A RESOLUTION AMENDING RESOLUTION NO. 12755
RELATING TO FEES FOR CONTRACTOR’S LICENSES,
REGISTRATIONS, PERMITS AND INSPECTIONS AND
RELATED SERVICES
WHEREAS, on June 1, 2012, the City of Pueblo and the County of Pueblo entered into
an Amended and Restated Agreement establishing the Pueblo Regional Building Department
(“Amended and Restated Agreement”) wherein the City and County expressed their intention to
adopt nearly identical building codes and fees to regulate and control all building construction,
including but not limited to building, electrical, mechanical, heating, plumbing and other
construction related activities, as well as dangerous buildings and property maintenance, in the
City of Pueblo and in the unincorporated areas of Pueblo County; and
WHEREAS,on August 12, 2013, by Resolution No. 12755, the City Council, pursuant to
Section 4-2-2 (g) of the Pueblo Municipal Code, established a fee schedule to be charged by
the Pueblo Regional Building Department for projects within the City which was consistent with
fees to be charged by the Pueblo Regional Building Department for projects in the
unincorporated areas of Pueblo County; and
WHEREAS, on June 17, 2015, the Regional Building Commission approved Resolution
No. 2015-05, recommending that the City of Pueblo and Pueblo County revise the fee schedule
to eliminate the plan review fees for all ground mount commercial solar projects pursuant to
Section 6 of the Amended and Restated Agreement; and
WHEREAS, this Council concurs with said recommendation and desires to amend
Resolution 12755, to revise the fee schedule so the Pueblo Regional Building Department may
enforce consistent fees throughout the City of Pueblo and the County of Pueblo. Now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Subsection F of Section 1 of Resolution No. 12755 is hereby amended as follows:
F. Plan Review Fees:
Plan review fees shall be charged as follows:
1. New one and two family dwellings 10% of the building
permit fee
2. All other building and additions and alterations to 50% of the building
existing buildings permit fee
3. Additional plan review required by changes,
additions or revisions to approved plan $30.00 per hour
Review of plans by the Department is merely a code compliance review and not a
structural or suitability review. Such review shall not relieve the designer, architect, engineer or
contractor of responsibility for the structural integrity of the contemplated work or from
compliance with all provision of all applicable codes.
All ground mount commercial solar projects are exempt from the above Plan
Review Fees schedule.
Except as expressly amended by this Resolution, Resolution No. 12755 shall remain in full force
and effect.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution to effectuate the policies and procedures described
herein.
SECTION 3.
This Resolution shall become effective immediately upon final passage.

SUMMARY:
Attached is a Resolution amending Resolution No. 12755 which established fees to be charged
by the Pueblo Regional Building Department.
PREVIOUS COUNCIL ACTION:
On August 12, 2013, by Resolution No. 12755, the City Council, pursuant to Section 4-2-2(g) of
the Pueblo Municipal Code, established a fee schedule to be charged by the Pueblo Regional
Building Department for projects within the City. The fee schedule was consistent with fees to
be charged by the Pueblo Regional Building Department for projects in the unincorporated
areas of Pueblo County.
BACKGROUND:
On June 17, 2015, the Regional Building Commission approved Resolution No. 2015-05,
recommending that the City of Pueblo and Pueblo County revise the fee schedule to eliminate
the plan review fees for all ground mount commercial solar projects, pursuant to Section 6 of the
Amended and Restated Agreement between the City of Pueblo and the County of Pueblo dated
June 1, 2012.
FINANCIAL IMPLICATIONS:
There will be no direct impact on the finances of the City of Pueblo. The Pueblo Regional
Building Department may experience a reduction in plan review fees, however, this is
outweighed by the benefits received by the community as a result of the construction of
commercial solar projects.
BOARD/COMMISSION RECOMMENDATION:
By Resolution No. 2015-05, dated June 17, 2015, the Pueblo Regional Building Commission
recommended the elimination of plan review fees for all ground mount commercial solar
projects.
STAKEHOLDER PROCESS:
The Pueblo Regional Building Commission and Department have worked with City staff on this
issue and the preparation of this Resolution.
ALTERNATIVES:
If this Resolution is not approved, the Pueblo Regional Building Department will be confronted
with the dilemma of estimating and collecting plan review fees for commercial solar projects.
This fee may discourage the location of commercial solar projects in the city and county. If
Pueblo County eliminates this fee and the City doesn’t, there will be an inconsistency in the fee
schedule used by the Pueblo Regional Building Department.
RECOMMENDATION:
Approve the Resolution.
