A RESOLUTION EXCUSING THE ABSENTEEISM OF
LIQUOR AND BEER LICENSING BOARD MEMBER DON
DIFATTA
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
For the purposes of Section 11-3-5, P.M.C., Mr. Don DiFatta’s absences from the
Liquor and Beer Licensing Board meetings that occurred on February 18, March 4, and
March 18, 2015 are hereby excused.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Resolution to effectuate the policies and
procedures described herein.
SECTION 3.
This Resolution shall become effective immediately upon final passage.

LICENSING BOARD MEMBER DON DIFATTA
SUMMARY:
The proposed Resolution excuses the absences, as a result of medical necessity, of Liquor and
Beer Licensing Board (hereinafter “Board”) member Mr. Don DiFatta from the meetings that
occurred on February 18, March 4, and March 18, 2015.
PREVIOUS COUNCIL ACTION:
On July 14, 2008, Council adopted Ordinance No. 7830 which incorporated an exception to the
provision in P.M.C. § 11-3-5 that requires the automatic removal of a board member who fails to
attend three (3) consecutive meetings of the Board. The exception allowed for City Council to
excuse absences that are caused by circumstances beyond the control of the board member or
are otherwise for good cause.
BACKGROUND:
The Pueblo Municipal Code currently provides that “\[a\]ny member of the Board may be removed
by the City Council for nonattendance to duty or for cause. Any member who fails to attend three
(3) consecutive meetings of the Board shall be removed from the Board, unless the City Council
excuses any such absences.” P.M.C. § 11-3-5(b). Unlike many other boards and commissions
which meet only one time per month, the Liquor and Beer Licensing Board meets two times per
month. As a result, it is possible for a member to exceed the permitted number of absences
within only a one and one-half month period of time.
Member Don DiFatta is currently suffering from a serious medical condition that has necessitated
his absenteeism from the Board for the meetings held on February 18, March 4, and March 18,
2015. The other members of the Board state that Mr. DiFatta is a qualified and experienced
member of the Board and desire for him to remain a member. The proposed Resolution requests
that Mr. DiFatta’s absences from the Board meetings that occurred on February 18, March 4, and
March 18, 2015 be excused so that he remains a member of the Board.
FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
Staff and the Liquor and Beer Licensing Board recommend adoption of the Resolution.
STAKEHOLDER PROCESS:
Not applicable.
ALTERNATIVES:
The City Council could decline to enact the proposed Resolution and board member Don
DiFatta’s absences would not be excused which would result in his removal from the Board.
This alternative is not recommended.
RECOMMENDATION:
Approval of the Resolution.
