AN ORDINANCE AMENDING TITLE IV CHAPTER 2 OF THE
PUEBLO MUNICIPAL CODE RELATING TO THE PROTECTION
OF THE PUBLIC DURING CONSTRUCTION OR DEMOLITION
WHEREAS, residents and other persons should not be endangered by construction and
demolition projects which occur within the City of Pueblo; and
WHEREAS, public sidewalks, alleys, streets and other City property should be protected
from damage during construction and demolition projects which occur within the City of Pueblo;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate

SECTION 1.
Section 4-2-6 of Chapter 2 of Title IV of the Pueblo Municipal Code is hereby amended
and modified to read as follows:
Sec. 4-2-6. - Protection of the public during construction or demolition.
To fully implement Section 3303 of the International Building Code, the following additional
requirements shall be applicable to all construction or demolition activities adjacent to a public
way or which require or involve any temporary occupancy of public property for fences,
walkways or other protective devices:

(5) It shall be unlawful for any person to place or store any materials or
equipment used in or required for construction or demolition work, or to
erect any walkway, barricades, canopy, railing or fence upon any public
property without having first obtained a permit in writing from the Director
of Public Works.
(6) No building permit shall be issued by the Building Official until there shall
have been obtained such permit from the Director of Public Works.
SECTION 2.
Chapter 2 of Title IV of the Pueblo Municipal Code is hereby amended and modified by
the addition of a new Section 4-2-7 to read as follows:
Sec. 4-2-7.
It shall be unlawful for any person to perform any work on any building or
structure in such manner as to endanger persons and property on the street or public
property.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of the Ordinance to effectuate the policies and procedures described
herein.
SECTION 4.
This Ordinance shall become effective immediately upon final passage and approval.

DURING CONSTRUCTION OR DEMOLITION
SUMMARY:
Attached for consideration is a text amendment that will amend Title IV Chapter 2 of the
Pueblo Municipal Code relating to the protection of the public during construction and
demolition.
PREVIOUS COUNCIL ACTION:
On December 22, 2014, by Resolution No. 13134, City Council imposed a temporary
moratorium, until June 30, 2015, on the issuance of demolition permits for buildings
larger than 15,000 square feet.
BACKGROUND:
Resolution No. 13134 directed the officers and staff of the City to review Section 4-2-6
of the Pueblo Municipal Code and Section 3303 of the International Building Code and
to propose appropriate and necessary amendments to same which would further protect
the City’s residents and the City’s infrastructure.
A review of comparable ordinances from other Colorado cities reveals that the City of
Pueblo, through Sec. 4-2-6 of the PMC, currently has an appropriate regulatory plan in
place for the protection of residents and City property while construction and
demolitions are taking place in the city. It was determined that only minor revisions to
Sec. 4-2-6 of the PMC are necessary.

Not applicable.
ALTERNATIVES:
If City Council does not approve this Ordinance, Title IV Chapter 2 of the Pueblo
Municipal Code will remain unchanged.
RECOMMENDATION:
Approval of the Ordinance.
