RESOLUTION NO. 13134
A RESOLUTION IMPOSING A TEMPORARY
MORATORIUM ON THE ISSUANCE OF DEMOLITION
PERMITS FOR BUILDINGS LARGER THAN 15,000
SQUARE FEET
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City Council finds and determines that the demolition of large structures may
expose the public to health risks and may contaminate the air, surface and ground
waters and soils with hazardous substances such as asbestos, lead and PCB’s.
SECTION 2.
The City Council finds and determines that the inadequate regulation of large
scale demolitions poses a threat to the City’s wastewater and stormwater systems.
SECTION 3.
The City Council finds and determines that the demolition of large structures
which are adjacent to a public right-of-way also endangers the safety of pedestrians on
adjoining sidewalks and traffic in adjoining streets, alleys and roadways.
SECTION 4.
A temporary moratorium on the City’s issuance of demolition permits for buildings
larger than 15,000 square feet is hereby approved and adopted. The temporary
moratorium shall expire on June 30, 2015.
SECTION 5.
During the term of this temporary moratorium, the appropriate officers and staff of
the City are directed to review Section 4-2-6 of the Pueblo Municipal Code and Section
3303 of the International Building Code and to propose appropriate and necessary
amendments to same which further protect the City’s residents and the City’s
infrastructure.
SECTION 6.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Resolution which are necessary or appropriate
to effectuate the transactions described herein.
SECTION 7.
This Resolution shall become effective immediately upon final passage.
SECTION 8.
The City Council finds and determines that the immediate adoption of this
Resolution is necessary for the protection of the health, safety and welfare of the
residents of the City.

SUMMARY:
Attached is a Resolution which places a temporary moratorium, until June 30, 2015, on the
issuance of demolition permits for large buildings located in the City. The moratorium only
applies to buildings larger than 15,000 square feet.
PREVIOUS COUNCIL ACTION:
Section 4-2-6 of the Pueblo Municipal Code relating to the protection of the public during the
demolition of buildings was last amended by City Council on March 22, 2010 through Ordinance
No. 8157.
BACKGROUND:
The demolition of large buildings poses a threat to the health, safety and welfare of residents of
the City. The demolition of large buildings, particularly older structures, may expose the public
to health risks and may contaminate the air, surface and ground waters and soils with
hazardous substances such as asbestos, lead and PCB’s. Inadequate regulation of large scale
demolitions poses a threat to the City’s wastewater and stormwater systems. The demolition of
large structures which are adjacent to public a right-of-way also endangers the safety of
pedestrians on adjoining sidewalks and to traffic in adjoining streets, alleys and roadways.

ALTERNATIVES:
Failure to approve this Resolution means that the current Pueblo Municipal Code Sections and
International Building Code Sections relating to demolitions will not be reviewed or updated.
RECOMMENDATION:
Adopt the Resolution.
