ORDINANCE NO. 8948
AN ORDINANCE VACATING CERTAIN STREETS AND
ALLEYWAYS LOCATED WITHIN A PORTION OF WILEY'S
PARK HEIGHTS SUBDIVISION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following streets and alleyways:
STREET VACATION DESCRIPTION:
All of Scott Street lying south of U.S. Highway No. 50 West as presently
located and Westerly of Lots 1 though 21 both inclusive in Block 117
AND
All of Torpy Street lying south of U.S. Highway No. 50 West as presently
located and Westerly of Lots 1 though 24 both inclusive in Block 118 and
Westerly of Lots 1 though 24 both inclusive in Block 131
AND
All of 37th Street lying south of Lots 24 and 25 both inclusive in Block 117 and
Lots 24 and 25 both inclusive in Block 118
AND
All of 36th Street lying south of Lot 24 and lying southerly of the westerly 85.19
feet of lot 25 in Block 131 and all being in Wiley's Park Heights according to
the recorded plat thereof as filed for record at Reception No. 40353 in the
Pueblo County records.
ALLEY VACATION DESCRIPTION:
All of the alley lying west of Lots 25 through 48 both inclusive in Block 117
AND
All of the alley lying west of Lots 41 through 48 both inclusive in Block 132
AND
All of the alley lying east of Lots 1 through 24 both inclusive in Block 131
AND
All of the alley lying east of Lots 19 through 24 both inclusive and easterly of
the southerly 17.96 feet of lot 18 in Block 118 and all being in Wiley's Park
Heights according to the recorded plat thereof as filed for record at Reception
No. 40353 in the Pueblo County records.
are hereby vacated.
SECTION 2.
The vacations are approved with the following conditions:
1. The portion of Lot 1, Block 1, Park West Business Campus Filing No.
4 be dedicated to the City of Pueblo before the Southern Colorado
Clinic Subdivision Filing No. 1 is recorded.
2. The vacation is null and void if the Southern Colorado Clinic
Subdivision Filing No. 1 is not recorded. In the event the Subdivision
is not recorded, the City of Pueblo shall rescind the ordinance
approving the vacation.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance to effectuate the policies and
procedures described herein.
SECTION 4.
This Ordinance shall become effective immediately upon final passage and
approval.

SUBJECT:AN ORDINANCE VACATING CERTAIN STREETS AND ALLEYWAYS
LOCATED WITHIN A PORTION OF WILEY’S PARK HEIGHTS
SUBDIVISION
SUMMARY:
The applicant is requesting to vacate streets and alleyways located within Wiley’s Park
Heights Subdivision
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The applicant is requesting to vacate multiple streets and alleys within the Southern
Colorado Clinic Subdivision, Filing 1. The vacation is requested to allow development of
the newly platted lots. The streets and alleys will no longer be necessary with the
proposed subdivision.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their October 14, 2015 Regular Meeting, voted
4-1 to recommend approval with conditions.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current streets and alleyways would
remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
