HomeMy WebLinkAbout08889ORDINANCE NO. 8889 AN ORDINANCE APPROPRIATING AND BUDGETING AN AMOUNT OF $2,744,695 FROM THE SEWER USER FUND RESERVES TO PROJECT NO. 15-020 (WW1304), AWARDING A CONSTRUCTION CONTRACT IN THE AMOUNT OF $2,220,000 TO ARCHER WESTERN, FOR PROJECT NO. 15-020 (WW1304) JAMES R. DIIORIO WATER RECLAMATION FACILITY CHEMICAL STORAGE AND FEED PROJECT, SETTING FORTH A CONTINGENCY AMOUNT OF $222,000, AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME WHEREAS, the City of Pueblo is required to comply with Colorado’s interim water quality regulations regarding nutrients; and WHEREAS, construction of a chemical storage and feed system is necessary to maintain such compliance; and WHEREAS, competitive bids for the Project No. 15-020 (WW1304) James R. DiIorio Water Reclamation Facility Chemical Storage and Feed Project have been received and examined; and WHEREAS, the proposal of Archer Western, of Westminster, Colorado was the lowest of those bids determined to be responsive; and WHEREAS, monies to fund this project are available from the Sewer User Fund Reserves; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. This contract is for the Chemical Storage and Feed Project at the James R. DiIorio Water Reclamation Facility in the City of Pueblo. Contract Agreement for James R. DiIorio Water Reclamation Facility Chemical Storage and Feed Project with Archer Western, Project No. 15-020 (WW1304) is hereby awarded to said bidder in the amount of $2,220,000. SECTION 2. Funds for Project 15-020 (WW1304) shall be appropriated and budgeted from the Sewer User Fund Reserves. SECTION 3. The Purchasing Agent is hereby authorized to execute said contract on behalf of Pueblo, A Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the contract to effectuate the transactions described therein. SECTION 5. This Ordinance shall become effective immediately upon passage and approval. DIIORIO WATER RECLAMATION FACILITY CHEMICAL STORAGE AND FEED PROJECT, SETTING FORTH A CONTINGENCY AMOUNT OF $222,000, AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME SUMMARY: Attached is an Ordinance appropriating and budgeting funds from the Sewer User Fund Reserves and awarding a construction contract to Archer Western, for project No. 15-020 (WW1304) James R. DiIorio Water Reclamation Facility Chemical Storage and Feed Project. PREVIOUS COUNCIL ACTION : None BACKGROUND : The James R. DiIorio Water Reclamation Facility Chemical Storage and Feed Project is needed in order to meet increasingly stringent nutrient removal requirements being implemented on its discharge permit. The requirements are determined by the Colorado Department of Health and Environment and the Environmental Protection Agency in order to protect rivers and lakes from excessive nutrients which can have detrimental effects on aquatic life and on human health. FINANCIAL IMPLICATIONS : The cost of the construction project was bid at $2,220,000. Funds are available from the Sewer User Fund Reserves. An amount of $302,695 is included to cover additional construction management costs. BOARD/COMMISSION RECOMMENDATION : Not applicable STAKEHOLDER PROCESS : None ALTERNATIVES : Alternative No. 1 – No Action In the event of no action being taken, the City could face fines of up to $35,000 per day of violation, and could be subject to other legal action.
