HomeMy WebLinkAbout08856ORDINANCE NO. 8856 AN ORDINANCE APPROVING AND ACCEPTING A COLORADO TREE COALITION GRANT AND APPLICABLE CONDITIONS PERTAINING THERETO, AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE GRANT AGREEMENT RELATING TO SAME, ESTABLISHING PROJECT NO. PL1501, AND BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $2,000 FOR THE PURPOSES AUTHORIZED BY THE GRANT AGREEMENT WHEREAS, the Colorado Tree Coalition (CTC) has tendered a grant award to the City of Pueblo in the amount of $2,000; and WHEREAS, acceptance of the award is in the best interest of the City; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Grant Agreement, a true copy is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of City Council is authorized and directed to execute the Grant Agreement and deliver any other instruments required to effect acceptance of the Grant Agreement on behalf of the City, and the City Clerk is directed to attest same. SECTION 3. Project No. PL1501 is hereby established. The full amount of the grant shall be deposited to Project No. PL1501. The amount of $2,000 is hereby budgeted and appropriated to Project No. PL1501 for expenditure for the purposes authorized by the Grant Agreement. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described herein. SECTION 5_ This Ordinance shall become effective immediately upon final passage and approval. PL1501, AND BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $2,000 FOR THE PURPOSES AUTHORIZED BY THE GRANT AGREEMENT SUMMARY: This Ordinance accepts a grant award from the Colorado Tree Coalition in the amount of $2,000, establishes a Project account, and budgets and appropriates the amount of $2,000 for the grant purposes. PREVIOUS COUNCIL ACTION: None BACKGROUND: An application for a grant from the Colorado Tree Coalition was submitted in September 2014. The CTC notified the Parks and Recreation Department of the grant award on February 9, 2015. The application submitted was for the "Minnequa Lake Urban Forestry Planting Project" which consists of the purchase of approximately forty (40) trees for planting within the beautiful park area located on the south end of Lake Minnequa near the existing athletic fields. Planting will be completed by Parks staff as the in-kind match for the project. FINANCIAL IMPLICATIONS: The City has committed a $2,000 cash match to the CTC Grant. Funds are available in Project No. LT1202 — Ongoing Citywide Tree Planting and Replacement Project. Acceptance of the grant, as recommended, would also bind the City to the conditions of the CTC Grant Agreement. Other financial implications would be staff time with oversight of the grant. NOW, THEREFORE, it is hereby agreed that: The GRANTEE agrees that: a. all funds awarded will be used for the sole purposes of implementing the project submitted for a Colorado Tree Coalition grant b. because this grant is funded by federal dollars the guidelines in the following OMB circulars will be followed: Al 10 Administrative Standards Non -Profits, Educational Institutions, A 122 Cost Principles Non -Profits, A133 Auditing Standards All Entities, 7CFR 3017 Debarment and Suspension Government wide Requirements for Drug -Free Workplace for all Entities, 7 CFR 3018 Restrictions on Lobbying for All Entities, SF -424b Standard Assurances (Non -Construction), and 7 CFR Administrative Standards for Institutions of Higher Education, Hospitals, and Other Non -Profit Organizations. (As of 2/4/02 all the above can be located at www.whitehouse.gov/omb/circulars/index.html). c. reporting requirements mailed to GRANTEE will be completed within 15 days and returned. d. newspaper articles, flyer, and photographs taken of this project will be submitted within 15 days of the completion of the project. These may be used for outreach efforts. e. any brochure, booklet, or educational materials produced will be submitted within 15 days of the completion of the project. The GRANTOR has the right to use said material in its outreach efforts. f. any problems or delays with said project will be reported to the GRANTOR immediately. g. funding for this project will not be requested sooner than 30 days prior to start- up. 2. GRANTOR agrees to: a. Provide cash payment as stated in award letter dated February 9, 2015. 3. It is understood between the GRANTEE and the GRANTOR that this Agreement shall begin on the date first above written, and shall remain in force until 9/30/2015. Should an extension be required it will be requested by GRANTEE 60 days in advance of this date. 4. This Agreement may be terminated by either party ten (10) days following written notice to the other party.
