MARTINEZ ON TEMPORARY PAID ADMINISTRATIVE LEAVE AND APPOINTING A TEMPORARY PRESIDING MUNICIPAL COURT JUDGE BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Judge William A. Martinez is hereby placed on paid administrative leave pending resolution of a recently arisen employment matter. The placement of Judge William A. Martinez on paid administrative leave is not based upon a determination of the validity of any claim with respect to the employment matter but is based upon Council’s determination of what is in the best interest of the City and the continued effective operation of the Municipal Court pending resolution of the matter. SECTION 2. Kathleen Hearn is hereby appointed to temporarily serve as Presiding Municipal Court Judge during all time that Judge William A. Martinez is on paid administrative leave pursuant to this Resolution. SECTION 3. The President of the City Council is directed and authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein including executing any related personnel action form placing or removing Judge William A. Martinez from paid administrative leave and executing any documents necessary for completion of an employment investigation including execution of a Garrity Advisement. SECTION 4. This Resolution shall become effective immediately upon final passage. PREVIOUS COUNCIL ACTION: Not applicable. BACKGROUND: The proposed resolution places Judge William A. Martinez on paid administrative leave pending resolution of a recently arisen employment matter and temporarily appoints Kathleen Hearn to serve as Presiding Municipal Court Judge. FINANCIAL IMPLICATIONS: There will be a salary paid to the temporarily appointed presiding Municipal Court Judge. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: If not passed, Judge William A. Martinez would not be placed on paid administrative leave at this time. RECOMMENDATION: No recommendation is made as such matter is left to the sound discretion of Council. Attachments:
