Section 18 of Chapter 5 of Title VI of the Pueblo Municipal Code is hereby amended to read as follows: 6-5-18. (a) The pay range with respect to all unclassified part time employees of the City shall be not less than $8.31 per hour and not greater than $40.00. (b) The entrance rate for any appointment of an unclassified part time employee shall be approved by the City Manager and shall be based upon recruitment related factors including level of work to be performed, training, experience, education and internal and external wage equity. With respect to internal wage equity, any unclassified part-time employee whose duties are substantially equivalent to the duties of a classified service position shall be paid at the hourly rate in the above schedule equivalent to, but not exceeding the rate paid for the classified service position. SECTION 2. All payments made consistent with the amended pay schedule set forth in Section 1 for work performed after January 1, 2016 and prior to the effective date of this Ordinance are hereby ratified. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies described herein. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Marisa Pacheco – Human Resources Director SUBJECT: AN ORDINANCE AMENDING CHAPTER 5 OF TITLE VI OF THE PUEBLO MUNICIPAL CODE RELATING TO COMPENSATION OF UNCLASSIFIED PART-TIME EMPLOYEES (2016) SUMMARY: This Ordinance amends the 2016 pay plan to reflect a pay range instead of a wage schedule and increases the minimum wage for unclassified part-time employees per Federal minimum wage guidelines and Colorado Minimum Wage Order Number 32. PREVIOUS COUNCIL ACTION: On January 12, 2015, Ordinance No. 8833 was approved by City Council. This Ordinance provided the pay plan for unclassified part-time employees for fiscal year 2015. BACKGROUND: Section 6-5-18 sets forth the rate of pay of unclassified part-time employees of the City and is updated to reflect the change in pay rate for 2016. Pursuant to federal law, the City of Pueblo follows Federal minimum wage guidelines and/or the State of Colorado minimum wage, whichever is greater. The Colorado Minimum Wage increased from $8.23 per hour to $8.31 per hour effective January 1, 2016. In addition, the Ordinance replaces the antiquated and oftentimes impractical wage schedule for a pay range with entrance rates set by recruitment related factors. FINANCIAL IMPLICATIONS: Funding for authorized temporary and part-time positions has been appropriated with the approval of the 2016 Budget Ordinance. BOARD/COMMISSION RECOMMENDATION: N/A STAKEHOLDER PROCESS: N/A ALTERNATIVES: There are no alternatives to this Ordinance. Section 8-8 of the City Charter requires that the Personnel (Human Resources) Director provide a uniformed schedule of pay approved by the City Manager and City Council and must comply with applicable minimum wage laws. The uniformed schedule of pay must be posted for all current and future employees to view and is a public record. RECOMMENDATION: Approval of the Ordinance.
