HomeMy WebLinkAbout13352RESOLUTION NO. 13352 A RESOLUTION APPROVING THE CONTINUED USE OF THE PUEBLO COUNTY JAIL FOR THE HOUSING OF MUNICIPAL PRISONERS BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. From the date of this Resolution through December 31, 2016, the City of Pueblo shall pay Pueblo County a total of forty-five dollars ($45) for each day, or partial day, Pueblo County houses a municipal offender in the Pueblo County jail, inclusive of all costs associated with housing that prisoner, under the current arrangement and operational practices of the Pueblo Police Department and the Pueblo County Sheriff’s Department unless or until a new agreement is reached with Pueblo County for the City’s use of the Pueblo County jail, or City Council approves by resolution to do otherwise. SECTION 2. The officers of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and to effectuate the policies and procedures described herein. SECTION 3. This Resolution shall become effective immediately upon final passage. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Sam Azad, City Manager SUBJECT: A RESOLUTION APPROVING THE CONTINUED USE OF THE PUEBLO COUNTY JAIL FOR THE HOUSING OF MUNICIPAL PRISONERS SUMMARY: Attached is a Resolution setting forth City Council’s commitment to pay Pueblo County for the continued use of the Pueblo County jail for municipal offenders under the parties’ current arrangement and operational practices until such time when a new agreement is reached with Pueblo County, or City Council approves by resolution to do otherwise. PREVIOUS COUNCIL ACTION: On December 22, 2014, City Council approved Resolution No. 13135 for the continued use of the Pueblo County jail nun pro tunc to January 1, 2014. BACKGROUND: On August 23, 2013, the Pueblo County Commissioners elected to terminate its Agreement with the City of Pueblo dated March 28, 1983, which provided for the housing of municipal prisoners in the Pueblo County jail. Since that time, the Pueblo County Sheriff’s Department has continued to accept and house in the Pueblo County jail, municipal offenders who have been arrested on municipal warrants. In addition, the Pueblo County Sheriff’s Department has continued to accept and house in the Pueblo County jail, at the request of the Pueblo Police Department, certain municipal offenders whose offense or conduct render incarceration into the jail appropriate as determined on a case by case basis. Pueblo County bills the Pueblo Police Department, and the Pueblo Police Department pays Pueblo County, forty-five dollars ($45) per day, or partial day, for each municipal prisoner housed in the Pueblo County jail inclusive of all costs associated with the housing of that prisoner. FINANCIAL IMPLICATIONS: Approval of the Resolution will maintain the current arrangement between agencies and maintain the status quo. Jail fees are paid out of the Police Department’s operating budget. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Denial of the Resolution may result in uncertainty and may disrupt the operation of the Police Department as it relates to the placement of municipal offenders. RECOMMENDATION: Approve the Resolution. Attachments: None.
