HomeMy WebLinkAbout13192RESOLUTION NO. 13192 A RESOLUTION ADOPTING POLICIES THAT ESTABLISH CRITERIA FOR THE EVALUATION OF PROPOSED LARGE-SCALE ANNEXATIONS INTO THE CITY OF PUEBLO WHEREAS, the Pueblo Regional Comprehensive Plan, as amended on September 8, 2014, requires that proposed large-scale developments that are within the Special Development Area future land use designations include Master Planning and ‐ locationspecific infrastructure and private development plans; and WHEREAS, the Pueblo Regional Comprehensive Plan does not provide criteria for the evaluation of the required master plans for large-scale developments within Special Development Area future land use designated areas ; and WHEREAS, the annexation of large areas of property into the City of Pueblo commit the provision of municipal services long into the future, so it is essential that these scale of annexations are very carefully reviewed and analyzed to reasonably ensure the economic viability, logical extension of City boundaries, and the integration with the economic and social fabric of the community; NOW THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Pueblo City Council hereby adopts the following policies that establish the criteria for the evaluation of proposed large-scale annexations of property into the City of Pueblo: POLICY 1 The City Council shall evaluate, analyze, and assess the relative fiscal impacts associated with other successful large-scale annexations to reasonably ensure that any similar proposal provides long-term economic development that definitively benefits the viability of the overall City, and does not transfer the cost of such development to residents and property owners within the existing City boundaries. POLICY 2 The City shall require that any proposed large-scale annexation demonstrates how it further enhances the historic settlement pattern of the City, connects physically and socially with the City, assimilates City services and functions, and becomes a logical and integrated extension of the City. POLICY 3 The City Council shall encourage any proposed large-scale annexation to demonstrate how it would provide new or expanded opportunities, relationships, linkages, and quality of life options in its master plan that do not currently exist within the City, and advance and further the overall goals and objectives of the City’s Comprehensive Plan. POLICY 4 The City Council shall encourage any proposed large-scale annexation to demonstrate best management practices in regard to natural and physical features for the land area and integrate and implement water conservation and storm water quality management methods and techniques that are sustainable, cost effective, and innovative. These best management practices should be reflected and memorialized in the project’s development criterion and guidelines. POLICY 5 For large scale developments in excess of 1,500 acres that are requesting annexation and zoning, the City Council shall require applicants to apply for and comply with the provisions of the City’s Master Planned Community Zone District. SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 3. This Resolution shall become effective immediately upon passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Scott Hobson, Planning & Community Development SUBJECT: A RESOLUTION ADOPTING POLICIES THAT ESTABLISH CRITERIA FOR THE EVALUATION OF PROPOSED LARGE-SCALE ANNEXATIONS INTO THE CITY OF PUEBLO SUMMARY: Attached is a Resolution for City Council consideration approving policies that establish criteria for the evaluation of proposed large-scale annexations into the City of Pueblo. These criteria would apply to the review of the proposed Pueblo Springs Ranch Annexation, as well as any other proposed large-scale annexations. PREVIOUS COUNCIL ACTION: On September 8, 2014, City Council approved Resolution No. 8771 amending the Pueblo Regional Comprehensive Plan (“Comprehensive Plan”). BACKGROUND: The Comprehensive Plan requires that proposed large-scale developments that are within the Special Development Area future land use designations include Master ‐ Planning and locationspecific infrastructure and private development plans. Although, the Comprehensive Plan does not provide criteria for the evaluation of the required master plans within Special Development Area future land use designated areas. This Resolution would establish policies that have been recommended by the City’s core consultant team for the Pueblo Springs Ranch Annexation represented by Donald Brandes and Bob Eck from Matrix Design Group and Gilbert McNeish from the law firm of Spencer Fane Britt & Browne LLP. At the March 9, 2015 City Council Work Session, Mr. Brandes and Mr. Eck reviewed the recommended policies with City Council. In 2008 the review team for the proposed Pueblo Springs Ranch Annexation, which included Mr. Brandes, Mr. Eck and Mr. McNeish, drafted policies for the review of the annexation petitions. The annexation petitions submitted in 2008 were ultimately withdrawn by the owners of the property. The policies were reviewed by City Council at that time, but were not formally adopted by Resolution.
