HomeMy WebLinkAbout08960ORDINANCE NO. 8960 AN ORDINANCE AMENDING ORDINANCE NO. 8819 TO EXTEND THE TEMPORARY MORATORIUM ON THE OPERATION OR ESTABLISHMENT OF ANY BUSINESS THAT INVITES OR PERMITS PRIVATE ASSEMBLY FOR THE PURPOSE OF THE USE OR CONSUMPTION OF MARIJUANA OR MARIJUANA PRODUCTS WHEREAS, on May 28, 2013 City Council adopted Ordinance No. 8591 which placed a temporary moratorium on the establishment and operation of so-called “private marijuana clubs;” and WHEREAS, on April 14, 2014 City Council adopted Ordinance No. 8718 which extended said moratorium until December 31, 2014; and WHEREAS, on December 22, 2014 City Council adopted Ordinance No. 8819 which extended said moratorium until December 31, 2015; and WHEREAS, good cause exists for the extension of the date of the moratorium from December 31, 2015 until December 31, 2016. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Ordinance No. 8819, adopted on December 22, 2014, shall be and hereby is amended to provide that the termination date of the moratorium is extended from December 31, 2015 to December 31, 2016. In all other respects, Ordinance No. 8819 shall remain in full force and effect. SECTION 2. This moratorium shall apply to the operation or establishment of any business that invites or permits private assembly for the purpose of the use or consumption or marijuana or marijuana products. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance which are necessary to effectuate the policies described herein. SECTION 4. This Ordinance shall become effective upon passage and approval. SECTION 5. This Ordinance is deemed necessary for the protection of the health, welfare, and safety of residents of the City. On December 22, 2014, Council adopted Ordinance 8819 which extended the moratorium until December 31, 2015. BACKGROUND: This ordinance extends the date of the moratorium on the establishment and operation of so- called “private marijuana clubs” from December 31, 2015 until December 31, 2016. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: Failure to enact this ordinance could result in the establishment and operation of so-called “private marijuana clubs” prior to necessary and appropriate changes to the City’s Municipal Code and land use code.
