AN ORDINANCE APPROVING AN AGREEMENT WITH
THE COLORADO DEPARTMENT OF TRANSPORTATION
(CDOT), ACCEPTING A GRANT FROM THE FEDERAL
HIGHWAY ADMINISTRATION (FHWA) IN THE AMOUNT
OF $280,000, BUDGETING $70,000 FROM FASTER
FUNDS FOR THE 20% LOCAL AGENCY MATCH, AND
APPROPRIATING THE COMBINED FUNDS INTO

REHABILITATION OVER FOUNTAIN CREEK FOR SUCH
PURPOSE
WHEREAS, the City and CDOT must enter into an intergovernmental agreement
(Agreement) to administer a construction contract to perform the necessary bridge
repairs, a copy of which is attached and has been approved as to form by the City
Attorney, and;
WHEREAS, the City has been approved to receive funding in the amount of

$280,000 from a Federal Highway Administration (FHWA) grant to rehabilitate the 8
Street Bridge, and;
WHEREAS, the City must furnish a 20% local agency match for said grant in the
amount of $70,000, for a maximum combined total amount (grant plus match) of
$350,000, and;
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Agreement between the City and CDOT is hereby approved.
SECTION 2.
The FHWA grant funds in the amount of $280,000 and the 20% local agency
match funds in the amount of $70,000 shall be deposited in Capital Project No HU1401

– 8Street Rehabilitation over Fountain Creek.
SECTION 3.
The President of the City Council is hereby authorized to execute the Agreement
with the Colorado Department of Transportation on behalf of Pueblo, a Municipal
Corporation, and the City Clerk shall affix the seal of the City thereto and attest the
same.
SECTION 4.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance to effectuate the policies and
procedures described herein.
SECTION 5.
This Ordinance shall become effective immediately upon final passage.

SUMMARY:
Attached is an Ordinance entering into an agreement, accepting grant funds, budgeting

and appropriating funds into Capital Project No. HU1401 – 8Street Rehabilitation over
Fountain Creek.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:

The 8 Street Bridge was constructed in 1928. It spans Interstate 25, two sets of Union
Pacific Railroad Tracks, the Fountain River, and adjacent floodplain. The portion of the
bridge that spans the Rail Road Tracks, and the floodplain has deteriorated significantly,
mostly at the bridge supporting piers where expansion joints allowed water to infiltrate
the superstructure into the substructure. Recent Bridge Inspection Reports have
recommended that repairs be made to the piers and expansion joints to preserve the
structure.
FINANCIAL IMPLICATIONS:
The required $70,000 local agency match will come from the FASTER Bill portion of the
City’s Highway Users Tax Fund as approved for the 2016 Budget.

ALTERNATIVES:
If the proposed Ordinance is not approved, the bridge will not be repaired at this time.
Further deterioration of the structure may result in reducing the load carrying capacity of
the bridge, thus restricting heavy vehicles from crossing the bridge.
