; and WHEREAS, on May 27, 2014, City Council appointed Don DiFatta to the Board of Elections for a four-year term expiring on June 1, 2018, subject to removal as herein above provided; and WHEREAS, City Council concludes that because of a serious illness Don DiFatta has absented himself from duly called meetings of the Board of Elections held on October 8, 2015, November 10, 2015 and November 13, 2015; WHEREAS, Mr. DiFatta has indicated that he wishes to continue as Council’s Representative on the Board of Elections and complete his term expiring June 1, 2018; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. Pursuant to Section 2-5 of the Charter and Resolution No. 2644, Don DiFatta was removed as a member of the Board of Elections and said office was declared vacant. SECTION 2. The following individual is hereby appointed to the Board of Elections to complete the term expiring June 1, 2018: Alvin Rivera SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein.
