A RESOLUTION ADOPTING THE ANALYSIS OF IMPEDIMENTS
TO FAIR HOUSING CHOICE AS REQUIRED BY THE U.S.
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
WHEREAS, the U.S. Department of Housing and Urban Development (HUD)
requires Community Development Block Grant (CDBG) and HOME entitlement
grantees to submit a certification that they will affirmatively further fair housing, and that
their grants will be administered in compliance with Title VI of the Civil Rights Act of
1968 and the Fair Housing Act as amended in 1988, which prohibits discrimination in all
aspects of housing, including the sale, rental, lease or negotiation for real property; and
WHEREAS, local entitlement communities meet this obligation by performing an
"Analysis of Impediments to Fair Housing Choice" within their communities and
developing and implementing strategies and actions to overcome any impediments to
fair housing choice based on their history, circumstances, and experiences; and
WHEREAS, the City of Pueblo has completed its AI which provides a
comprehensive review of the City's regulations and administrative policies, procedures,
and practices affecting fair housing choice and assesses the impact of the City's
regulations on the location, availability and accessibility of housing.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Analysis of Impediments to Fair Housing Choice, is hereby adopted, a copy of which
is on file with the City Clerk of the City of Pueblo.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution and the Analysis of Impediments to Fair Housing
Choice, and to effectuate the transactions described herein.
SECTION 3.
This Resolution shall become effective immediately upon final passage

AND URBAN DEVELOPMENT
SUMMARY:
The Department of Housing and Urban Development (HUD) provides funding to jurisdictions to
help meet their housing and community development needs. As recipients of these federal
funds, HUD requires that an Analysis of Impediments to Fair Housing Choice (AI) be conducted.
City staff has prepared the AI and this Resolution adopts said document and plan.
PREVIOUS COUNCIL ACTION:
The City Council has not taken any previous action on this matter.
BACKGROUND:
The Department of Housing and Citizen Services prepared this AI to submit to HUD in
conjunction with the 2015-2019 Consolidated Plan and the 2015 Annual Action Plan. The latter
two have been prepared and were presented to the City Council earlier this year for approval.
These Plans were submitted to HUD for approval. The last remaining piece is the AI.
The purpose of the AI is to review conditions in the jurisdiction that may impact the ability of
households to freely choose housing and to be treated equally without regard to race, ethnicity,
religion, gender, national origin, disability or other protected status. The AI reviews the general
state of fair housing, the enforcement of fair housing law, efforts to promote fair housing, access
to credit for the purpose of housing and the general constraints to the availability of a full range
of housing types.
FINANCIAL IMPLICATIONS:
In order to continue receiving HOME and CDBG funds an AI must be completed and approved
by the HUD Office of Fair Housing and Equal Opportunity.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
The Department of Housing and Citizen Services reached out for public comment. A notice was
placed in the Pueblo Chieftain on August 10, 2015. The notice advised the community of the
availability of the draft AI and to a survey. The purpose of the survey was to measure
knowledge and understanding of fair housing laws to determine potential educational needs.
ALTERNATIVES:
The City Council can choose not to accept the CDBG and HOME funds, which eliminates the
requirement to adopt this AI.
RECOMMENDATION:
Approve the Resolution.
