AN ORDINANCE CHANGING ZONING RESTRICTIONS
FOR PROPERTY COMMONLY KNOWN AS 413
EAGLERIDGE BOULEVARD FROM I-2, LIGHT
INDUSTRIAL DISTRICT TO BP, BUSINESS PARK
DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering parcels of land commonly known as 413
Eagleridge Boulevard are hereby changed from 1-2, Light Industrial District to BP,
Business Park District and upon passage of this Ordinance, zoning restrictions affecting
BP, Business Park District, shall apply to said property as follows:
Lot 1, Block 1, Fountain Park Commercial Center Subdivision
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of the Ordinance to effectuate the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

DISTRICT
SUMMARY:
The applicant is requesting to rezone the property commonly known as 413 Eagleridge
Boulevard from I-2, Light Industrial District to BP, Business Park District.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The applicant is requesting to rezone 5.6 acres of property from I-2 to BP to facilitate
commercial uses permitted in the BP zone. The existing 45,176 square-foot building
located on the property was constructed in 1974 by U.S. West Communications. A
parking field is located on the west side of the building and the site is contained by a six
foot tall chain-link fence. Landscaping, site drainage, sidewalks, and ADA
accommodations do not meet current City Codes. It has been presented to City staff
that as part of any new permit approvals the site will be brought into compliance with
current City Codes. As proposed, the development plans for this property will be
compatible within the neighborhood and will comply with City standards for
development.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their February 11, 2015 Regular Meeting,
voted 4-0 to recommend approval with Commissioners Latka and Seybold being
absent.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
