AN ORDINANCE CHANGING ZONING RESTRICTIONS
FOR PROPERTY COMMONLY KNOWN AS 1201 E. EVANS
AVENUE FROM S-1, GOVERNEMENAL USE DISTRICT TO
R-4, MIXED RESIDENTIAL DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering parcels of land commonly known as 1201 E.
Evans Avenue Street are hereby changed from S-1, Governmental Use District to R-4,
Mixed Residential District, shall apply to said property as follows:
All of Lots 48, 49, 50, 51, 52 and 53, Block 50, City Hall Place together with
the northerly 40 feet of the adjacent Mesa Avenue right-of-way and the
westerly 40 feet of the adjacent Evans Avenue right-of-way.
Containing 0.67 acres, more or less.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of the Ordinance to effectuate the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

SUBJECT: AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR PROPERTY
COMMONLY KNOWN AS 1201 E. EVANS AVENUE FROM S-1,
GOVERNMENTAL USE DISTRICT TO R-4, MIXED RESIDENTIAL
DISTRICT
SUMMARY:
The applicant is requesting to rezone the property commonly known as 1201 E. Evans
Avenue from S-1, Governmental Use District to R-4, Mixed Residential District.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
On December 31, 2013, the City of Pueblo sold the subject property, formerly known as
Fire Station No. 4, to Cozzetta/Purcell Properties, LLC for their private non-governmental
use. The S-1 zoning classification of the property is not consistent with the general plans
of the City or the intent of the S-1 zone. Staff has determined that the R-4 zoning
classification is the most appropriate classification in this case.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their October 14, 2015 Regular Meeting, voted
4-0 to recommend approval with Commissioners Latka, Lucas and Eslinger absent from
the meeting.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
